MAPC MINUTES
JULY 24, 1990
body
The Metropolitan Area Planning Commission met Thursday July 24, 1990 in the City Council Chambers, 314 W. Washington Avenue. Items considered are as follows:
#1 RZ90-23 Mona Kay requested rezoning from R-1 to R-2 for Lots 34 & 35 of the Ruth Ann Subdivision. The property is located on the west side of Holmes Road, at the south end of Holmes Road. This request was withdrawn by the owner’s representative during the meeting held July 10, 1990.
Several in attendance spoke in opposition to this request citing existing sewer problems, increased traffic congestion, etc. as reasons why the rezoning should not be approved.
Mr. Vance made a motion to approve this request with the following stipulations:
1. That final reading by the City Council be tabled until a site development plan has been approved by the MAPC with the development to be in strict compliance with the surrounding development.
2. That the owner improve the street at the time of development if it adjoins the already improved portion of the street. If it does not adjoin the improved section then the owner shall sign a street improvement agreement stating they will participate in the cost of improvements when they are made.
A further statement was made that the 25' of right-of-way is sufficient with the plat being changed to reflect same.
Mr. Blalock seconded the motion. Voting was 2 in favor, 2 opposed. Rezoning requires five (5) affirmative votes for approval: therefore, REQUEST DISAPPROVED.
#2 RP90-26 Mona Kay requested approval of Lot, Kay’s Addition, a replat of Lots 34 & 35 of Ruth Ann Subdivision. The property is located on the west side of Holmes Road, at the south end of Holmes Road. This request was also withdrawn from consideration at the July 10, 1990 meeting. Mr. Vance made a motion to approve this request contingent upon the City Council overruling the decision of the MAPC and with the stipulation as follows:
1. That final reading by the City Council be tabled until a site development plan has been approved by the MAPC with the development to be in strict compliance with the surrounding development.
2. That the owner improves the street at the time of development if it adjoins the already improved portion of the street. If it does not adjoin the improved section then the owner shall sign a street improvement agreement stating they will participate in the cost of improvements when they are made.
A further statement was made that the 25' right-of-way is sufficient with the plat being changed to reflect same.
Mr. Patteson seconded the motion. Voting was 4 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

A motion was made by Mr. Vance to approve the PUD for preliminary, conceptual approval asking that the golf course and the entry road servicing the club house be named a phase before seeking final conceptual approval and with the stipulation that a site development plan be sub- mitted and approved for the club house, parking and drainage before a building permit is issued.
A statement was also made that the Commission would like to see at the next regular meeting, if the owners are ready to proceed, only the phase called golf course for final approval and final conceptual approval on the total PUD. A further statement was made that each phase, one through five, should be submitted in the same fashion for preliminary and final approval as separate matters.

A motion to approve this request was made by Mr. Coleman subject to the determination of the existence of an easement on the property south of this property. If there is a not a sufficient easement then an additional 10' of right-of-way shall be granted on the lots north of the ditch and shown on the plat thus shifting the street 10' north and west. It was further stated that if the Mayor or his designate determined that the easement was sufficient that the stipulation regarding right-of-way could be released. Mr. Vance seconded the motion.
