ORDINANCE TO VACATE AND ABANDON MIDDLEFIELD DRIVE, WHITEMAN AVENUE, SPURLOCK DRIVE

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, March _____, 1974, praying the City Council vacate and abandon the streets described as:
Begin at Middlefield Drive at the North right-of-way line of Apache Avenue extended across Middlefield Drive, all of Middlefield Drive north of such North right-of-way line of Apache Drive, all of Whiteman Avenue and all of Spurlock Drive in the City of Jonesboro, Craighead County, Arkansas.
Platted and filed for record in the Recorder's Office at Jonesboro, Arkansas in Record Book 129 page 76; and
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that the streets, or portions thereof, hereinbefore described, have heretofore been dedicated to the public use as streets, herein described; has never been actually developed or used by the public as streets for many years after the filing of the plat; that all of the owners of property abutting upon the portions of the streets to be vacated above, filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such streets.
NOW THEREFORE, be it ordained by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the streets described as follows:
Begin at Middlefield Drive at the north right-of-way line of Apache Avenue extended across Middlefield Drive, all of Middlefield Drive north of such North right-of-way line of Apache Drive, all of Whiteman Avenue and all of Spurlock Drive in the City of Jonesboro, Craighead County, Arkansas.
Section 2: A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County and recorded in the deed records of said county.
Section 3: This ordinance shall take effect and be in force from and after its passage.
