Minutes for the City Council meeting on July 5, 1988

A Public Hearing was held at 7:15 p.m. regarding an alley abandonment between Gordon and Allen by Gary Holland. No objection was voiced.

 

City Council Minutes - July 5, 1988

 

The Jonesboro City Council met at 7:30 p.m. in regular session. Present were Mayor, City Clerk, City Attorney, and all Aldermen with the exception of Mr. Sanderson, who was absent.

 

The minutes of June 20, 1988, were approved as mailed on motion by Mr. Parks, seconded by Mr. Evans. All voted aye.

 

Mr. Hinson offered the following ordinance for first reading:

 

AN ORDINANCE TO VACATE A FIFTEEN FOOT ALLEY RUNNING NORTH AND SOUTH BETWEEN ALLEN AND GORDON STREETS BEING BOUNDED ON THE WEST BY LABAUME AND ON THE EAST BY MILLER STREET

 

Mr. Hinson moved, seconded by Mr. Nix to suspend the rules and place the ordinance on second reading. All voted aye. The ordinance was read for the second time.

 

Mr. Stricklin offered the following ordinance for first time:

 

AN ORDINANCE TO CONDEMN STRUCTURE LOCATED AT 3809 STEVENS, 317 W. WOODROW, 2414 Boydston, 4108 RACE, 500 FLOCK OF HOUSTON

 

Mr. Evans moved, seconded by Mr. Shelton to suspend the rules and place on second reading. All voted aye. The ordinance was read for the second time.

 

The following ordinance was on third reading: (Rez/R -1 to R -2, SW side of Curtview & Race, Rainwater)

 

AN ORDINANCE TO AMEND ORDINANCE #954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES

 

Mr. Mays moved, seconded by Mr. Hannah for the adoption of the ordinance with the emergency clause. All voted aye. The ordinance was given the number 2132.

 

The following ordinance was on third reading: (Rez/R -1 to C -3, Wood Estates 8.5 acres)

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES

 

Attorney for the property owners, Skip Mooney stated the highest and best use of 8.5 acres would be commercial. He added there were no immediate plans for specific commercial development. He emphasized the council and MAPC can require a buffer zone between any commercial and residential developments.

 

Mooney stated that only 2 lots on Bernard are contiguous to the tracts making up 8.5 acres and the balance of the Wood Estate, in excess of 22 acres bound by Bernard, Highland, Hillcrest and Wilkins will be developed into a highly restricted subdivision.

 

Mr. Hannah moved, seconded by Mr. Stricklin to amend the ordinance to stipulate that when and if the property that is rezoned C-3 is developed, that a fair and reasonable buffer zone, to be determined by the adjoining property owners, City Council, MAPC, school officials and developers be constructed between the C -3 zoning and any and all property adjoining, that is not zoned C -3. A roll call vote was taken and all voted aye.

 

Mr. Hannah stated that the U.S. Supreme Court left the Council no choice, noting the higher court held that property owners are entitled to fair and reasonable use of the land, and the only reasonable use for the property is commercial development.

 

Mr. Park stated he objected to the proposal because of the impact a commercial zoning classification could have on Hillcrest Elementary School, and residents of Bernard between Highland and Wilkins.

 

Mr. Mays moved, seconded by Dr. Strauser for the adoption of the ordinance as amended with the emergency clause. A roll call vote was taken and all voted aye, with the exception of Mr. Park who voted nay. The ordinance passes 10-1. The ordinance was given the number 2133.

 

Mr. Nix moved, seconded by Mr. Stricklin to accept the appointment of Greta Troutt to replace Frances Kemp on the Forum Commission, with term to expire 4/3/90.

 

With no further business, the meeting adjourned.
