AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter more fully described, was duly filed in the County Court of Craighead County, Arkansas on April 28th, 1987; and,

 

WHEREAS, said petition for the annexation of the land was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and,

                     

WHEREAS, an order setting a hearing upon said petition was duly had and held in the Quorum Court of Craighead County, Arkansas, on May 26th, 1987 at 7:00 o’clock p.m. at which hearing it was duly found and declared that the petition for annexation was right and proper and that the lands hereinafter more fully described should be annexed to the City of Jonesboro, Arkansas, where upon an order of annexation was made and entered; and,

 

WHEREAS, thirty (30) days have expired since the order of annexation was filed on June 9th, 1987 and no proceedings to prevent the annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, the annexation proceedings were in all things confirmed by the Quorum Court of Craighead County, Arkansas, by its order of June 24th, 1987.

 

NOW, THEREFORE, BE IT ORDAINED AN ENACTED by the City Council for the City of Jonesboro, Arkansas:

 

Section One: The territories and lands annexed to the City of Jonesboro, Arkansas by order of the Quorum Court of Craighead County, Arkansas filed May 26th, 1987 be and are hereby accepted by the City Jonesboro, Arkansas, and the territory hereinafter more fully described shall be hereafter deemed and taken to be a part of parcel of the limits of the City of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section Two: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are more fully described as follows: (Henry Turner)

Walker: The North 10 acres of the S ½ S ½ SW ¼ SE ¼ of Section 27, Township 14 North, Range 3 East, containing 10.0 acres.

Lyles: Part of the SE ¼ SE ¼ Section 27 T14N, R3E, Being more particularly described as follows; Begin at the SE Corner of said SE ¼ SE ¼; thence West 1002.5’ to the West R/W line of Ark. Hwy. #226, the point of beginning proper; thence N16˚35’W 156.5’; thence West 397.5’; thence S1˚55’ W on the West line said SE ¼ SE ¼ - 150.0’ to the SW Corner of said SE ¼ SE ½; thence East on the south line of said SE ¼ SE ¼ to the West line of Ark. Hwy. #226 to the point of beginning proper, containing 1 acre, more or less.

Porter: A part of the S ½ SE ½ of Section 27, T14N, R3E, being more particularly described as follows; Begin at the NW Corner of aforesaid SE ½ SE ½; thence South on the 40 acre line 497.5’ to the point of beginning proper; thence S75˚ 15’E 28.3’; thence S 71˚04’ E 182.5’; thence S 80˚ 02’ E 136.8’ to the centerline of Ark. Hwy. #226; thence 30˚15’ W along said centerline 50.0’; thence S20˚53’ W along said centerline 36.6’ to the North line of Lot 5 of McDaniel 1st Addition produced East; thence S88˚05’ W on the North line of said lot 5 produced East and on the North line of Lot 5-344.0’ to the Northwest corner of said Lot 5; thence N0˚02’W along a fence 191.3’;thence S75˚15’E 49.4’ to the point of beginning proper, containing 1.09 acres, and being subject to Arkansas Hwy. #226 R/w off and across the East side thereof lots 1, 2, 3, 4 & 5 in McDaniel Subdivision First Addition and lots 4, 5, 6, 7 & 8 in McDaniel Subdivision;   (III).

Turner: A part of the NE ¼ NE ¼ of Section 34, Township 14 North, Range 3 East, being more particularly described as follows; Begin at the Northeast Corner of the NE ½ NE ¼ of said section 34; thence N87˚54’E on the section line 356.7’ to the centerline of a pubic road; thence S2˚06’ E along said centerline 64.0’; thence S17˚39’W along said centerline 174.0’; thence S28˚04’W along said centerline 113.0’; thence N38˚36’ W 404.8’ to the point of beginning, containing 1.45 acres, more or less, Subject to Arkansas Hwy. No.226 Right-of-way.

 

Section Three: The lands and territories annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro and assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.

 

Section Four: The lands and territories hereby annexed to the City of Jonesboro are hereby zoned Residential (R-1).

 

Section Five: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that the property and the citizens of the territory described above can be entitled to fire, police, zoning, water, sewage and other protections and benefits and that these benefits and protections are urgently needed now in order to allow orderly growth and development of the lands and territories hereinabove described.

 

THEREFORE, an emergency is hereby declared to exist and this Ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage and approval.
