AN ORDINANCE ESTABLISHING THE NORTH CARAWAY ROAD  STREET IMPROVEMENT DISTRICT NUMBER 1:  AND FOR OTHER PURPOSES.

WHEREAS,  parties claiming to be the owners of a majority in value as shown by the  last  county  assessment of the property located within the district  hereinafter described have  filed  a  petition praying that a street improvement district be established for the purposes hereinafter set forth;  and

 

WHEREAS, after due notice as required by law, the City Council of the City of Jonesboro, Arkansas, held a public hearing to meet and hear all owners of real property in the proposed district desiring to be heard and has found and ruled that the petition contains the signatures of the majority in value of the real property owners within the said district; and

 

WHEREAS, the aforesaid petition should be approved and that the proposed street improvement district should be established in accordance with Arkansas Code Ann. § 14-322-101, et seq., and other applicable laws of the State of Arkansas.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1:   There is hereby established a street improvement district embracing the following real property with improvements:

 

Commence at the Southeast Corner of the Northeast Quarter of the Northeast Quarter of  Section 17, Township 14 North, Range 4 East, and run thence North 417.20 feet to the point of beginning proper; thence run North 57°33' East 204.63 feet into a part of the Northwest Quarter of the Northwest Quarter of Section 16, Township 14 North, Range  4 East; thence North 29°19' West 67.2 feet; thence South 71° West 25 feet; thence North 20° 22' East 318.0 feet; thence North 86°59' East 33.6 feet; thence North 36°42' West 61.2 feet;   thence South 74°02' West 53.0 feet; thence North 2°34' West 400.7 feet to the North line of said Northwest Quarter of  the Northwest Quarter of Section 16; thence East along said North line 125.4 feet; thence North into the West Half of the Southwest Quarter of the Southwest Quarter of  Section 9, Township 14 North, Range 4 East a distance of 527.99   feet; thence West 37.0 feet; thence North 100.0 feet; thence East 37.0  feet; thence North 100.0 feet; thence West 83.0 feet; thence North 105.0 feet; thence East 30.0  feet;  thence  North 72.0 feet; thence East 53.0 feet; thence North 85.0 feet; thence  West 83.0 feet; thence North 132.0 feet; thence East 135.0 feet; thence North 198.0 feet; thence East 990.0 feet; thence North 1310.0 feet; thence West 1320.0 feet to the East Line of the East Half of the Southeast Quarter of Section 8, Township 14 North, Range 4 East;  thence  South  along  said  East  line 179.18  feet  to the Southerly right-of-way of Greensboro Road; thence South 43.°07' West along said right-of-way 253.5 feet; thence South 37° 13' East 102.7 feet; thence South 25°42' West 134.0 feet; thence South 89°10' West  90.0  feet;  thence South 22°48'  West 128.0 feet;  thence South 63°35' West 202.6 feet; thence South 2°53' East 278.0 feet; thence South 89°53' West 85.0 feet; thence South 0°17' West 297.0 feet; thence South 19°40' East 230.0 feet; thence South 31°21' East 227.0 feet; thence South 13°39' West 98.0 feet; thence South 89°21' East 167.0 feet;  thence South 210.0 feet; thence West 230.0 feet; thence South 389.16 feet; thence East 200.0 feet; thence South 210.0 feet to the North Line of the Northeast Quarter of Section  17, Township 14 North, Range 4 East; thence West 200.0 feet; thence South 396.0 feet; thence West 240.0 feet; thence South 328.8 feet; thence East 489.3 feet; thence South 281.80 feet, more or less, to the Northerly right-of-way line of Johnson Avenue; thence North 57°33'  East 200.83 feet to the point of beginning proper, all  being a part of the West Half of the Northwest Quarter of the Northwest Quarter of Section 16;  a part of the West Half of the Southwest Quarter of Section  9; a  part of the East Half of the Southeast Quarter of Section 8; and a part of the East Half of the North East Quarter of the  Northeast Quarter of  Section 17,  all  in Township 14 North, Range 4 East, Craighead County, Jonesboro, Arkansas.  (which includes Sylvan Hill Estate Addition and Sylvan Hill Estates 2nd Addition to Jonesboro, AR) and Sylvan Hill Estates 3rd Addition to Jonesboro, AR and Sylvan Hill Estates 4th Addition to Jonesboro, Ar.

 

That the purpose of the establishment of said improvement district shall be to pay for the necessary needs improvements to North Caraway Road  along with all work necessary and incidental  thereto, including, but not limited to, paving and curbing of said road.  Further, the sum of $58,550.00 shall be assessed against the real property within the district as allowed by applicable state law as set forth hereinafter.

 

SECTION 2:   That said street improvement district shall be known as North Caraway Road Street Improvement District No. 1.  That Jack Sugg, Jerry Allison and Robert Lockridge shall be and are hereby appointed Commissioners to serve on the Board of Commissioners with the authority to make assessments and carry out the improvements provided hereinabove.

 

SECTION 3:   That the property owners within the district shall pay the amount of the assessments in one (1) lump sum payment or in five (5) equal annual installments with interest per annum at the real of 12%.  That the first annual installments shall be collected by the County Collector on August 31st, 1989.  That the second and subsequent annual installments shall be paid at the time provided by law for paying the first installment of general taxes.

 

SECTION 4:   Due to the fact that North Caraway Road is an important traffic artery to the City of Jonesboro and that said road is dangerous to the public at large in its present condition, an emergency is hereby declared to exist and, therefore, this ordinance being necessary for the preservation of the public peace, health and safety shall take effect immediately and be in force from and after its passage.
