AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, on October 17, 1975, and
WHEREAS, said petition for the annexation of said land was duly signed by the sole owner of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on November 20, 1975, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated November 20, 1975, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of December 22, 1975.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of November 20, 1975, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing herein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:
A part of the Northeast Quarter of Section 23 and a part of the Northwest Quarter of Section 24, all being in Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows: Beginning at the Quarter Corner between Section 23 and 24 of aforesaid Township and Range and the point of beginning proper; thence South 89 degrees 40 minutes West along the centerline of Nettleton Avenue 555.0 feet; thence North 0 degrees 20 minutes West 156.0 feet; thence North 89 degrees 40 minutes East 15.5 feet; thence North 0 degrees 20 minutes West 254.4 feet; thence North 32 degrees 41 minutes East 100 feet; thence North 0 degrees 20 minutes West 380.0 feet; thence North 35 degrees 49 minutes East 144.1 feet; thence South 89 degrees 40 minutes West 761.8 feet; thence North 0 degrees 37 minutes East 177.0 feet; thence South 89 degrees 40minutes West 395.9 feet; thence North 0 degrees 58 minutes East 565.72 feet; thence North 89 degrees 40 minutes East 1584.5 feet to the East line of Section 23 and West line of Section 24 of aforesaid township and range; thence South 1 degree 06 minutes West along East line of Section 23 and West of line of Section 24, 953.40 feet; thence North 89 degrees 40 minutes East into the Northwest Quarter of Section 24 of aforesaid township and range 341.6 feet; thence South 0 degrees 52 minutes 30 seconds West 579.9 feet; thence South 89 degrees 41 minutes West 343.0 feet to the West line of Section 24 and the East line of Section 23 of aforesaid township and range; thence South 1 degree 06 minutes West along the East line of Section 23 and West line of Section 24 of aforesaid township and range200.0 feet to the center line of Nettleton Avenue and the point of beginning proper and containing 41.75 acres, more or less, Craighead County, Arkansas, and also being known as Scenic Hills Sub-division, First Addition, Jonesboro, Arkansas.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 4 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-2).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
