AN ORDINANCE CORRECTING THE PROPERTY DESCRIPTION GIVEN IN ORDINANCE NO. 1519, AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, was duly filed in the County Court of Craighead County on April 1, 1976; and

 

WHEREAS, said petition for the annexation of said land was duly signed by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, on May 3, 1976, a hearing was held at which it was duly found and declared that said petition of annexation was right and proper and that said lands should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and

 

WHEREAS, said land was approved for annexation by the Metropolitan Area Planning Commission and for R-2 zoning on May 13, 1976; and

 

WHEREAS, Ordinance No. 1519 was subsequently presented to the Jonesboro City Council and after its third reading thereby was approved by said City Council on July 19, 1976; and

 

WHEREAS, the description contained in Ordinance No. 1519 does not contain a complete description of all of the land approved for annexation by the City Council; and

 

WHERAS, it is necessary that Section 2 of Ordinance No. 1519 heretofore approved be amended so as to give it full and correct effects.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: That Section 2 of Ordinance No. 1519 approved on July 19, 1976, is amended as follows:

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit:

 

Block A of Cedar Heights 6th Addition: Begin at the Southeast Corner of Lot 3 of Cedar Heights 5th Addition to Jonesboro, Arkansas; thence 1 Degree 37 Minutes West 148.8 feet; thence South 1 Degree 54 Minutes West 263.3 feet; thence South 1 Degree 29 Minutes West 74.0 feet; thence South 4 Degrees 29 Minutes West 58.1 feet; thence South 1 Degree 25 Minutes West 185.8 feet to the Northwest right-of-way line of Arkansas Highway No.1; thence South 59 Degrees 12 Minutes West along said right-of-way line 24.0 feet; thence South 89 Degrees 48 Minutes West 109.3 feet to the Southeast Corner of Lot 5 Block B of Cedar Heights 4th Addition; thence North 16 Degrees 24 Minutes West 131.6 feet along the East line of said Lot 5 to the South right-of-way line of Russell Drive; thence Northeasterly long a 61 Degree 06 Minutes curve to the left and along said right-of-way 101.2 feet to the P.T. of said curve; thence North 6 Degrees 54 Minute East along said right-of-way 120.0 feet to the P.C. of a 40 Degree 16 Minute curve to the left; thence Northwesterly along said curve and on the East right-of-way line of Russell Drive 139.6 feet to the P.T. of said curve; thence North 49 Degrees 22 Minutes West along said right-of-way line 24.5 feet to the P.C. of a 31 Degree 41 Minute curve to the right; thence Northwesterly along said curve and Russell Drive right-of-way line 51.0 feet to the P.T. of said curve; thence North 33 Degrees 10 Minutes West along said right-of-way 88.4 feet to the P.C. of a 58 Degree 47 Minute curve to the right; thence Northwesterly along said curve and along Russell Drive right-of-way 45.0 feet to the P.T. of said curve; thence North 6 Degrees 41 Minutes West along said right-of-way 39.7 feet to the P.C. of a 24.5’ radius curve to the right; thence Northeasterly along said curve 41.3 feet to the P.T. of same and the South right-of-way line of Phillips Drive; thence South 88 Degrees 55 Minutes East along the South right-of-way line of Phillips Drive 134.7 feet to a point on a 50’ radius curve to the left; thence Southeasterly and Northeasterly along said curve 175.4 feet to a point on said curve; thence North 50 Degrees 53 Minutes East 82.8 feet to the point of beginning, containing 2.84 acres, more or less;

All of the rest and remaining parts of Ordinance No. 1519 shall remain in full force and effect as heretofore approved.
