CITY COUNCIL MINUTES - OCTOBER 7, 1996

 

The Jonesboro City Council met Monday, October 7, 1996, at 6:30 p.m. A full quorum was in attendance. Present were: Hubert Brodell, Mayor; Donna Jackson, City Clerk, Phillip Crego, City Attorney; and 11 council members. Those members were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

The minutes of September 3, 1996, were approved as delivered by Councilman Young and seconded by Councilman Harpole. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

As the first order of business, Leonard Jadrich spoke to Council, requesting recognition of the Unionization of Jonesboro Firefighters Local 3718, and implementation of Payroll deductions for Union dues, similar to that of the current Christmas Club deduction. Mr. Jadrich explained a large percentage of the firemen have joined the Union and wanted to have dues taken from their paycheck. Councilman Harpole questioned Mr. Jadrich's statement "Recognition of the Union". Mr. Jadrich explained he was referring to collective bargaining, that it was their desire to be able to discuss matters pertaining to the Jonesboro Fire Department. He suggested a committee be organized for the purpose of opening up negotiations.

 

The following ordinance was on the second reading:

 

ORDINANCE TO VACATE A 120.0' DRAINAGE EASEMENT AND A 146.6' UTILITY EASEMENT ON LOT 6, PARDEW NORTH ADDITION (GUY PARDEW & LAN METZ/ ED STEPP)

 

No further action was taken regarding this ordinance.

 

The following ordinance was on the second reading:

 

ORDINANCE TO VACATE ALLISON STREET LOCATED IN THE CURTVIEW SUBDIVISION OF JONESBORO, ARKANSAS. (RONALD L. WHITE & LAURA J. WHITE/C. M. MOONEY, SR.)

 

Councilman Tate moved, seconded by Councilman Vance to suspend the rules and place on the third reading. A voice vote was taken resulting in all council members voting aye. Those members voting were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Vance moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The ordinance was given the number 2722.

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Joyce Lackey & Tracy Spence \C.M. Mooney, Sr.)

 

Councilman Young moved, seconded by Councilman Kelton to suspend the rules and place on the third reading. A voice vote was taken resulting in all council members voting aye. Those members voting were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Young moved, seconded by Councilman Kelton for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The ordinance was given the number 2723.

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (John M. White, III \ C.M. Mooney, Sr.)

 

Councilman Harpole moved, seconded by Councilman Perrin to suspend the rules and place on the third reading. A voice vote was taken resulting in all council members voting aye. Those members voting were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Vance moved, seconded by Councilman Kelton for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Jimmy Doyle Hunt/Dan Mulhollen)                     

 

Councilman Perrin moved, seconded by Councilman Young to suspend the rules and place on the third reading, but later the motion was withdrawn. Mr. David Oswald spoke in opposition to the ordinance stating the plat was misleading, because residential homes were not shown on the plat presented by Mr. Mulhollen. The decision was made to hold the third reading for the next council meeting.

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Albert Richardson/George Hamman)

 

Councilman Vance moved, seconded by Councilman Perrin to suspend the rules and place on the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Young moved, seconded by Councilman Vance for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. The following ordinance was on the second reading:

 

ORDINANCE TO AMEND ORDINANCE NO. 2511 TO REINSTATE A MULTI-WAY "STOP" SIGN AT THE INTERSECTION OF FLINT & COLLEGE.

 

Councilman Tate moved, seconded by Councilman Province to suspend the rules and place on the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Discussion followed with several residents speaking in favor of putting back the "STOP" sign, located at the intersection of Flint and College. Mr. Dan Mulhollen, a local engineer had been asked to look at the intersection on behalf of the citizens. It was explained in this immediate area there is a High School, a fenced kindergarten playground, and Episcopal Church. Several accidents were noted which have taken place, and expressed concern over the increase in excessive speed since the removal of the Flint/College "STOP" sign. Mr. Mulhollen explained if motorists were driving the speed limit then a "STOP" sign would not be needed, but motorist are not obeying the speed limit. Mr. Mulhollen told how he and other motorists stopped for a group of two and three year olds who had been left unattended for an unsafe period of time at this intersection. The Council was urged to put the "STOP" sign back up. Mr. Aubry Scott, member of the Metropolitan Area Traffic Authority agreed the problem at Flint/College Intersection was speeding. However, Mr. Scott stated "STOP" signs do not deter speeders. Several council members inquired about speed bumps and rumble stripes as a deterrent to slow down traffic. Councilman Young moved, seconded by Councilman Perrin for the adoption of the ordinance. A roll call vote was taken resulting in an eight to three vote in favor of the motion. Those council members voting aye were: Wise, Province, Hannah, Young, Tate, Kelton, Roddy, and Perrin. Those council members voting nay were: Vance, Rega, and Harpole. The ordinance was given the number 2728.

 

Councilman Vance offered the following ordinance for the first reading:

 

AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AUTHORIZE PURCHASE OF BRIDGE PANELS AND CONCRETE PILINGS FOR REPLACEMENT ON ONE (1) FIVE-SPAN BRIDGE, LOCATED ON INGLES ROAD, OVER HIGGINBOTTOM CREEK

 

Councilman Wise moved, seconded by Councilman Harpole to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Perrin moved, seconded by Councilman Young for the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. Councilman Perrin moved, seconded by Councilman Young for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The ordinance was given the number 2729.

 

The following Mayor's Reappointments were approved:

 

* Councilman Harpole moved, seconded by Councilman Perrin to approve the Mayor's recommendation of Bill Rainwater to the Advertising & Promotion Commission with term to expire April 18, 2000. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

٭Councilman Vance moved, seconded by Councilman Young to approve the Mayor's recommendation of James Turner and Doug Gilmore to Board of Zoning Adjustment with the first term to expire March 16, 1999, and Mr. Gilmore's term to expire July of 1999. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

* Councilman Rega moved, seconded by Councilman Young to approve the Mayor's recommendation of Harry Puddephatt and Greta Troutt to the Forum Commission with the first term to expire April 3, 2001, and Mrs. Troutt's term to expire April 3, 2000. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

* Councilman Perrin moved, seconded by Councilman Roddy to approve the Mayor's recommendation of Russell Patton III, Bob Rubenstein and Frances Puryear to the Handicapped Advisory Committee with the first term to expire June 3, 1999, and the other two terms (Bob Rubenstein and Frances Puryear) to expire June 2, 2000. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

Councilman Harpole moved, seconded by Councilman Young for the adoption of a resolution condemning two Jonesboro properties: 4433 East Nettleton, owned by George Baldwin, and the other at 314 West Word, owned by Bobbie Ladden. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The resolution was given the number 1996:48.

 

Under new business, Councilman Vance moved, seconded by Councilman Harpole to approve work outside the city limits on ramps, south to the overpass. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole.

 

Councilman Rega moved, seconded by Councilman Roddy for the adoption of a resolution supporting and endorsing the adoption of Amendment 2 in the 1996 General Election. A voice vote was taken with all council members voting aye. Those members voting aye were: Vance, Wise, Province, Hannah, Young, Rega, Tate, Kelton, Roddy, Perrin, and Harpole. The resolution was given the number 1996:49.

 

With no further business, the meeting was adjourned.
