RESOLUTION AUTHORIZING THE SALE OF AN ALLEY TO SIDNEY FRANKLIN

WHEREAS, the City Council did by proper resolution passed and adopted on the 19th day of February, 1968, authorize the Mayor to option to the Postmaster General of the United States and his assigns the following described property, to-wit:
Begin at the Northwest Corner of Lot 5 of Resurvey of Collins Addition, Jonesboro, Arkansas, thence South 00°10’ East along the West line of aforesaid Lot 5, 134.5 feet to the Southwest Corner of said Lot 5: thence South 86° 35’ East along the South line of Lot 5, 13.10 feet to the point of beginning proper; thence continue South 86° 35’ West along the South line of Lot 5 a distance of 152.13 feet; thence South 88° 35’ East 31.35 feet; thence South 00° 11’ East 55.7 feet; thence North 89° 54’ West 183.35 feet; thence North 00° 04’ West 64.96 feet to the point of beginning proper,
lying immediately North of the United States Post Office building which is owned by Sydney Franklin and leased to the United States Government; and,
WHEREAS, the Postmaster General of the United States has assigned said option to Sydney Franklin and the said Sydney Franklin has not given notice of his intention to exercise his option on said property and it appears that a portion of his property may have been dedicated to the City of Jonesboro for an alley in Deed Record 20 at page 352 which would be described as follows:
Begin at Northwest Corner of Lot 5 of Resurvey of Collins Addition to Jonesboro, Arkansas; thence South 0° 10’ East along the West line of said Lot 5, 134.5 feet to the Southwest Corner of said Lot 5; thence South 86° 35’ East along the South line of Lot 5, 13.10 feet to the point of beginning proper; thence continue South 86° 35’ East 152.13 feet; thence South 88° 35’ East 31.35 feet; thence South 0° 11’ East 10.0 feet; thence North 88° 35’ West 31.80 feet; thence North 86° 35’ West 151.68 feet; thence North 0° 04’ West 10.01 feet to point of beginning proper.
AND WHEREAS, the City council finds that said lands have never been used for an alley for travel by the general public and is not needed by the City for an alley way and it would be impractical to use said property as an alley and that said property should be sold to Sydney Franklin under the terms of the aforementioned option all pursuant to the authority granted by Arkansas Statutes §19-2304.
It is, therefore, RESOLVED by the City Council that the above described dedicated alley be sold to Sydney Franklin pursuant to the option aforementioned and the Mayor and City Clerk are hereby authorized to execute the necessary deed to convey said alley.
