AN ORDINANCE ACCEPTING CERTAIN LANDS TO THE CITY OF JONESBORO, ARKANSAS: ASSIGNING SAID ANNEXED TERRITORY TO WARD 4: ZONING SAID ANNEXED TERRITORY C-3: DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a Petition was filed by certain real estate owners of property contiguous to and adjoining the incorporated City of Jonesboro, Arkansas, and;
WHEREAS, said property owners desire that certain property be annexed to said incorporated town, and
WHEREAS, said Petition was filed on the 21st day of November, 1985, and;
WHEREAS, the County Court entered an Order setting a hearing date for the 23rd day of December, 1985, and on that date the Court did enter an Order of Annexation to said property annexing the same to the incorporated City of Jonesboro, Arkansas, said property being more particularly described as follows: (Elmer Bowen, S. of Bypass, adjacent to Candlewood Estates, and Bob’s Small Engine Repair - Curt Huckaby)
A part of the Southeast Quarter of the Northwest Quarter of Section 36, Township 14 North, Range 3 East, described as follows: Beginning at the Northwest Corner of said Southeast Quarter of the Northwest Quarter of Section 36, thence East 437.6 feet, thence South 458 feet to center of Highway No. 49, thence South-westerly along center of said Highway, 110 feet; thence Northwesterly 422 feet to a point 481.4 feet South of point of beginning, thence North to point of beginning, containing 6 acres, more or less.
WHEREAS, a copy of the Plat to the above described property is attached to this Ordinance and made a part hereof as through set out word for word, and:
WHEREAS, it is the desire of this Council to accept said territory as part of the incorporated City of Jonesboro, Arkansas; and
WHEREAS, a green belt buffer zone of 25 ft. width will be included along and adjacent to Candlewood Estates, when developed by the property owner.
It is determined by the City Council that the immediate passage of this ordinance is necessary for the health, benefit and welfare of the citizens of Jonesboro, Arkansas, and therefore, an emergency exists and this Ordinance shall have full force and effect from the date of passage and publication.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the incorporated City of Jonesboro, Arkansas, that said property more particularly described above, a copy of the Plat which is attached hereto and made a part hereof as though set out word for word be accepted as part of the incorporated City of Jonesboro, Arkansas.
BE IT FURTHER RESOLVED that the County Clerk duly certified two (2) copies of the entire proceedings and Plat, and forwarded one copy to the City Council of Jonesboro, Arkansas, and the other to the Secretary of State who shall file and preserve the same according to Arkansas Statute Section 19-305.
