METROPOLITAN AREA PLANNING COMMISSION

APRIL 11, 2000

 

MEMBERS PRESENT: Beadles, Little, Damron, Gott, Finley, Krennerich, Pitts, Shaw, Phillips

 

MEMBERS ABSENT: None

 

Dr. Beadles opened the meeting by conducting a public hearing regarding a proposed amendment to the Residential Planned Unit Development Ordinance(PUD) that would delete commercial zoning from the list of eligible properties.  Currently all residential zones, R-1, R-2 & R-3 as well as all commercial zones, C-1, C-2, C-3, C-4 & C-5 allow residential PUD developments.  The amendment deletes commercial zoning from the ordinance.  No one in attendance spoke in favor or against the proposal and the MAPC took the matter under advisement.

 

The minutes of the March 14, 2000 meeting were approved as prepared.

 

#1 RZ00-1 Wayne Anderson requested approval of rezoning from Residential R-3 to Commercial C-3 for Lots 9, 10, 11 & 12 in Block 14, Lots 11, 12, 13, 14 & 15 in Block 13, Lots 1, 2, 3, 4, 5 & 6 in Block 9 of Matthews Addition.  The property is located as follows: 

a. On the north side of Johnson Avenue between Miller Street and Bridge Street,

b. On the northeast corner of Johnson Avenue and continuing north on Bridge Street,

c. On the south side of Johnson Avenue, between Bridge Street and Drake Street

 

Ms. Finley made a motion to recommend approval of the request to the City Council with the stipulation that a site development plan be submitted to and approved by the MAPC prior to development.  The motion was seconded by Mr. Pitts.  Voting was 6 in favor, 2 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#2 RZ00-21 Robin Nix requested approval of rezoning from Residential R-1 to Commercial C-4 for Lot 10 of Marlo Acres First Addition.  The general location of the property is on the southeast side of Southwest Drive, approximately 450' southwest of the intersection of Culberhouse Street. 

 

Mark Mayfield, attorney for Richard Jernigan, informed the MAPC that an agreement had been reached between Mr. Nix and Mr. Jernigan regarding the building design and separation between the commercial and residential uses.  No one in attendance spoke in opposition to the request. 

 

Mr. Pitts made a motion to recommend to the City Council that the property be rezoned to Commercial C-5 instead of C-3 and thereby limit uses to professional offices which Mr. Nix is in agreement with.  Mr. Pitts also included the stipulation that a site development plan be submitted to and approved by the MAPC prior to development which will require compliance with the agreement with the neighbor and buffering in addition to typical site plan requirements.  The motion was seconded by Ms. Finley.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#3  RZ00-23 Charles & Rhoda Smith, Marcia Patton, Russell & Ann Patton, Stradley and Marystel Appleton requested approval of rezoning from Residential R-2 to Residential R-1 for Lots 11, 12, 13 & 14 of Teasdale Acres and the Crafton’s Addition.  The general location of the property is on the west side of Harrisburg Road, approximately 400' south of Highland Drive.

 

A motion to recommend approval of the rezoning to the City Council was made by Mr. Damron and seconded by Mr. Gott.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED.

 

#4  RZ00-24 Louise Nance requested approval of rezoning from Residential R-2 to Commercial C-3 for the North 138 feet of Lot 5 and the west 50 feet of Lot 4, all in Block 1 of Patrick’s Second Addition.  The general location of the property is on the northeast corner of Matthews Avenue and Roland Street.

 

Mr. Krennerich made a motion to modify the zoning to Commercial C-5 instead of C-3 and recommend approval of the C-5 zoning to the City Council with the stipulation that site development plan be submitted to and approved by the MAPC prior to development.  The motion was seconded by Mr. Phillips.  Voting was 7 in favor, 1 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#5   RZ00-25 Scott and Melissa Vaughn requested approval of rezoning from Residential R-1 to Commercial C-3 for .94 acres located on a part of the NE 1/4, NE 1/4 of Section 10, T14N, R4E.  The address of the property is 4516 E. Johnson Avenue and the general location of the property is on the north side of E. Johnson Avenue, west of Paragould Drive.

 

Mr. Pitts made a motion to recommend approval of the C-3 zoning as submitted to the City Council with the stipulation that site development plan be submitted to and approved by the MAPC prior to development.  The motion was seconded by Ms. Shaw.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#6  MP00-10 Scott and Melissa Vaughn requested approval of a minor plat containing one lot on .94 acre.  The address of the property is 4516 E. Johnson Avenue and the general location of the property is on the north side of E. Johnson Avenue, west of Paragould Drive.

 

A motion to approve the request was made by Ms. Shaw and seconded by Ms. Finley.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED.

 

#7  SU00-3 Tommy & Leah Soffray requested approval of placement of a manufactured home at 4825 Peachtree Avenue.

 

Mr. Pitts made a motion to approve the request which is supposed to be a temporary placement while their new home is constructed and then be removed with 30 days of completion of the home.  The motion was seconded by Mr. Gott.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#8  RP00-18 Tip Shipp requested approval of a replat of Lot 2, Block B of Loyd Subdivision.  The address of the property is 3817 Hill Drive and the general location of the property is on the south side of Hill Drive, west of Airport Road.

 

Ms. Shaw made a motion to approve the replat subject to approval of the site development plan by the MAPC.  The motion was seconded by Mr. Pitts.  Voting was 6 in favor, 2 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#9  SP00-4 Tip Shipp requested approval of site development plans for a duplex to be added to a lot with an existing home.  The lot contains .36 acre and is located at 3817 Hill Drive.  The general location of the property is on the south side of Hill Drive, west of Airport Road.

 

A motion to disapprove the request by Mr. Krennerich was withdrawn after the owner’s representative asked to withdraw the request for further review, REQUEST WITHDRAWN.

 

#10  RP00-17 Gary Zane requested approval of a replat of a part of Lot 1 and part of a strip of land 30' wide lying east of Lot 1 of Cobb Survey of the SE 1/4, NW 1/4 of Section 18, T14N, R4E.  The general location of the property is on the northeast corner of Main Street and Johnson Avenue. 

 

A motion to approve the replat was made by Mr. Pitts and seconded by Ms. Finley.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED.

 

#11  SP00-5 Gary Zane requested approval of site development plans for Water Magic Car Wash containing 4 wash bays to be constructed on the Water Magic Replat.  The general location of the property is on the northeast corner of Main Street and Johnson Avenue. 

 

Mr. Gott made a motion to approve the request subject to elimination of the drives nearest the intersection leaving only two accesses are far east and as far north as possible.  IT was further stipulated that a drainage plan be prepared and submitted for approval to the City Engineer.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#12  RP00-19 Lorena Granger requested approval of a replat of part of Lot 6 of Senter & Company’s Addition containing 2 lots on .91 acre.  The address of the property is 1501 Rains Street and the general location of the property is on the west side of Rains Street, south of Hidden Cove.

 

WITHDRAWN PRIOR TO MEETING.

 

#13  RP00-20 Martin Crain requested approval of a replat of Lots 8 & 9, Block 2 of Wilson’s Addition and the south ½ of an abandoned alley.  The general location of the property is on the north side of W. Matthews Avenue, east of Wilson Street. 

 

A motion to approve the request was made by Mr. Krennerich and seconded by Mr. Gott.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED.

 

#14  SP00-6 Martin Crain requested approval of site development plans for 10 apartment units in three buildings to be constructed on Crain’s Replat of Lots 8 & 9, Block 2 of Wilson’s Addition.  The general location of the property is on the north side of W. Matthews Avenue, east of Wilson Street. 

 

WITHDRAWN BY OWNER’S REPRESENTATIVE FOR FURTHER REVIEW.

 

#15  PP00-4 Rick and Sandy Wyatt requested preliminary approval of Marchbanks Estates, a subdivision containing 20 lots on 8.54 acres.  The general location of the property is on the west side of Airport Road, south of Prospect Road.

 

Mr. Krennerich made a motion to approve the request with the following stipulations:

1.  Addressing the comments in the staff report

2.  Granting utility easements as requested by CW & L

3.  Working with the Grace Baptist Church and the City Engineer on a drainage plan for this subdivision and the church site

 

The motion was seconded by Mr. Damron.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#15B - SP00-7 Grace Baptist Church requested approval of site plans for their new church facilities to be to be constructed on the northwest corner of Airport Road and Aggie Road. 

Ms. Shaw made a motion to approve the request with the following stipulations:

1.  Providing a minor plat of the property

2.  Working with the developer of the subdivision to the north and the City Engineer to come up with an approved drainage plan

3.  Installing a sidewalk and rail under the canopies on the east and west sides so that pedestrians do not open the door in to the lane of traffic which may involve extending the canopies

 

The motion was seconded by Mr. Pitts.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#16 FP00-2 Dennis Gregory requested final approval of subdivision plans for Gregory’s Subdivision containing 27 lots on 9.57 acres.  The subdivision is a continuation southward of Crepe Myrtle Drive and is located approximately 1/4 mile east of Paragould Drive.

 

Mr. Pitts made a motion to approve the request with the following stipulations:

 

1.  Confirmation of the size of drainage structure needed for the ditch crossing on the north side

2.  Verification of who is going to extend Crepe Myrtle Drive from its current ending into this subdivision, including the bridge construction

3.  Additional phases will not be approved is a second access is not provided

 

The motion was seconded by Mr. Damron.  Voting was 6 in favor, 2 opposed, REQUEST APPROVED WITH STIPULATIONS.

 

#17  FP00-1 Rick Turman requested final approval of subdivision plans for the Paddock, a subdivision containing 108 lots on 28.52 acres.  The general location of the property is on the south side of Rook Road, west of the Missouri Pacific Road and east of Stadium Boulevard.

 

Mr. Krennerich made a motion to approve the request with the following stipulations:

1.  Compliance with the engineering comments contained in the staff report

2.  Providing a drainage profile from the subdivision down to Higginbottom Creek

3.  Rip the ends of the pipes

4.  Stipulations contained on the preliminary plan are in compliance except as noted in items 1, 2 & 3. 

 

The motion was seconded by Mr. Phillips.  Voting was 8 in favor, 0 opposed, REQUEST APPROVED WITH STIPULATIONS. 

 

#18  FP99-14 Todd Jackson and Roy Milner requested final approval of subdivision plans for Woodsprings Estates Phase V containing 34 lots on 22 acres.  The general location of the property is on the north side of Woodsprings Road, east of Casey Springs Road.

 

It was pointed out that the retention pond has been increased in size to adequately handle the runoff from this subdivision and alleviate some drainage problems downstream.

 

Mr. Krennerich made a motion to approve the request noting that one of the collapsed pipes has been replaced and stipulating that all the collapsed pipes be replaced prior to starting this phase.  The notes about “future commercial zoning” are to be removed from all pages of the plans.  The motion was seconded by Mr. Gott.  Voting was 7 in favor, 1 opposed, REQUEST APPROVED WITH STIPULATIONS.
