AN ORDINANCE ABANDONING AND VACATING A PART OF UNDEVELOPED STREET RIGHT-OF-WAY LOCATED IN:
THAT PART OF THE RIGHT OF WAY OF EVA COURT RUNNING EASTERLY AND WESTERLY AND ADJOINING LOTS B2 AND C6 ON THE SOUTH AND NORTH SIDES RESPECTIVELY LOCATED IN GRIFFIN SUBDIVISION, BEING PART OF THE EAST HALF OF THE NORTHWEST QUARTER OF SECTION 35, TOWNSHIP 14 NORTH, RANGE 3 EAST, JONESBORO, AR, PLAT RECORDED IN PLAT BOOK 158, PAGE 52 IN THE OFFICE OF THE CIRCUIT CLERK FOR CRAIGHEAD COUNTY, AR, IN JONESBORO, AR.

WHEREAS, the City Council at its regular meeting on November 18, 2014, pursuant to Ark. Stats. Section 14-301-302 through 14-301-304 heard the requests of Bob Harrison to abandon public street rights-of-way; and
WHEREAS, the City Council held a public hearing and heard all persons desiring to be heard in connection with this matter; and
WHEREAS, the respective utilities have consented to said abandonment; and
WHEREAS, the abandonment of said street right-of-way will not adversely affect the City of Jonesboro, and would be in the best interest of all parties concerned.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that;
SECTION 1. The City of Jonesboro, Arkansas hereby vacates and abandons all of its rights together with the right of the public generally, in and to the right-of-way of portions of streets, as shown on the recorded plat of GRIFFIN SUBDIVISION, BEING PART OF THE EAST HALF OF THE NORTHWEST QUARTER OF SECTION 35, TOWNSHIP 14 NORTH, RANGE 3 EAST, JONESBORO, AR, PLAT RECORDED IN PLAT BOOK 158, PAGE 52 IN THE OFFICE OF THE CIRCUIT CLERK FOR CRAIGHEAD COUNTY, AR, IN JONESBORO, AR.
SECTION 2. A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed Records of Craighead County, Arkansas.
SECTION 3. The closing, vacating, and abandonment by the City of its rights and the rights of the public generally in the above described right-of-way are in the public interest and will promote the public peace and welfare.
