AN ORDINANCE TO AMEND ARTICLE NO.12, TITLE OF THE JONESBORO PARKS COMMISSION BY AMENDING THE ORDINANCE AND CHANGING THE NAME TO THE JONESBORO PARKS AND RECREATION COMMISSION AND FOR OTHER PURPOSES

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, to amend Article No.12, Title 9 of “The Jonesboro Park Commission”, as follows:

 

Section 1: The Jonesboro Park Commission shall, hereinafter, be known as The Jonesboro Parks and Recreation Commission.

 

Section 2: Established; members; terms; officers; meetings; and removal of members.

 

(a)                     Established; members; terms. There is hereby established and created a city commission to be known as The Jonesboro Parks and Recreation Commission to consist of five members to be appointed by the mayor and approved by the City Council, and shall hold office for a term of five years, provided however, that those commissioners first appointed and confirmed after the passage of this article shall serve for terms of one, two, three, four and five years each to be designated by the mayor and City Council, and thereafter, upon the expiration of their respective terms, commissioners appointed by the mayor and approved by the majority vote of the City Council shall each be appointed for a term of five (5) years. In the event of a vacancy occurring on the commission, it shall be filled by appointment by the mayor, subject to the approval of a majority vote of the duly elected and qualified members of the City Council. Each commissioner shall file the oath required by law in the State of Arkansas for public officials.

(b)                     Officers; rules; The commission shall each year’s elect one of its members as chairman, said chairman not to succeed himself as chairman in two successive terms and such other officers as may be deemed proper and necessary, and shall establish such rules and by-laws as it deems necessary for its guidance.

(c)                     Meetings; The commission shall meet regularly each month or at a special meeting on the request of its chairman or any three of its members. Said meeting shall be attended by the parks committee of the City Council.

(d)                     Removal of Member; Any commissioner may be removed for cause upon a vote of two-thirds (2/3) of the duly elected and qualified members of the council. Three consecutive absences from said meetings shall be prima facie cause for removal.

 

Section 3: Section 2-86 of the Code of Ordinances of the City of Jonesboro, Arkansas, shall be amended to read as follows:

 

The Jonesboro Parks and Recreation Commission shall operate all Jonesboro Parks and Recreation programs and shall operate all park facilities, including Craighead Forrest.

 

Section 4: Section 2-87 shall be amended to read as follows:

 

The Commission shall employ such personnel as deemed to be necessary for the operation of the parks facilities and recreational program. The Parks Director shall be appointed by the Mayor and approved by the majority of the City Council and shall serve and hold office at the will and discretion of the City Council. The Parks Director’s salary shall be determined by the City Council.

 

Section 5: Section 2-88 of the Code of Ordinances of the City of Jonesboro, Arkansas, is hereby amended to read as follows:

 

The Commission shall promulgate reasonable rules and regulations which shall govern the operation of the facilities and of the Jonesboro Parks and Recreation Commission and shall establish, when desirable, reasonable schedules of charges to be made for the use of the parks and recreation facilities and programs.  

 

The Commission shall make park facilities available to all members of the public without discrimination at times, and without preferential treatment to any individual or group of individuals and members of any private association shall not be necessary to enable the use of the facilities.

 

All rules, regulations, and schedules shall be promulgated and adopted by the Commission, subject to review of the City Council. All rules, regulations, and schedules shall become effective upon passage by the Parks Commission.

 

The City Council shall have the authority to review all rules, regulations, and schedules, and shall have the power to remand, delete, or add to any rules, regulations, and (or) schedules, and shall have the power to pass by resolution any change in any rules, regulations, and/or schedules passed by the Commission.

 

Section 6: Section 2-89 of the Code of Ordinances of the City of Jonesboro, Arkansas, shall be amended, and the same shall read as follows:

 

The Commission shall make all purchases and sell all property through the Purchasing Department of the City of Jonesboro, Arkansas.

 

The Commission shall not make a contract, or enter in to a contract, without the approval of the City Council of the City of Jonesboro. Arkansas.

 

The Commission shall remain, repair, establish, and supervise all programs established by the Jonesboro Parks and Recreation Commission and shall conduct and manage all programs for the public welfare of the people of the City of Jonesboro, Arkansas, and will utilize all property under its control to the best possible advantage.

 

Section 7: Section 2-90 of the Code of Ordinances of the City of Jonesboro. Arkansas is hereby amended as follows:

 

The Commission is authorized to receive funds for the use of the parks facilities by the general public or other associations, and are authorized to receive donations, gifts, and other charitable contributions, and the Commission is authorized to make reasonable charges for the use of parks facilities and for programs conducted under the auspices of the Jonesboro Parks and Recreation Commission.

 

All revenues received by the Commission shall be deposited with the Department of Finance and Administration.

 

The Commission shall not have the authority or power to sell, mortgage, or encumber any real property, unless specifically authorized by the statutes of the State of Arkansas.

 

All expenditures by the Commission shall be made through the Purchasing Department of the City of Jonesboro, Arkansas, for any expenditure which exceeds the sum of $100.00.

 

The Commission shall maintain proper books of account of all revenues and expenditures in accordance with established accounting procedures and shall render an annual accounting to the Director of the Department of Finance and Administration.

 

Section 8: All Ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

Section 9: It is found and declared by the City Council of the City of Jonesboro, Arkansas, that the Jonesboro Park Commission should hereafter be known as the Jonesboro Parks and Recreation commission, and that the Commission has served as a valuable advisory board, and that the City Council wishes to continue to utilize the expertise of the Commission. This Ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist and it shall take effect from and after its passage.

 

PASSED and ADOPTED this 21st day of February, 1977.
