AN ORDINANCE VACATING, CLOSING AND ABANDONING A PORTION OF FLOYD STREET BOUND ON THE SOUTH BY THE NORTH RIGHT-OF-WAY LINE OF THE ST. LOUIS & SOUTHWESTERN RAILROAD AND BOUND ON THE NORTH BY THE SOUTH RIGHT-OF-WAY LINE OF THE ST. LOUIS AND SAN FRANCISCO RAILROAD.

WHEREAS,  after due notice, the City Council at the special public hearing on June 19, 1989, heard all persons deserving to be heard; and
 
WHEREAS, that portion of Floyd Street running between the St. Louis & Southwestern Railroad and the St. Louis and San Francisco Railroad is no longer needed for corporate purposes  and;
 
WHEREAS, the vacating, abandonment, and closing of such portion of Floyd Street would be in the best interest of the public and would promote the welfare and well being of the majority of the public.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Jonesboro, Arkansas, that:
 
SECTION 1:  The City of Jonesboro, Arkansas hereby releases, vacates, closes and abandons all of its rights together with the right of the public generally, subject to existing utility easements, in and to a portion of Floyd Street described as follows:
 
A portion of Floyd Street described as: A strip of land 50.0 feet in width adjacent and adjoining the West boundary of Berger Realty Company Addition  to Jonesboro, Arkansas, bound on the South by the North right-or-way line of the St. Louis & South- Western Railroad, and bound on the North by the South right-of-way line of the St. Louis and San Francisco Railroad, together with any and all prescriptive right-of-way, all being subject to any and all rights-of-way and easements of record, all in Section 13, Township 14 North, Range 3 East.
 
SECTION 2:   A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Craighead County at Jonesboro, Arkansas, and recorded in the Deed of Craighead County, Arkansas.
 
SECTION 3:   The closing, vacating and abandonment by the City of its rights and the rights of the public generally in the above described portion of Floyd Street is in the public interest and will promote the public peace and welfare. And further, the City Council finds that an emergency exists and this ordinance being necessary for the protection and promotion of the public health, welfare and safety, the same shall take effect from and after its passage and approval.
 
PASSED AND APPROVED this 10th day of July, 1989.
