AN ORDINANCE TO AMEND CHAPTER 117, KNOWN AS THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS, PROVIDING FOR CHANGES IN ZONING BOUNDARIES FOR PROPERTY LOCATED AT 5425 SOUTHWEST DRIVE AS REQUESTED BY BRUNO AZEMI

WHEREAS, the following described lands located in Jonesboro, Craighead County, Arkansas, are currently zoned R-1, residential use classification:

 

A part of the Southwest Quarter of the Southwest Quarter of Section 2, Township 13 North, Range 3 East, Craighead County, Arkansas and being more particularly described as follows:

Commencing at the Northeast corner of the Southwest Quarter of the Southwest Quarter of said Section 2; thence South 0°00'28" East 1147.94 feet along the East line of aforesaid to the North right of way Line of Highway No. 49; thence South 89°39'44" West 40.58 feet along said right of way; thence South 6°39'29" West 73.61 feet along said right of way; thence South 77°47'34" West 178.30 feet along said right of way; thence South 86°09'26" West 190.16 feet along said right of way; thence South 88°35'42" West 11.60 feet along said right of way to the point of beginning proper; thence North 88°35'42" West 232.11 feet to the East Line of Floyd Minor Plat; thence North 0°23'39" West 400.00 feet along said East line of said Floyd Minor Plat; thence South 89°52'39" East 231.59 feet; thence South 0°46'11" West 249.52 feet; thence South 2°24'42" East 155.83 feet along an existing fence to the point of beginning proper, containing 2.12 acres more or less and being subject to all public and private roads and easements.

 

WHEREAS, all applicable laws, rules and regulations have been complied with in presenting this Ordinance to the City Council.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:

 

SECTION I: The Zoning Ordinance of the City of Jonesboro, Arkansas, codified as Title 14 of the Jonesboro Municipal Code, should be, and hereby is amended so that the Property described herein shall be zoned as C-3, General Commercial District.

 

SECTION II: The following conditions are required pursuant to the C-3, General Commercial District rezoning for the subject property:

 

1.                     The proposed site shall satisfy all requirements of the City Engineer, all requirements of the current Stormwater Drainage Design Manual and Flood Plain Regulations regarding any new construction.

2.                     A final site plan subject to all ordinance requirements shall be submitted, reviewed, and approved by the Planning Department, prior to any redevelopment of the property.

3.                     Any change of use shall be subject to Planning Commission approval in the future.

4.                     The site shall comply with all overlay district standards.

 

SECTION III: All ordinances and parts of ordinances in conflict herewith are hereby repealed.

 

SECTION IV: The City Clerk is hereby directed to amend the official zoning district boundary map of the City of Jonesboro, Arkansas, insofar as it relates to the Property, so that the zoning classification of the Property shall be in accordance with the provisions of this Ordinance.
