MEMBERS PRESENT: Mr. Sloan, Mr. Blalock, Mr. Coleman, Mr. Vance, Mr. McCracken, Mr. Lamberth, Mr. Aycock, Mr. Patteson

 

MEMBERS ABSENT: None

 

The minutes of the April 10 and April 24, 1990 meetings were approved as prepared.

 

#1 OA90-1 A public hearing was held to receive comments on the proposed nonconforming use ordinance. This ordinance provides for change in uses, extensions of nonconforming used, allows reuse of nonconforming uses after uses have ceased, and provides procedures for restoration of nonconforming uses which have been damaged or destroyed.

 

Most of the comments received from those in attendance were related to the expansion of apartments. It was pointed out that the ordinance as prepared allows for expansion of apartments or any other nonconforming use by a maximum of 40%. A further statement was made that an expansion of a nonconforming use must be done in the same manner as the existing use. The 40% expansion would only be allowed one time. Concern was also expressed about the expansion of uses onto adjacent lands. NO ACTION was taken on this ordinance.

 

#2 OA90-3 A public hearing was also held to receive comments on an amendment to Ordinance No. 2257, which would allow for replacement of mobile homes, outside a mobile home subdivision, park, or court which have been made unusable by natural disaster or fire.

 

No comments were received by anyone in attendance.

 

#3 RZ90-9 M D R Cartage, Inc. Requested rezoning from R-1 to I-1 for 22.25 acres, more or less, located on a part of the SW 1/4, NW 1/4 of Section 9, T13N, R4E. The property is located on the east side of S. Caraway Rd., north of Arkansas Hwy.1.

 

A motion was made by Mr. Vance to approve this request subject to a total of 41' of right-of-way being dedicated from the centerline on Caraway Road and the owners participating in the street improvements on Caraway Road when it is improved. Mr. Coleman seconded the motion. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#4 MP90-10 MDR Cartage, Inc. requested approval of a one (1) lot minor plat containing 22.25 acres, more or less. The properly is located on the east side of S. Caraway Rd., north of Arkansas Hwy. 1.

 

A motion to approve this request was made by Mr. Vance and seconded by Mr. Patteson. Voting was 7 in favor, 0 opposed. REQUEST APPROVED.

 

#5 RZ90-10 Jonesboro Memorial Service requested rezoning from R-1 to I-1 for 7.1 acres located on a part of the SW 1/4, NW 1/4 of Section 9, T13N, R4E. The property is located on the east side of S. Caraway Rd., north of Arkansas Hwy. 1 and adjacent to MDR Cartage, Inc.

 

A motion was made by Mr. Patteson to approve this request subject to a total of 41' of right-of-way being dedicated from the centerline on Caraway Road and the owners participating in the street improvements on Caraway Road when participating in the street improvements on Caraway Road when it is improved. Mr. Blalock seconded the motion. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#6 MP90-11 Jonesboro Memorial Service requested approval of a two (2) lot minor plat containing 7.1 acres, more or less. The property is located on the east side of S. Caraway Rd., north of Highway 1.

 

A motion to approve this request was made by Mr. Vance and seconded by Mr. Aycock. REQUEST APPROVED.

 

#7 RZ90-11 Carey Henry requested rezoning from R-1 to R-2 for 1.76 acres, more or less, located on a part of the NE 1/4, SE 1/4 of Section 6, T14N, R4E. The property is located on the west side of Patrick Street, north of Jonathan Drive.

 

Mr. Vance made a motion to table this request stating that he would be reluctant to rezone on a per lot basis but would look more favorable on a ledger rezoning request if more adjacent owners would request the same. The motion was seconded by Mr. Aycock. Voting was 7 in favor, 0 opposed REQUEST TABLED.

 

#8 RZ90-12 Charles Johnson requested rezoning from R-1 to I -1 for 8.11 acres, more or less, located on a part of the NE 1/4 of Section 13, T14N, R3E. The property is located on the south side of Hwy. 63B, west of Gee Street.

 

A motion to approve this request was made by Mr. Vance and seconded by Mr. Aycock. REQUEST APPROVED.

 

#9 RZ90-13 Floyd Prescott requested rezoning from R-1 to R-2 for 15 acres, more or less, located on a part of the NE 1/4, SW 1/4, T14N, R4E. The property is located on the east side of Mitzi Lane, south of Darlene Drive, extending to Prescott Lane.

 

Mr. Vance made a motion to table this request with the owner to consider developing the land as a mobile home subdivision under the new mobile home ordinance. Mr. Lamberth seconded the motion. Voting was 7 in favor, 0 opposed. REQUEST TABLED.

 

#10 RZ90-14 Heatherwood Developers, Inc. Requested rezoning from R-1 to R-2 for 39.46 aces, more or less, located on a part of the SW 1/4, NE 1/4 of Section 14, T14N, R4E. The property is located on the southeast corner of Airport Road (Hwy. 351) and Aggie Road.

 

A motion to approve this request was made by Mr. Lamberth and seconded by Mr. Vance. Voting was 7 in favor, 0 opposed. REQUEST APPROVED.

 

#11 PP90-3 Heatherwood Developers, Inc. Requested preliminary approval of Summers Glenn Addition, a subdivision containing 122 lots on 39.46 acres. The property is located on the southeast corner of Airport Road and Aggie Road.

 

Mr. Sloan made a motion to approve this request with the understanding that the Commission will address street improvements on Aggie Road and Airport Road prior to final approval and with the stipulation that the “proposed” be deleted from the right-of-way. Mr. Patteson seconded the motion. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#12 RZ90-15 Lynda Wewers requested rezoning from R-1 to R-2 for 5.0 acres, more or less, located on a part of the NW 1/4, NW 1/4 of Section 27, T14N, R5E. The property is located on the east side of Barnhill Road, south of Highland Drive.

 

Mr. Lamberth made a motion to approve this request with the following stipulations:

 

1. A total of 41' of right-of-way being dedicated from the centerline on Barnhill Road

2. A drainage easement be dedicated from the centerline of Maple Slough Ditch to ensure at least a 20' bank area for maintenance.

3. The owner signing a agreement to pay their prorate share of street improvements on Barnhill Road when it is improved.

 

The motion was seconded by Mr. Aycock. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATION.

 

#13 MP90-13 Lynda Wewers requested approval of a one lot minor plat, containing 5.0 acres, more or less. The property is located on the east side of Barnhill Road, south of Highland Drive.

 

A motion to approve this request was made by Mr. Sloan and seconded by Mr. Aycock. Voting was 7 in favor, 0 opposed. REQUEST APPROVED.

 

#14 RZ90-16 J. C. Mahon requested rezoning from R-2 to C-3 for .21 acres, more or less, located on a part of the NW 1/4, SE 1/4 of Section 21, T14N, R4E. The property is located on the south side of Nettleton Avenue, east of Stadium Blvd.

 

A motion to approve this request was made by Mr. Lamberth subject to a total of 50' of right-of-way being dedicated from centerline on Nettleton Avenue. Mr. Sloan seconded the motion. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATION.

 

#15 RP90-16 J. C. Mahon requested approval of Lot A, a replat of Lot 9, the east 50.0' of Lot 8 and a part of Lot 12 of Charles A. Stuck’s Turtle Creek Ranch Addition. The property is located on the south side of Nettleton Avenue, east of Stadium Blvd.

 

Mr. Vance made a motion to approve this request subject to a total of 50' of right-of-way being dedicated from centerline on Nettleton Avenue. Mr. Coleman seconded the motion. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#16 RZ90-17 Coy Mac Boyd requested rezoning from R-1 to R-2 for 6.67 acres, more or less, and from R-1 to C-3 for 8.037 acres, more or less, located on a part of the North half of the NE 1/4 of Section 33, T14N, R3E. The property is located on the north side of Woodsprings Road, west of Friendly Hope Road.

 

Mr. Vance made a motion to table this request for further review and consideration of the R-2 zoning request. Mr. Coleman seconded the motion. Voting was 6 in favor, 0 opposed, 1 abstaining. REQUEST TABLED.

 

#17 MP90-12 Mitchell Caldwell and Shelby Phillips requested approval of a three (3) lot minor plat containing 2.25 acres, more or less. The property is located on the east side of Richardson Road, north of Colony Drive.

 

Mr. Coleman made a motion to approve this request subject to the following stipulations:

1. That 30' of right-of-way be dedicated from the centerline on Richardson Road and Colony Dr.

2. The owner signing an agreement to pay their prorata share of street improvements on both streets when the streets are improved.

 

Mr. Vance seconded the motion. Voting was 6 in favor, 0 opposed, l absent during voting. REQUESTED APPROVED WITH STIPULATIONS.

 

#18 MP90-14 Richard Flemon requested approval of a one (1) lot minor plat containing 1.0 acre, more or less. The property is located on the south side of Hwy. 49 South, west of Maple Valley Drive.

 

Mr. Patteson made a motion to approve this request subject to a total of 50' of right-of-way being dedicated from centerline on Southwest Drive (Highway 49). The motion was seconded by Mr. Coleman. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#19 RP90-17 Kent Arnold requested a replat of Caraway Place, Phase I, containing 31 lots. The property is located east of Caraway Road, on the north and south sides of Glenn Place.

 

A motion to approve this request was made by Mr. Coleman and seconded by Mr. Vance. Voting was 7 in favor, 0 opposed. REQUEST APPROVED

 

#20 RP90-18 Jeff Cranford requested a replat of Lots 14, 15, 16, & 17, Block C, Marshall Estates. The property is located on the east side of E. Lakeshore Drive, south of E. Lakeshore Drive, south of E. Lakeshore Cove.

 

A motion to approve this request was made by Mr. Vance and seconded by Mr. Patteson. Voting was 7 in favor, 0 opposed. REQUEST APPROVED.

 

#21 RPUD90-1 Joe Foster requested preliminary approval of a Residential Planned Unit Development. The development covers 6.20 acres, more or less, and contains 17 units on 10 lots for a density of 3.1 units per acre. The property is located on the west side of Paragould Drive, south of Prospect Road.

 

Mr. Vance made a motion to grant preliminary approval with the following stipulations:

 

1. The owner petition the Council to close and abandon the existing street if the street is to be private.

2. Proper documents be provided to address the maintenance of the private street and specifically exclude the City from any maintenance responsibilities.

3. Foster Drive be renamed.

4. Look at the need for reducing external perimeter setbacks and variance from paving requirements for parking spaces.

5. Consider phased development.

6. The legal description of the tract and lot dimensions be determined and certified.

 

The motion was seconded by Mr. Patteson. Voting was 7 in favor, 0 opposed. REQUEST APPROVED WITH STIPULATIONS.

 

#22 John Bracey requested the MAPC to rescind their action on a replat (RP90-13) approved on April 10, 1990.

 

A motion to rescind this action was made by Mr. Lamberth, and seconded by Mr. Vance. REQUEST APPROVED, ACTION RESCINDED.

 

#23 SP90-3 Robert Rees requested site plan approval for a dry cleaners to be located on the southwest corner of Race Street and Caraway Road.

 

Mr. Lamberth made a motion to approve this request with the following stipulations;

 

1. The 24' required parking spaces be shown or a variance be secured from the Board of Zoning Adjustments.

2. The owner work out the location of the curb and gutter to be installed on Caraway Road with the proper city officials.

3. The owner secure, in writing, permission from all the utilities to locate part of his building in the 20' utility easement, west of the 40' street right-of-way.

 

Mr. Vance seconded the motion. REQUEST APPROVED WITH STIPULATIONS.
