AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORIES TO WARDS 5 AND 6; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of a particular tract to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court, of Craighead County, Arkansas, on October 16, 1989; and

 

WHEREAS, said petition for the annexation for these lands was duly signed by all of the owners of the tracts to be annexed to the City of Jonesboro, Arkansas and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on November 30, 1989, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon and order of annexation was made and entered; and

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: All of the territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas by its order of November 30, 1989, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

SECTION 2: The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:

 

A part of Section 16 and 17. Township 13 North, Range 4 East, being more particularly described as follows: Begin at the Northeast Corner of Section 17, Township 13 North, Range 4 East, the same being the Northwest Corner of Section 16, Township 13 North, Range 4 East; thence East on the Section line 300.00 feet; thence South parallel to and 300.00 feet from the West line of said Section 16 to the East/West Quarter Section line of said Section 16; thence West on the Quarter Section line 300.00 feet to the East line of said Section 17; thence South on the Section line to the Southeast Corner of said Section 17; thence West on the Section line to the intersection with the centerline of Old Ridge Road; thence Northwesterly with the meanderings of said centerline to the North/South Quarter Section line of said Section 17; thence North on the Quarter Section line to the Southwest Corner of the Northwest Quarter of the Southeast Quarter of said Section 17; thence East on the 40 acre line to the Southeast Corner of said Northwest Quarter of the Southeast Quarter; thence North on the 40 acre line to the Northeast Corner of said North west Quarter of the Southeast Quarter; thence West on the 40 acre line to the intersection with the Centerline of the Missouri Pacific Railroad; thence Southwesterly with the meanderings with said railroad centerline to centerline of Old Ridge Road; thence North westerly with the centerline of Old Ridge Road to the intersection with the centerline of Arkansas Highway No1; thence Northeasterly along said Highway centerline to the North line of aforesaid Section 17; thence East on the Section line to the Northeast Corner of Section 17, Township 13 North, Range 4 East, the point of beginning, containing 248.3 acres more or less, subject to all rights-of-way and easements of record, less and except the following described parcels:

 

McDaniel Parcel: The North 75 feet of Lot 10 Wooded Acres Subdivision, Craighead County, Arkansas: Marsh Parcels: Lots 13 and 19 of Wooded Acres Subdivision, Craighead County, Arkansas, Also, the following described parcel: A part of Lot 3 of the Re-plat of a part of Lot 17 and 18 of Wooded Acres Subdivision, Craighead County, Arkansas, as shown by Re-plat in Plat Cabinet “A” page 12 at Jonesboro, Arkansas, more particularly described as follows: Begin at the Southeast corner of Lot 3 aforesaid; thence North 64°13' West 189.8 feet to the right-of-way line of a 50 foot radius cul de sac; thence in a Northwesterly direction along a curve to the left, with a radius of 50 feet, a distance of 78.54 feet; thence South 64°13' East 170.13 feet; thence South 25°11' East 79.4 feet to the point of beginning, containing 0.21 acre; being subject to Bill of Assurance in Deed Record 241 page 522 and Amendment thereto in Deed Record 260 page 47 and to easements as shown on recorded Re-plat; Moore Parcels: A part of Lot 9 of wooded Acres Subdivision, Craighead County, Arkansas, as shown by Plat in Deed Record 198, page 96 in the Office of the Circuit Court Clerk and Ex-Officio Recorder, Craighead County, Jonesboro, Arkansas, more particularly described as follows: beginning at the Southeast Corner of Lot 9, wooded Acres Subdivision, aforesaid, thence North 0°46' East 413.5 feet along the East line of Lot 9: thence South 89°50' West 170.6 feet to the point of beginning proper; thence South 89°50' West 189.5 feet to the East right-of-way line Pine Lane; thence North 2°47' East 18.0 feet; thence North 3°55' East 46.1 feet; thence North 17°46' East 99.1 feet; thence North 12°24' East 40.1 feet: thence North 89°50' East 149.3 feet; thence South 0°46' West 201.0 feet to the point of beginning proper, containing 0.787 acres; and

 

A part of Lot 9 of Wooded Acres Subdivision, Craighead County, Arkansas, as recorded in Plat Book 198, page 96 in the office of the Circuit Court Clerk and Ex-Officio Recorder, Craighead County, Arkansas, Jonesboro, Arkansas, being more particularly described as follows: Begin at the southeast corner of Lot 9 of Wooded Acres Subdivision aforesaid; thence North 0°46' East 207.0 feet tot h3e point of beginning proper; thence South 89°50' West 363.7 feet to the East right-of-way line of Pine Lane; thence North 5°09' West along said right of way 58.8 feet; thence continue along said right of way North 2°47' East 153.3 feet; thence North 89°50' East 193.8 feet; thence North 0°46' East 195.8 feet: thence North 89°50' East 170.06 feet; thence South 0°46' West 407.5 feet to the point of beginning proper containing 2.55 acres, containing less said exceptions, 238.1 acres, more or less, subject to al right-of-way and easements of record.

 

SECTION 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are assigned and attached to ward 5 & 6.

 

SECTION 4: Said lands and territory annexed to the City of Jonesboro are hereby classified for purposes of zoning as Residential - 1.

 

SECTION 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein by immediately annexed to and accepted by the City of Jonesboro, Arkansas so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.
