ORDINANCE TO VACATE AND ABANDON DUDLEY STREET

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 27th day of March, 1974, praying the City Council to vacate and abandon the streets and roadways described as:
Dudley Street from the North edge of Oliver Street South for a distance of 310 feet which is to the South edge of the street known as South Street, said Street being a 30 foot wide street; that South Street, said street being a 30 foot wide street extending from what is or formerly was Dudley Avenue on the West to Kathleen Street or Pankey Road on the East a distance of 1282.6 feet and also that Oliver Street from the West boundary of Dudley Avenue be abandoned a distance of 265 feet East to its intersection with James Street on the East.
WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the streets and roadways or portions thereof as described above has heretofore been dedicated to the public use; that the streets mentioned therein have not been opened nor have they been used by the general public for any purpose; that the owners of all the property abutting upon the said streets and roadways to be vacated have joined in the petition filed before the City Council; and that public interest and welfare will not be adversely affected by the abandonment and vacation of such streets and roadways or portions thereof.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights together with the rights of the public generally in and to the following streets and roadways or portions thereof, to-wit:
Dudley Street from the North Edge of Oliver Street South for a distance of 310 feet which is to the South Edge of the street known as South Street, said street being a 30 foot wide street; that South Street, said street being a 30 foot wide street extending from what is or formerly was Dudley Avenue on the West to Kathleen Street or Pankey Road on the East a distance of 1282.6 feet and also that Oliver Street from the West Boundary of Dudley Avenue be abandoned a distance of 265 feet East to its intersection with James Street on the East.
Section 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County, Arkansas, and recorded in the deed records of said County.
Section 3: This Ordinance shall take effect and be in force from and after its passage.
