AN ORDINANCE VACATING AND ABANDONING PART OF AN ALLEY NORTH OF HOPE AVENUE AND SOUTH OF CREATH AVENUE, BETWEEN BRIDGE STREET AND BAKER STREET
Body
WHEREAS, a petition was duly filed with the City Clerk for the City of Jonesboro, Arkansas, on March 15, 2007, requesting that the Jonesboro City Council vacate and close part of an alley located in, Jonesboro, Arkansas; and,
 
WHEREAS, notice of the hearing on said petition was given by publication of a notice once a week for two consecutive weeks in the Jonesboro Sun as required by Resolution No. 2007-46, passed and approved by the Jonesboro, Arkansas City Council on March 20, 2007, and a hearing on said petition was held at 6:15 p.m. on April 3, 2007, in the Huntington Building located at 900 West Monroe Street, Jonesboro, Arkansas; and
 
WHEREAS, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all person desiring to be heard on the petition and ascertained that the portion of the alley described below, was previously dedicated to the public use; that the portion of the alley described below is not necessary or beneficial to the public and not required for corporate purposes; that the petitioner is the sole owner of the property abutting upon the part of the alley to be vacated; and that public interest and welfare will not be adversely affected by the abandonment of the portion of the alley.
 
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:
 
Section 1: The City of Jonesboro, Arkansas, releases, vacates and abandons all its right, together with the right of the public generally in and to the portion of the alley designated as follows:
 
Part of the 20' alley lying in Block 4 of Broadaway Addition to the City of Jonesboro as recorded in the public records in Jonesboro, Craighead County, Arkansas, also being a part of the Southeast quarter of Section 18 Township 14 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows:
 
Beginning at the Southwest corner of Lot 12 of Block 4 of Broadaway Addition to the City of Jonesboro as recorded in the public records in Jonesboro, Craighead County, Arkansas: thence South 88°18'47" East along the South line of Lots 8 and 12 of Block 4, aforesaid, 185.00 feet: thence South 02°51'33" West departing said South line, 20.00 feet to the North line of Lots 2, 4, 5, 6 and 11 of Block 4, aforesaid: thence North 88°18'47" West along said North line, 185.00 feet to the Northwest corner of Lot 11 of Block 4, aforesaid: thence North 02°51'33" East 20.00 feet to the point of beginning. Containing in all 3,700 square feet or 0.08 acres, more or less. Subject to easements, restrictions, reservations and rights-of-way of record.
 
Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the recorder of the County and recorded in the deed records of the County.
