AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD 5, ZONING SAID ANNEXED TERRITORY AGRICULTURAL (AG), DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on March 12, 1986; and
WHEREAS, said petition for the annexation of said land and was duly signed by all of the owners of all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, as order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on April 14, 1986, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated April 14, 1986, and no proceedings to prevent said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of May 14, 1986.
NOW, THEREFORE, be it ordained and enacted by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro by an order of the County Court of Craighead County, Arkansas, by its order of April 14, 1986, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit: (Calvary Chapel Church of Jonesboro, Inc- S. of Hwy 63 Bypass, E. of Hwy 1 - Mike Gott)
A part of the Southwest Quarter of the Northeast Quarter, Section 33, Township 14 North, Range 4 East, Craighead County, Arkansas, more particularly described as follows: Commencing at an iron pipe found at the Southeast Corner of Northeast Quarter Section 33, T14N, R4R; thence S 88°18’ West along the half section line 1333.85 feet to the Southeast Corner, SW ¼ Section 33, the point of beginning proper; thence continue S 88°18’ West 1268.77 feet to the East right-of-way (75 feet from centerline) of Arkansas Highway #1; thence along the East right-of-way line of Arkansas Highway #1, as follows; North 0°53’ East 330 feet, North 0°37’ East 1019.49 feet; thence North 88°44’ East 1254.43 feet; thence South 00°04’ 30” West along a property line fence 1339.49 feet to the point of beginning proper, containing 38.90 acres, more or less, being subject to right-of-way for existing county road along the North side of the property.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas.
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Agricultural (AG).
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect and be in full force from and after its passage.
Section 6: Stipulation to install a water main and a hydrant to service the present church building being annexed.
