AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas hereinafter described, was duly filed in the County Court of Craighead County, Arkansas on March 31, 1986; and

 

WHEREAS, said petition for the annexation of said lands was duly sought by the owner of the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an order setting the hearing upon said petition was entered and notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on May 27, 1986, at which hearing it was duly found and declared that said petition for annexation was right and proper, and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and

 

WHEREAS, more than thirty (30) days having expired since the order of the annexation dated May 30, 1986, and no proceedings to prevent said annexation having been filed in the Circuit Court of the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of August _____, 1986,

 

NOW THEREFORE BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of May 30, 1986, are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to-wit: (Prospect Baptist Church Annexation)

 

Begin at the Northwest corner of the Northwest Quarter of the Northeast Quarter of Section 10, Township 14 North, Range 4 East; thence South 1247.2 feet along the Section line to the North right-of-way line of State Highway #49; thence North 57°55’ East 462.2 feet along said right-of-way line to the point of beginning proper; thence continue North 57°55’ East 327.2 feet along said right-or-way line; thence North 32°05’ West 410.0 feet; thence South 57°55’ West 327.2 feet; thence South 32°05’ East 410.0 feet to the point of beginning proper, containing 3.08 acres.

 

Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Jonesboro Township #8 of the City of Jonesboro, Arkansas.

 

Section 4: Said lands and territory annexed to the City of Jonesboro are hereby zoned Residential (R-1).

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said property in said territory described herein can be entitled to fire, police, zoning and other protection and benefits, and that said benefits & protection are urgently needed in order to allow orderly growth and development of said lands and territory. Therefore an emergency is hereby declared to exist and this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage.

 

PASSED and ADOPTED this 20th day of October, 1986.
