AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORIES TO WARD FIVE; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of a particular tract to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on November 8, 1985; and

 

WHEREAS, said petition for the annexation for these lands was duly signed by the majority of the owners of all of the tracts to be annexed to the City of Jonesboro, Arkansas, and

 

WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on December 10, 1985, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an ordinance of annexation was made and entered; and

 

WHEREAS, thirty days having expired since the order of annexation dated December 10, 1985, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of January 13, 1986.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: A portion of the territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas, by its order of December 10, 1985, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing herein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Jay Gamblin, Laymon Richardson, Curt Gamblin, S. of 63 Bypass, W. of Willow Rd. Willow Acres)

 

TRACT 1: Part of the Northeast Quarter of the Northwest Quarter of Section 34, Township 14 North, and Range 4 East, more particularly described as follows: Beginning at the Northwest corner of Lot 3 of Willow Acres Subdivision as recorded in Book 198, Page 213, Craighead County, Western District, Jonesboro, Arkansas, thence North 88°41’ East along the North line of said Lot 3 a distance of 229.3 feet to the centerline of Willow Road; thence South 1°15’ West along said centerline a distance of 399.0 feet; thence North 89°19’ West a distance of 230.0 feet to a point; thence North 1°15’ East a distance of 392.0 feet to the point of beginning proper, containing 2.0acres more or less.

 

TRACT 2: Part of the Northeast Quarter of the Northwest Quarter of Section 34, Township 14 North, Range 4 East, more particularly described as follows: Beginning at the Southwest corner of Lot 19 of Willow Acres Subdivision as recorded in Book 198, Page 213, Craighead County, Western District, Jonesboro, Arkansas; thence South 1°15’ West 30.0 feet to the centerline of Gamblin Drive; thence along the center line of Gamblin Drive as follows, South 88°41’ West 30.9 feet, along a curve to the left with a radius of 132.78feet a distance of 103.9 feet, South 43°51’ West147.6 feet to a point, thence North 36°51’ West 30 feet to the South corner of Lot 5 of a Re-plat of Lots 17, 20, 21 and 22, Willow Acres Sub-division; thence North 36°51’ West 153.56 feet; thence North 53°09’ East 61.01 feet; thence North 0°41 East 58.0 feet; thence North 34°41’ East 174.0 feet; thence South 89°19’ East 175.3 feet; thence South 1°15’ West 207.0 feet to the point of beginning proper, containing 1.934 acres.

 

Section 3: The lands and territory annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro are hereby accepted by the City of Jonesboro are assigned and attached to Ward Five (5).

 

Section 4: Said lands and territory annexed to the City of Jonesboro are hereby classified for purposes of zoning according to the following:

 

Residential-3 zoning: all of Tract 1 and Lot 5 of a re-plat of Lots 17, 20, 21 and 22 of Willow Acres subdivision as recorded in Book 198, Page 13.

                     

Commercial -3 zoning: all of Tract 2 less and except Lot 5 of a re-plat of Lots 17, 20, 21 and 22 of Willow Acres Subdivision as recorded in Book 198, Page 13.

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning and other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effect and be in full force from and after its passage.

 

PASSED and ADOPTED this 18th day of August, 1986.
