CITY COUNCIL MINUTES - SEPTEMBER 14, 1998

 

The Jonesboro City Council met Monday, September 14, 1998, at 6:40 p.m. The meeting began late due to a committee meeting prior to the council meeting. A full quorum was in attendance. Present were: City Clerk, Donna K. Jackson, and 12 council members. Those members were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. Mayor Brodell and City Attorney Crego were unable to attend. Vice Mayor Kelton presided over the meeting in Mayor Brodell’s absence.

 

The minutes for August 17, 1998, were approved as delivered, by Councilman Perrin, seconded by Councilman Tate. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. The minutes for the Special Called meeting August 28, 1998 were approved as delivered, by Councilman Young, seconded by Councilman Tate. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Floyd Vuncannon)

 

Councilman Tate moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. The ordinance was assigned number 3077.

 

The following ordinance was on the third and final reading:

 

ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Roddy Thrasher)

 

Councilman Young moved, seconded by Councilman Crockett for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. The ordinance was assigned number 3078.

 

The following ordinance was on second reading:

 

ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Jim Etters/ C. M. Mooney)

 

Councilman Bowers moved, seconded by Councilman Roddy to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. Councilman Young moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. The ordinance was assigned number 3079.

 

Councilman Bowers offered the following ordinance for first reading:

 

ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Russell Dougherty)

 

Councilman Tate moved, seconded by Councilman Crockett to suspend the rules and place on second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. No further action was taken regarding this ordinance.

 

Councilman Perrin offered the following ordinance for first reading:

 

ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Brenda Rainwater)

 

Mr. Brian Wadley of the Inspection Department informed Council that this particular rezoning had been amended by the Metropolitan Area Planning Commission from Residential R-3 to Residential R-2. Based on this information, Councilman Rega moved, seconded by Councilman Davis to amend the ordinance from Residential R-3 to Residential R-2 as recommended by the MAPC. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. Councilman Perrin moved, seconded by Councilman Bowers to suspend the rules and place on second reading as amended. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. Mr. Watkins who was representing Brenda Rainwater stated it was his understanding that a Residential R-3 zoning had been approved by the MAPC. No further action was taken regarding this ordinance.

 

Councilman Tate offered the following ordinance for first reading:

 

ORDINANCE TO AMEND THE JONESBORO CODE OF ORDINANCES 15.16.01 FOR THE PURPOSE OF ADOPTING A STREET IMPROVEMENT AGREEMENT FOR USE WITH ENFORCEMENT OF THE SUBDIVISION REGULATIONS AND TO PREVENT PIECE-MILL INSTALLATION OF STREET IMPROVEMENTS.

 

Councilman Tate explained that the ordinance had been drafted by Jon Coleman of the Metropolitan Area Planning Commission with the assistance of City Attorney Phillip Crego for the purpose of receiving prior approval from property owners to pay their share of costs for street improvements. Councilman Young inquired about a public hearing allowing for comment from developers on the matter. He was told by Mr. Brian Wadley of the Inspections Department that the Metropolitan Area Planning Commission had conducted a public hearing. Vice Mayor Kelton questioned if Mayor Brodell had been informed of the issue. Councilman Tate stated Mayor Brodell was aware of the ordinance. Councilman Bowers moved, seconded by Councilman Roddy to suspend the rules and place on second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy.

 

Councilman Crockett moved, seconded by Councilman Davis to accept low bid meeting bid specifications of Little Rock Equipment for $50,959.00 for a Side Loader for the Sanitation Department (Bid No. 98:30). A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy.

 

Under new business the Mayor’s Assistant, Larry Johnson gave a report on the progress of MATA projects. He stated that seventeen of the original MATA projects had been completed with fifteen projects in progress. Mr. Johnson reported that 26 of the gravel road projects had been completed with eight gravel road projects in progress. Councilman Province inquired about a completion date for Main Street. Mr. Johnson stated they had promised last week to have the project done in two weeks. Councilman Province stated they had told him it would be the middle of October before Main Street was completed. Mr. Johnson reported there were approximately 140 gravel streets and 80 original MATA projects with a total of three years to complete the projects.

 

Vice Mayor Kelton reported at the next Council meeting Mayor Brodell will be nominating Mr. Bill Gott to replace Mr. Gene Gardner on the Metropolitan Area Planning Commission.

 

Code Enforcement Officer, Doug Little reported to Council a problem with littering in Jonesboro. He asked for Council’s support with regard to enforcing existing laws against littering and posting signs on telephone poles. Mr. Little explained he did not want to issue tickets without Council being aware of the situation. Council agreed that the existing laws must be enforced. In closing, Mr. Little recommended increasing the amount of the fine for littering.                                                                                                                                                                                                                                                            

Discussion was held regarding Bill Ebbert. Council requested copies of previous minutes regarding condemnation extensions and requiring a $25,000.00 bond from Mr. Ebbert. It was determined that further information was needed from City Attorney, Phillip Crego.

 

Councilman Young moved, seconded by Councilman Perrin to accept the low bid meeting specifications of Accurate Roofing for $51,244.00 for the partial re-roofing of Earl Bell Community Center. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy.

 

Councilman Rega announced a Professional Services Committee meeting for 5:00 p.m. on Wednesday September 16, 1998, at City Hall Council Chambers.

 

Councilman Tate moved, seconded by Councilman Davis for the adoption of a resolution setting a public hearing for 6:15 p.m. on October 5, 1998, to vacate the 300 and 400 Block of East Novak. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. The resolution was assigned number 1998:53.

 

Councilman Pratt stated Ordinance No. 3026, an ordinance allowing the Finance Department to set publication fees needed to be amended to allow Council to set the fee. Councilman Pratt stated he was going to provide information to City Attorney, Crego and bring the amended ordinance to Council.

 

Councilman Young called for a Finance Committee meeting for September 17, 1998, at 12:00 noon in City Hall Council Chambers.

 

Councilman Rega moved, seconded by Councilman Pratt for the adoption of a resolution designating October 4 - 10, 1998, the 12th Annual Public Power Week to honor City Water and Light for its contributions to the community. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. The resolution was assigned number 1998:54.

 

Councilman Perrin reported to Council that Arkansas State University has its first home game Saturday, September 19, 1998, at 1:00 p.m. He encouraged everyone to attend.

 

Councilman Pratt moved, seconded by Councilman Perrin for the adoption of a resolution to place STOP signs at the following locations:

 

On Outback at Koala

On Butler Rd. at Craighead Forest Rd.

On Huntcliff at Dunwoody

(At Both Huntcliff/Dunwoody Intersections/3 Signs Total).

On Wolf Chase at Dunwoody

On Wolf Chase at Huntcliff

On Buckhorn at Huntcliff

 

A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Davis, Tate, Crockett, Rega, Pratt, Young, Perrin, Bowers, and Roddy. The resolution was assigned number 1998:55.
