The Metropolitan Area Planning Commission met on Thursday, April 14, 1977 at 7:00 P.M. in the Court Room at City Hall.
 
The meeting was called to order by the Chairman, Mr. Ralph Morrison.
 
MEMBERS PRESENTS: Morrison, Cooper, Ball, Smith, Tilton, McDaniel, Gott, and Morse.
 
MEMBERS ABSENT: Brown
 
OTHERS PRESENT: Gene Martz, Mike Cameron, Joe Tomlinson, Larry Fugate, and Shirley Watkins.
 
Items for business were as follows:
 
Minutes of the March 11, 1977 meeting were read and approved.
 
#1. A.B. Clark and Bobby McDaniel, representing Developers Mutual, a partnership, request a zoning classification of Commercial Two (C-2) for a parcel of property abutting the present city limits of Jonesboro, Arkansas. Subject zoning request is submitted under the provisions of City Ordinance #1473 providing for zoning classification prior to the subject property being annexed to the city. The MAPC is also asked to make a written statement as to what effect the proposed annexation of this property would have on the city accepting said land. Subject property is described as follows: A part of the Northwest Quarter, Southeast Quarter of Section 28, Township 14 North Range 4 East, being more particularly described as follows: begin at the southeast corner o the Northwest Quarter of the Southeast Quarter of Section 28, aforesaid; thence south 89.0 degrees, 57.0 minutes west on the 40 acre line 1012.1 feet; thence north 0 degrees, 42.0 minutes east 313.0 feet; thence north 0 degrees 44.0 minutes east 347.0 feet; thence north 89.0 degrees 57.0 minutes east 315.8 feet: thence south 1.0 degree 3.0 minutes west 50.8 feet; thence east 145.0 feet; thence south 1.0 degree, 3,0 minutes west 60.0 feet; thence east 410.0 feet; thence north 1.0 degree 3.0 minutes east 60.0 feet; thence east 145.0 feet to the 40 acre line; thence south 1.0 degree 3.0 minutes west on the 40 acre line 608.7 feet to the point of the beginning containing 13.97 acres. General location of this property is described as being south of Race Street, East of Young, and north of Craighead Memorial Hospital. This item was tabled by the MAPC in March 1977 in order that the owner might submit an updated plat of the area. A motion was made by Mr. Cooper and seconded by Mr. Ball to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#2. Garmon Y. Price and Lillian Price requests a rezoning from Residential One (R-1) to Commercial Three (C-3) at the following described location: A part of the west on-half of the Southwest Quarter of Section 13, Township 14 North, Range 3 East, Craighead County, Arkansas, and being more particularly described as follows. Commencing at the Southwest corner of Section 13, Township 14 North, Range 3 East; Thence North 89.0 degrees, 53.0 minutes east along the south line of said Section 13 a distances of 652.2 feet; thence North 0 degrees 45.0 minutes East 222.4 feet to the point of beginning proper; thence continuing North - degrees, 45.0 minutes east along the east line of Modes Addition 681.6 feet to the south line of Washington Street; thence North 89.0 degrees 53.0 minutes east along the South line of Washington Street 270.5 feet; thence south 0 degrees 45.0 minutes west along an existing property line fence 681.6 feet; thence south 89.0 degrees 53.0 minutes west 270.5 feet to the point of beginning proper and containing, in all 4.23 acres, more or less. General location of this property is described as being on the south side of West Washington Street being east of Freeman Street and west of Christian Creek. Mr. Skip Mooney, attorney, represented the developer of the property. A petition was presented by several surrounding neighbors in opposition to the request. A motion was made by Mr. Smith and seconded by Mrs. Morse to DENY the request because it was not adjacent to other C-3 areas and would not be the best use for the area at this time. A vote was taken and the motion was passed unanimously to DENY the request.
 
#3. E.L. McCarty and Maurice McCarty request a rezoning from Residential one (R-1) to Commercial Four (C-4) at the following described location: Lot 1 and Lot 2, less the South 15.5 feet thereof, in Block "B" and the South 35.5 feet of Lot 3, all of Lot 4 an the North 25.0 feet of Lot 5 in Block "B" of the McCarty Addition to the City of Jonesboro, Arkansas, as shown on the recorded plat thereof. General location of this property is described as commencing at the Southeast corner of Nettleton and Franklin Street extending south along the east side of Franklin Street for approximately 380.0 feet. A motion was made by Mr. Cooper and seconded by Mr. Ball to APPROVE the request subject to the dedication of 30 feet of right of way on Franklin Street and 41 feet of right of way on Nettleton Avenue. A vote was taken and the motion was passed unanimously.
 
#4. John E. Marcom, Mary Lee Marcom, Jimmy Doyle Hunt, Glenna Hunt, Jonesboro Lumber Company, McDaniel Brothers Construction Company, a partnership consisting of D.H. McDaniel and H.D. McDaniel requests a zoning classification of Commercial Two (C-2) for a parcel of property abutting the present city limits of the City of Jonesboro, Arkansas. Subject zoning request is submitted under the provisions of City Ordinance #1473 providing for zoning classification prior to the subject property being annexed to the city. The MAPC is also asked to make a written statement as to what effect the proposed annexation of this property would have on the city accepting said land. Subject property is described as follows: All that part of the Northwest Quarter of the Southwest Quarter of Section 28, Township 14 North, Range 4 East, lying south of Race Street right of way and lying east of Arkansas Highway No. 173 right of way, containing 37.24 acres, Craighead County, Ar. General location of this property is described as being on the east side of South Caraway Road being immediately south of Race Street. A motion was made by MR. Ball and seconded by Mr. McDaniel to APPROVE the request subject o a 41 foot right of way being dedicated on Race Street. It should be noted that the property owner needs to tie in with a street immediately south of their property and continue it to tie into Race Street. A vote was taken and the motion was passed unanimously. Also property development plan should be submitted to MAPC for approval prior to beginning of any construction.
 
#5. Porter Jones requests a rezoning from Residential One (R-1) to Commercial Three (c-3) at the following described location. A part of the Southeast Quarter of the southwest quarter of section 21, Township 14 North, Range 4 East, being more particularly described as follows: commencing at the northeast corner of the Southeast Quarter of the southwest quarter of aforesaid section 21; thence south 89.0 degrees 30 minutes west 667.0 feet to the point of beginning proper; thence south 328.0 feet; thence south 89.0 degrees 30 minutes west 650.0 feet to the east line of Sycamore Street; thence north 328.0 feet along said east line of Sycamore Street to the South line of Forest Home Avenue; thence North 89.0 degree, 30.0 minutes east 650.0 feet along said south line of Forest Home Avenue to the point of beginning proper, and containing 4.89 acres, more or less. General location of this property is described as being on the Southeast corner of Forest Home and Bittle Street. Request to delete this item from the agenda was received after publication of the required legal notice. No action was taken on this item.
 
#6. Bruce Burrow requests approval of a replat of a part of Lot 3 of Cobb and Lee Survey of the Northwest Quarter of Section 21, Township 14 North, Range 4 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the intersection of the south right-of-way line of the St. Louis and Southwestern Railroad with the west line of Section 21, aforesaid; thence South 89.0 degrees 59.0 minutes east along said railroad right-of-way line 41.0 feet to the point of beginning proper; thence continue South 89.0 degrees 59.0 minutes East along said railroad right-of-way line 218.0 feet; thence South 146.8 feet to the North dedicated right-of-way line of Matthews Avenue; thence south 88.0 degrees 53.0 minutes west along said north line 218.0 feet to the east dedicated right-of-way line of Caraway Road; thence north along said East line 151.3 feet to the point of beginning proper, and containing 0.75 acre, more or less. General location of this property is described as being on the northeast corner of Caraway Road and East Matthews. A motion was made by Mr. Ball and seconded by Mr. Smith to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#7. Bruce Burrow requests the approval of Property Development Plan for a building and parking layout proposed to be constructed on the northeast corner of Caraway Road and East Matthews. A motion was made by Mr. Cooper and seconded by Mr. Ball to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#8. L.C. Inc. requests approval of a replat of Lot 9, 10, and the Southeast one half of Lot 11, Block A, Service Park Addition into one lot. General location of this property is described as being east of Willow Road on Service Street. A motion was made by Mr. Ball and seconded by Mrs. Morse to APPROVE the request. A vote was taken. The vote was YEA: Ball, Smith, Tilton, McDaniel, Gott, and Morse. PASS: Cooper. The motion to APPROVE the request was passed.
 
#9. Dr. Harvey O. Edwards requests the approval of a replat of Lot 6, 7, 8, 9, and 10 of Block A, Edwards Addition into Lots 6, 7, 8, and 9 further requests to replat Lots 6, 7, 8, 9, Block B, Edwards Addition into Lots 6, 7, and 8. General location of this property is described as being on the north of Belt Street and being on the east and west side of Melrose Street. A motion was made by Mr. Ball and seconded by Mr. Smith to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#10. Jamie Buhler requests approval of the 2nd replat of Lot 8 of a replat of Lots 7, 8, and 9 Block F, Richland Hills Addition. General location of this property is described as being bounded by Wood Spring Road on the south and being generally bounded by Ridge Road on the north. A motion was made by Mrs. Morse and seconded by Mr. Gott to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#11. Tommy Rankin requests final approval of a replat of Lot A and a part of Lot B of the Market Place. Subject replat would increase the size of Lot A and decrease the size of Lot B. General location of this property is described as being on the north side of Wilkins Avenue and being west of the Indian Oldsmobile Cadillac Company. A motion was made by Mr. Ball and seconded by Mrs. Morse to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#12. John White and Tommy Rankin requests final approval of a Property Development Plan for Lot A, The Market Place. Lot A size is proposed to be increased by replat, item number 11 of this agenda. Subject Property Development Plan proposes the construction of two buildings on Lot A. General location of this property is described as being the same location of Item 11 of this agenda. A motion was made by Mr. Ball and seconded by Mr. Smith to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#13. Michael Darling requests final approval of the Darling Subdivision of Lot 20 of Wooded Acres Subdivision, Craighead County, Arkansas. General location of this property is described as being southwest of the Apt Community being bounded on the east by Pine Lane and on the southwest by Ridge Road. A motion was made by Mr. Smith and seconded by Mr. Ball to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#14. Joe Rankin requests the preliminary approval of the Rankin's Oak Forrest, Fifth Addition. General location of this property is described as being north of the Rankin's Oak Forrest, Fourth Addition the northwest portion to connect with State Highway #226 (Woodsprings Road). Contains 12.49 acres. A motion was made by Mr. Gott and seconded by Mr. Ball to APPROVE the request. A vote was taken and the motion was passed unanimously.
 
#15. Mr. Mike Cameron, City Engineer, was requested by RESOLUTION from the METROPOLITAN AREA PLANNING COMMISSION to contact the developer of the Nicely Subdivision, Mr. Skip Macon, on the drainage plans for his subdivision and also to investigate possible discrepancies in the plans submitted. A vote was taken and the motion was passed.
 
#16. Impact Statement on Annexations.
 
A.B. Clark and Bobby McDaniel. We see no problems with this request except it should be developed under Flood Plain requirements.
 
John E. Marcom #4. We recommend this area be accepted as requested with the understanding that the street near the center of the property be continued to Race Avenue.
