PUBLIC HEARING - 6:45 P.M. - A public hearing was held regarding the vacating and abandonment of a utility easement in the Highland Subdivision. Attorney Jim Burton represented Mr. Jerry Craft and Attorney Skip Mooney represented several McCarther Park residents who were opposed to the utility easements being vacated. Mr. Burton explained the plat which was filed was not finalized and was filed prematurely. Mr. Mooney explained that the area had already been approved by the MAPC as a residential subdivision and many of the residents were concerned that once the easements had been vacated then commercial zoning would take place. He stated this would be considered spot zoning. Mr. Mooney also stated to remove the street easements would create lots with no access except off Highland Drive.
Mr. Clay Kenward spoke in favor of the abandonment. Mr. Kenward explained that both plats had been approved by the MAPC and if the first plat had not been filed inappropriately then they would not have to bring it before the Council in the first place. Mr. Kenward stated the lots cannot be sold under the first plat. Mr. Randall Wheeler and Ms. Pat Hagen voiced opposition to the abandonment for reasons of safety, loss of property value, and maintenance of the area once it has been rezoned.
CITY COUNCIL MINUTES - NOVEMBER 1, 1993
The Jonesboro City Council met in regular session at 7:30 p.m. Present were the Mayor, City Clerk, City Attorney, and all council members.
The minutes of October 18, 1993, were approved as mailed out by motion of Councilman Perrin seconded by Councilman Harpole. A roll call vote was taken resulting in all council members voting aye.
Councilman Mullenix read a proclamation citing the educational achievements of Ms. Lois Freeman who was named Arkansas' 1994 Teacher of the Year. Ms. Freeman thanked Mayor Brodell and the Council for their contributions to education.
The following ordinance was on the third reading:
AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIESAND OTHER PURPOSES. (KEN & BARBARA SHIRLEY)
Councilman Hannah moved, seconded by Councilman Harpole for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. The ordinance was given the number 2519.
Councilman Wise offered the following ordinance for the first reading:
AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE, PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND OTHER PURPOSES. (CLAY KENWARD/HILLPOINT)
Councilman Vance moved, seconded by Councilman Harpole to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. No further action was taken.
Councilman Wise offered the following ordinance for the first reading:

Councilman Evans moved, seconded by Councilman Vance to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. No further action was taken.
The following ordinance was on the third reading:
AN ORDINANCE AMENDING SECTION 14.04 BY ADDING SECTION 14.04.13 FOR THE PURPOSE OF REGULATING YARD SALES.
Councilman Ingram moved, seconded by Councilman Harpole for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye with the exception of Councilman Perrin, who voted nay. The ordinance was given the number 2520.
Councilman Mays offered the following ordinance for the first reading:
IN THE MATTER OF VACATING AND ABANDONING A STREET EASEMENT IN HIGHLAND FOREST SUBDIVISION TO THE CITY OF JONESBORO, ARKANSAS (JIM BURTON / JERRY CRAFT)
Attorney Skip Mooney requested the status of the rezoning be clarified prior to the vacation and abandonment. Councilman Harpole moved, seconded by Councilman Bowers to suspend the rules and place on the second reading. A roll call vote was taken resulting in all council members voting aye. No further action was taken at this time.
Councilman Harpole moved, seconded by Councilman Bowers to adopt a resolution establishing a public hearing regarding the abandonment of a portion of McClure Street between Johnson Avenue and Word Street. The public hearing was set for November 15, 1993, at 7:10 p.m. at City Hall. A roll call vote was taken resulting in all council members voting aye. The resolution was given the number 1993:58.
Councilman Hannah moved, seconded by Councilman Harpole for the adoption of a resolution to establish procedures for the retention of financial and accounting records. A roll call vote was taken resulting in all council members voting aye. The resolution was given the number 1993:59.
Councilman Bowers moved, seconded by Councilman Perrin to approve the recommendation of the Jonesboro Urban Renewal and Housing Authority to reappoint Ms. Deborah Agnew for another five year term which will expire October of 1998. A roll call vote was taken resulting in all council members voting aye.
Under new business Councilman Hannah stated budget meetings would be scheduled for November 13, 1993, beginning at 7:00 a.m. Councilman Hannah welcomed all council members who wished to attend.
Councilwoman Ingram moved, seconded by Councilman Bowers to publish, in local newspapers, a list of each board, committee and commission currently operating under the Jonesboro City Council. The list was to include the names of each member with the expiration date of their term of office. When vacancies arise then nominations would be taken from the Mayor and Council. A roll call vote was taken resulting in a nine (9) to three (3) vote against the motion. Those council members voting nay were: Wise, Evans, Province, Perrin, Kelton, Vance, Harpole, Mays and Hannah. Those voting aye were: Ingram, Mullenix and Bowers.
Councilman Mullenix moved, seconded by Councilman Bowers to give city employees Thursday and Friday, November 25th and 26th, off for the Thanksgiving Holiday. A roll call vote was taken resulting in all council members voting aye.
With no further business the meeting was adjourned.
