AN ORDINANCE TO AMEND ORDINANCE NO. 3239 REMOVING THE CODE ENFORCEMENT OFFICERS RECOGNIZED AS THE CONDEMNATION AND WEEDS/GRASS OFFICERS FROM THE PLANNING, INSPECTION AND CODE ENFORCEMENT DEPARTMENT; ASSIGNING THOSE OFFICERS TO THE POLICE DEPARTMENT; DEFINING THEIR AUTHORITY; AMENDING THE CITY PAY PLAN; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.

WHEREAS, The City of Jonesboro adopted Ordinance No. 3239 establishing the Department of Planning, Inspection and Code Enforcement and placing these departments under the direct supervision of the City Planner and the City Pay Plan includes the position of Code Enforcement Officer in the Planning Department;

 

WHEREAS, effectiveness, efficiency, and economy of operations can best be realized, and the public best served, by removing the Code Enforcement officers known as the Condemnation and Weeds/Grass Officers from the department of Planning, Inspection and Code Enforcement under the direction of a City Planner and assigning those officers to the Police Department under the direction of the Chief of Police.

 

NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Jonesboro;

 

SECTION 1: That Title 13 of the Jonesboro Municipal Code by hereby amended by adding Sections 13.04.04 and 13.04.05 to Chapter 13.04 entitled Planning, Inspection and Code Enforcement Department and shall read as follows:

 

Section 13.04.04 Certain Functions of Code Enforcement Assigned to the Police Department

Those personnel assigned to the Code Enforcement known as the Condemnation and Weed/Grass Officers whose duties primarily focus on condemnation, weeds, grass, trash and other public nuisances shall fall under the supervision and purview of the Police Department in order to more efficiently deal with those issues associated with public health and safety.

 

Section 13.04.05 Condemnation and Weeds/Grass Officer Responsibilities. The Condemnation and Weeds/Grass Officer shall enforce and be authorized to perform other authorized actions for violations of only those currently effective codes and ordinances, and for any further revisions to same as follows:

 

(1)   City Buildings and Construction Code, Title 11, of the Jonesboro Municipal Code, Chapter 11.32.

 

(2)  City Vehicles and Traffic Code, Title 8 of the Jonesboro Municipal Code, Chapter 8.16.

 

(3)  City Health and Sanitation Code, Title 5 of the Jonesboro Municipal Code, Chapter 5.08, 5.16, 5.20 and 5.24.

 

(4)  City Public Peace, Safety, and Morals code, Title 7 of the Jonesboro Municipal Code, Chapter 7.92.

 

(5)  City Vehicles and Traffic Code, Title 8 of the Jonesboro Municipal Code, Chapter 8.28, Sections 8.28.07, 8.28.09 and 8.28.10 and Chapter 8.40, Section 8.40.10.

 

(6)  City Streets and Sidewalks Code, Title 9 of the Jonesboro Municipal Code, Chapter 9.04, Sections 9.04.01 and 9.04.02.

 

SECTION 2: The position of Code Enforcement Officer, Grade 12 in the City Pay Plan is hereby deleted from the Inspections Department.

 

SECTION 3: In order to enhance the operations of Code Enforcement and improve service to the citizens of Jonesboro, the position of Code Enforcement Officer, Grade 12, is moved to and under the supervision of the Police Department.

 

SECTION 4: Due to the immediate need to provide more effective and efficient service to the City of Jonesboro, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health, and safety, shall take effect from and after its passage and approval.
