AN ORDINANCE TO REZONE A PART OF THE NORTHEAST QUARTER OF SECTION 4, TOWNSHIP 13 NORTH, RANGE 4 EAST FROM R-1 TO C-3 AND TO REZONE A PART OF THE NORTHEAST QUARTER OF SECTION 4, TOWNSHIP 13 NORTH, RANGE 4 EAST FROM R-1 TO R-3

WHEREAS, it is in the best interest of the owner of the property, the residents of the City of Jonesboro and all interested parties that the property described below be rezoned.

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:         

 

SECTION 1: The City of Jonesboro, Arkansas, hereby rezones the following described real property situated in Jonesboro, Craighead County, Arkansas, and more particularly described as follows:

 

A part of the Northeast Quarter of Section 4, Township 13 North, Range 4 East, Craighead County, Arkansas, being more particularly described as follows:  commencing at the North Quarter Corner of said Section 4; thence South 89º32'30" East 65.8 feet to the East Right-Of-Way Line of Arkansas Highway No. 1; thence South 00º44' West along said Right-Of-Way Line 1459.25 feet to the point of beginning proper; thence South 89º54' East 1197.45 feet to the West Right-Of-Way Line of the Union Pacific Railroad; thence South 12º49' West along said Right-Of-Way Line 1202.54 feet to the South Line of aforesaid Northeast Quarter; thence North 89º54' West along said Quarter Section Line 946.31 feet to the East Right -Of-Way Line of Arkansas Highway No. 1; thence North 00º44' East along said Right-Of-Way Line 1173.1 feet to the point of beginning proper, containing 29.00 acres, more or less and being subject to a public road Right-Of-Way off and across the South Side thereof.

 

SECTION 2: That the following portion of the property described (in SECTION 1) above is rezoned from R-1 to R-3:

 

A part of the Northeast Quarter of Section 4, Township 13 North, Range 4 East, Craighead County, Arkansas, to wit:  from the North Quarter Corner of said Section 4, run South 89º32'30" East 65.8 feet to the East Right-Of-Way Line of Arkansas Highway No. 1; thence South 00º44' West along said Right-Of-Way Line 1459.25 feet; then run South 89º54' East 300.02 feet to the point of beginning; then continue South 89º54' East 897.43 feet to the West Right-Of-Way Line of the Union Pacific Railroad; thence South 12º49' West along said Right-Of-Way Line 895.03 feet; then run North 89º54' West 710.51 feet; then run North 00º44' East 873.12 feet to the point of beginning, containing 16.11 acres.

 

SECTION 3: That the following portion of the property described (in section 1) above is rezoned from R-1 to C-3:

 

A part of the Northeast Quarter of Section 4, Township 13 North, Range 4 East, Craighead County, Arkansas, to wit:  from the North Quarter Corner of said Section 4, run South 89º32'30" East 65.8 feet to the East Right-Of-Way Line of Arkansas Highway No. 1; thence South 00º44' West along said Right-Of-Way Line 1459.25 feet to the point of beginning; thence South 89º54' East 300.02 feet; then run South 00º44' West 873.12 feet; then run South 89º54' East 710.51 feet to the West Right-Of-Way Line of the Union Pacific Railroad; thence South 12º49' West along said Right-Of-Way Line 307.51 feet to the South Line of aforesaid Northeast Quarter; thence North 89º54' West along said Quarter Section Line 946.31 feet to the East Right-Of-Way Line of Ark Highway No. 1; thence North 00º44' East along said Right-Of-Way Line containing 12.75 acres and being subject to a public road right-of-way off and across the South Side thereof.

 

SECTION 4: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the recorder of Craighead County, Arkansas, and shall be filed in the deed record of such office.

 

SECTION 5: The City Council of the City of Jonesboro, Arkansas, finds and declares that the rezoning of the aforementioned real property is necessary to maximize the property's best use and to conform it to the proper zoning regulations.

 

SECTION 6: The City Council further finds and declares that an emergency exists and this ordinance is necessary for the preservation of public peace, health and safety and shall take effect and be in full force and effect from and after its passage and approval.
