AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING SAID ANNEXED TERRITORY AS COMMERCIAL (C-3); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described has been proposed; and

 

WHEREAS, said proposal for the annexation of said lands was made by the sole owners of all of the acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, a notice setting a hearing upon said proposal was duly published and a public hearing upon said Petition was duly held at which hearing it was duly found and declared that said annexation was right and proper ant that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; and

 

WHEREAS, no objection to the annexation or proceedings to prevent said annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas; and

 

WHEREAS, said annexation complies with the requirements of Arkansas law.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territories and lands described below and surrounded by the City of Jonesboro be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Craighead County Arkansas, are more particularly described as follows:

(Island near Trim Gym by Race Street C-3 zoning- Jim Lyons)

 

A part of the South Half of the Southwest Quarter of the Northeast Quarter of Section 29, Township 14 North, Range 4 East, being more particularly described as follows: begin at the Southwest corner of aforesaid Southwest Quarter of the Northeast Quarter, thence North 89°02’ East on the 40 acre line 50 feet; thence North 0°11 ½ ‘ East 50 feet to the North right-of-way line of Race Street; thence North 89°02’ East along said right-of-way line 149 feet; thence South 89°03’ East along said right-of-way line 600.34 feet; thence North 89°02’ East along said right-of-way line 73.60 feet to the point of beginning proper; thence North 0°11 ½’ East 627.88 feet; thence North 89°05’ East 138.80 feet; thence South 0°11 ½’ West 627.76 feet to the North right-of-way line of Race Street; thence South 89°02’ West along said right-of-way line 138.80 feet to the point of beginning proper, containing 2.00 acres and being subject to a sanitary sewer easement across the South side thereof.

 

Section 3: The lands and territories annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5 of the City of Jonesboro, Arkansas.

 

Section 4: Said lands and territories annexed to the City of Jonesboro are hereby zoned Commercial (C-3).

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to the accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described herein can be entitled to fire, police, zoning, water and sewage and other protection in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist, this ordinance being necessary for the preservation of public peace, health and safety shall take effect and be in full force from and after its passage and approval.

 

PASSED and ADOPTED this 5th day of May, 1986.
