Metropolitan Area Planning Commission Minutes, February 14, 2002

The minutes of the January 8, 2002 meeting were approved as prepared.

 

#1  RZ02-1 Roy and Nell Bearden requested approval of rezoning from the Residential R-1 Single-Family Medium Density District to the C-3 General Commercial District for Lots 6,7,8,9,20 & 21 in Block A of Benton’s Subdivision.  The general location of the property is on the north side of Southwest Drive, East of Darr Hill Road.

 

Several area residents spoke in opposition to this request.  The main items of concern were noise, outdoor lights, trash, litter, safety concerns for children in the area, smells, flies, traffic, the close proximity of residences on adjacent properties, parking lots adjoining residential property, and the negative effect rezoning would have on property values. 

 

Jerry Sims, representing the Beardens, stated that a convenience store was planned for the site with a structure that would be attractive and maintained.

 

Glenn Batten, City Planner, stated that the lots are configured in an “L” shape with the lots fronting Southwest Drive having a depth of around 156' and a width of 250'.  Mr. Batten pointed out that the AHTD is taking 15' of property for highway improvements which decreases the lot depth and when setbacks are taken into account, the buildable area is greatly reduced.  The proposal does not fit the description of a commercial node either and is not consistent with the Zoning Ordinance.  The continuation of C-3 zoning northeast on Southwest Drive would not be compatible with the adjoining residential uses.

 

Ms. Shaw made a motion to recommend disapproval of the request to the City Council stating that the site is not suitable for commercial development in this very established residential neighborhood and the proposal is not consistent with the Comprehensive Land Use Plan nor the Zoning Ordinance.  The motion was seconded by Mr. Little.  Voting was 7 in favor, 0 opposed.  Those voting aye were Shaw, Krennerich, Gott, Little, Street, Damron, Johnson, MOTION CARRIED, REQUEST DISAPPROVED.

 

#2  RZ02-3 Darrell Floyd requested approval of rezoning from the Residential R-1 Single-Family Medium Density District to the C-3 General Commercial District for 2.0 acres located on a part of the SW 1/4, SW 1/4 of Section 2, T13N, R3E.  The general location of the property is on the north side of Southwest Drive, west of Darr Hill Road.

 

A representative for Mr. Floyd stated they planned to build a building for an agricultural equipment parts store.

 

Glenn Batten, City Planner stated that there are some C-4 parcels across the street and further west of this site.  This proposal is not consistent with the Future Land Use Plan nor is it consistent with the Zoning Ordinance.  The proposal is also incompatible with the surrounding uses and character.  A much larger tract of land is needed to meet the intent of the commercial node as described in the Comprehensive Land Use Plan.

 

Mr. Krennerich made a motion to recommend disapproval of the request to the City Council stating the rezoning is not consistent with the Comprehensive Plan and does not meet the requirements for a commercial node.  The motion was seconded by Mr. Gott.  Voting was 7 in favor, 0 opposed.  Those voting aye were Krennerich, Shaw, Street, Johnson, Gott, Damron, Little, MOTION CARRIED, REQUEST DISAPPROVED.

 

#3  MP02-3 Darrell Floyd requested approval of a one lot, minor plat containing 2.0 acres located on a part of the SW 1/4, SW 1/4 of Section 2, T13N, R3E.  The general location of the property is on the north side of Southwest Drive, west of Darr Hill Road.

#4  RZ02-4 Jonesboro Real Estate Holding Company, Inc. requested approval of rezoning  from the Residential R-2 Multi-Family Low Density District to the C-3 General Commercial District for Blocks 26 & 27 of Patrick’s Third Addition.  The general location of the property is on the north side of Matthews Avenue, east of McDaniel Street, south of Logan Avenue, and west of Houghton Street. 

 

St. Bernard’s RMC has purchased two blocks of property located on the side of Matthews Avenue, east of McDaniel Street, south of Logan Avenue, and west of Houghton Street. 

 

City Planner, Glenn Batten, stated that the rezoning meets the intent of the Comprehensive Plan and is consistent with the zoning ordinance.  This proposal is compatible with the uses and changing character of the area.  Mr. Batten explained that the C-4 and C-5 Zoning Districts did not serve the needs of the petitioners and therefore he had worked with Roger Colbert and Matt Parker, representatives for St. Bernard’s RMC, to prepare a list of limited uses under a C-3 Limited Use Overlay.  Mr. Colbert stated their intention to pursue abandonment of the unnamed, unimproved street right of way splitting the two blocks of property and asked that it be specifically included in the rezoning. 

 

Mr. Krennerich made a motion to recommend approval of an amended zoning of  C-3 LU-O instead of the C-3 General Commercial District to the City Council with the following limited uses: automated teller machine; bank or financial institution; day care, general; hospital; hotel or motel serving the medical center and downtown; medical service/office; nursing home; office, general(medically related); parking lot, commercial serving medical and related uses; restaurant, general(medically related); retail/service with medically related products/services; utility, minor; vocational school(medically related).  This recommendation also includes the unimproved right of way between the two blocks.  The motion was seconded by Mr. Gott.  Voting was 7 in favor, 0 opposed.  Those voting aye were Gott, Damron, Little, Shaw, Johnson, Krennerich, Street, MOTION CARRIED, AMENDED REQUEST APPROVED.

 

#5  CU02-4 Robert and Loretta Guy requested approval of a conditional use for placement of Manufactured Home, Residential Style, at 4719 Industrial Drive.

 

This proposal is located at the southern line of the city limits.  Other manufactured homes have been approved and located in the area. 

 

Ms. Shaw made a motion to approve the conditional use with the following stipulations:

1.  Approval of the septic system by the Health Department prior to issuance of a building permit

2.  Adherence to the Manufactured Home, Residential Style, standards in the zoning ordinance

3.  Inspection and approval by city building inspector prior to permitting or location of home on site

 

The motion was seconded by Mr. Damron.  Voting was 7 in favor, 0 opposed.  Those voting aye were Street, Little, Damron, Shaw, Johnson, Gott, Krennerich, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

 

#6  RP02-3 Jay Harmon requested approval of a replat of Lots 2, 3, 5, 6, 7, 8, 11, 12, 13, 14,  and 15 of Harmon Industrial Park.  The general location of the property is on the west side of Nestle Way, formerly Cottage Home Road, north of Jake Drive.

 

Carlos Wood, representing Mr. Harmon, stated they were replatting lots in the subdivision in order to comply with the I-2 zoning district which was granted some time ago. 

 

It was pointed out by Glenn Batten, City Planner, that the owner’s certification needed to be corrected and the plat revised to reflect “lot lines to be extinguished”.  Mr. Batten advised that in the future all plans should show the adjacent land uses within 200' of the boundaries of the site and provide a better vicinity map.

 

Mr. Street made a motion to approve the request with the stipulation that the owner’s certification on the plat be corrected to show the property subdivision name and revise the plat to show “lot lines to be extinguished” where they now say “old lot lines”.  The motion was seconded by Mr. Damron.  Voting was 7 in favor, 0 opposed.  Those voting aye were Damron, Gott, Little, Street, Krennerich, Johnson, Shaw, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

 

#7  RP02-4 Alec Farmer requested approval of a replat of Lots 1-4, Lots 14 & 15, and the open space 2 of Stone Creek, PUD 2nd revision.  The general location of the property is on the north side of Nettleton Avenue, east of Strawfloor Drive.

 

Ken Scrape, representing Mr. Farmer, stated that this plat was for the purpose of dedicating some right of way for Cemetery Lane and rearranging some lot lines.

 

Glenn Batten, City Planner, raised a question about the configuration of Lot 12 and requested that the building setbacks be added to the plat.  Mr. Scrape informed the commission that Lot 12 was not a part of the replat but they would consider making any needed changes.

 

Claude Martin, City Engineer, stated he needed to confirm the legal description for correctness.

 

Ms. Shaw made a motion to approve the request with the following stipulations:

1.  Revision of the plat to include building setback lines

2.  Approval of the legal description by the City Engineer

3.  Getting with Glenn on the reshaping of Lot lines for Lot 12

 

The motion was seconded by Mr. Krennerich.  Voting was 7 in favor, 0 opposed.  Those voting aye were Shaw, Johnson, Krennerich, Street, Gott, Damron, Little, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

 

#8  PP02-1 Jim Abel requested preliminary approval of subdivision plans for Kensington Estates Phase II.  The subdivision contains 23 lots on 6.30 acres and is located on the east side of Culberhouse Street and is a continuation of Charleston Drive.

 

Mr. Abel explained that this phase of Kensington and Phases IV & V of Woodland Heights Subdivision fill the gap between the existing Woodland Heights Subdivision and the first phase of Kensington Estates.  He noted that there had been very little change in his overall plan that was begun more than six years ago. 

 

Glenn Batten, City Planner, informed the commissioners of the need for an east/west corridor between Southwest Drive and Culberhouse Street and further on to Harrisburg Road.  This area is one alternative for location of a major road across south Jonesboro.  There was much discussion about city plans for a road and whether the city was prepared to build such a road and who was going to be responsible for obtaining the right of way.  Questions were raised as to why MATA did not include this in the Master Street Plan and why the issue had not been addressed in previous years. 

 

The Commissioners stated more time was needed to review such a plan but they did not feel like they could delay action on Mr. Abel’s part due to inaction of the city.

 

Claude Martin, City Engineer, stated that he needed more information regarding drainage, ditch maintenance and intersection radius.

 

A motion to approve the request by Mr. Krennerich with conditions was withdrawn prior to a second being made. 

 

A second motion was made by Mr. Damron to grant preliminary approval of Kensington Estates Phase II, and Woodland Heights Phases items IV & V (which are items 9 & 10 on this agenda) with the following stipulations:

1.  Showing the intersection radius on the plan view

2.  Need to clean out the ditch north of Lots 1 & 8, Block H of Kensington Estates II before starting houses on these lots

3.  Need ditch between Phases III & IV of Woodland Heights cleaned out before building houses in phase 4

4.  Need intersection radius shown on plans for Woodland Heights Phase IV

5.  Need information on pipe at Culberhouse and Crestfield Drive

6.  Include % grade on Crestfield Drive on profile

7.  Need to clean out existing ditch between Phases III & V of Woodland Heights before starting houses in phase V

8.  Show radius on intersection, cul-de-sac and road centerline

9.  Include overall plan of all phases with the final submittal

10. Review street names with Planning Department

11.  Show building setbacks on plat

 

The motion was seconded by Ms. Shaw.  Voting was 7 in favor, 0 opposed.  Those voting aye were Damron, Shaw, Little, Johnson, Gott, Krennerich, Street, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.

 

#9  PP02-2 Jim Abel requested preliminary approval of subdivision plans for Woodland Heights Phase IV.  The subdivision contains 27 lots on 10.19 acres and is located on the east side of Culberhouse Street and is a continuation of Asbury Drive.

#10  PP02-3 Jim Abel requested preliminary approval of subdivision plans for Woodland Heights Phase V containing 30 lots on 11.29 acres and is located on the east side of Culberhouse Street and is a continuation of Covington Drive.

#11  PP02-4 Carroll Caldwell requested preliminary approval of subdivision plans for Deerfield Subdivision Phase II containing 14 lots on 3.81 acres.  The subdivision is a continuation of Deerfield Drive, east of Wimpy Lane.

 

Mr. Krennerich made a motion to grant preliminary approval of these 14 lots and the remaining 100 or so lots in the Deerfield Subdivision with the following stipulations:

 

1.  Providing an outlet to the east

2.  Include overall drainage plans on the whole subdivision in the final plans for Deerfield Phase II as well as the Bob Wood property north of Deerfield

3.  Remove plastic pipe from plans (not allowed)

4.  Finish the triple barrel box if P-1 under Deerfield Drive at Wimpy Lane

5.  Show drainage pipes and sizes on profile and on overall drainage plan

6.  Need station numbers on centerline of plan view

 

The motion was seconded by Mr. Street.  Voting was 7 in favor, 0 opposed.  Those voting aye were Johnson, Street, Damron, Shaw, Krennerich, Gott, Little, MOTION CARRIED, REQUEST APPROVED WITH STIPULATIONS.
