AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED AUGUST 7, 1963; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed in the County Court of Craighead County, Arkansas, Western District, on June 27, 1963; and
WHEREAS, said petition for the annexation of said land was signed by all of the real estate owners, owning all of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing, and a hearing upon said petition was duly had and held in the County Court on August 7, 1963, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an order of annexation was made and entered; and
WHEREAS, more than thirty days has expired since the order of annexation dated August 7, 1963, and no proceedings to prevent said annexation having been filed in the Circuit court for the Western District of Craighead County, Arkansas, said annexation proceedings was in all things confirmed by the County Court by its order of August 7, 1963.
NOW, THEREFORE, BE IT ORDAINED, AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
SECTION I: The territory and lands annexed to the City of Jonesboro, Arkansas, by order of the County Court of Craighead County, Arkansas, Western District, by its order of August 7, 1963, be and are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein, shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
SECTION II: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows, to wit:
All that part of the Northeast Quarter of the Northwest Quarter (NE ¼ NW ¼), the Southeast Quarter of the Northwest Quarter (SE ¼ NW ¼), and the Southwest Quarter of the Northeast Quarter (SW ¼ NE ¼) of Section 25, Township 14 North, Range 3 East, more particularly described as follows: Begin at the center of Section 25, Township 14 North, Range 3 East; thence North 88 degrees 24 minutes East along the half section line 82.4 feet to the intersection with the center line of Wood Street; thence North 1 degree 16 minutes West along the center line of Wood Street 174.0 feet; thence North 2 degrees 55 minutes West along side center line 213.5 feet; thence North 1 degree 54 minutes West alongside center line 340.0 feet; thence North 3 degrees 58 minutes East along said center line 155.2 feet; thence North 6 degrees 35 minutes East along said center line 274.9 feet; thence North 16 degrees 26 minutes East along said center line 100.0 feet; thence North 27 degrees 58 minutes East along said center line 76.0 feet to the intersection with the North line of the Southwest Quarter of the Northeast Quarter of Section 25 aforesaid; thence South 88 degrees 24 minutes West along said 40 acre line 154.4 feet to the Northwest Corner of the Southwest Quarter of the Northeast Quarter of Section 25 aforesaid; thence North along the East line of the Northeast Quarter of the Northwest Quarter of said Section 25 754.4 feet to the intersection with the center line of Wood Springs Road: thence North 47 degrees 46 minutes West along the center line of Wood Springs Road 175.8 47 degrees 46 minutes West along the center line of Wood Springs Road 175.8 feet; thence North 89 degrees 12 minutes West along said center line 400.0 feet; thence South 89 degrees 54 minutes West along said center line 346.0 feet to the intersection with the Southeasterly Bank of Christian Creek; thence South 19 degrees 03 minutes West along said Bank 59.9 feet; thence North 81 degrees 18 minutes West along said Bank 146.5 feet; thence South 75 degrees 47 minutes West along said Bank 50.0 feet; thence South 53 degrees 20 minutes West along said Bank 75.1 feet; thence North 79 degrees 29 minutes West along said Bank 64.1 feet; thence South 61 degrees 37 minutes West along said Bank 109.3 feet to the intersection with the West line of the Northeast Quarter of the Norwest Quarter of Section 25 aforesaid (this point being 530.0 feet South 0 degrees 07 minutes West of the Northwest Corner of the Northeast Quarter of the Northwest Quarter of Section 25 aforesaid); thence South 0 degrees 07 minutes West along said 40 acre line 182.0 feet to the intersection with the Easterly Bank of Christian Creek, thence South 36 degrees 53 minutes East along said Easterly Bank of Christian Creek 172.0 feet; thence south 69 degrees 53 minutes East along said Bank 152.9 feet; thence South 52 degrees 24 minutes East along said Bank 52.2 feet; thence South 37 degrees 36 minutes West along said Bank 85.0 feet, thence South 83 degrees 35 minutes West along said Bank 76.5 feet; thence South 22 degrees 56 minutes East along said Bank 118.0 feet; thence South 71 degrees 04 minutes West along said Bank 112.0; thence South 1 degree 03 minutes West along said Bank 78.0 feet; thence South 63 degrees 03 minutes West along the Southeasterly Bank of Christian Creek 112.1 feet to the intersection with the West line of the Northeast Quarter of the Northwest Quarter of Section 25 aforesaid; thence South 0 degrees 07 minutes West along said 40 acre line 31.1 feet to the Southwest Corner of the Northeast Quarter of the Northwest Quarter of Section 25 aforesaid; thence continue South 0 degrees 07 minutes West along the West line of the Southeast Quarter of the Northwest Quarter of Section 25 aforesaid 1315.3 feet to the Southwest corner of the Southeast Quarter of the Northwest Quarter of Section 25 aforesaid; thence North 88 degrees 24 minutes East along the south line of the Southeast Quarter of the Northwest Quarter 1307.1 feet to the center of Section 25, Township 14 North, Range 3 East, the point of beginning. The above described tract contains 66.228 acres.
SECTION III: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are hereby assigned and attached to Ward 5th, of the City of Jonesboro, Arkansas.
SECTION IV: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro so that said property may be included in the cities 1968 census count; and that it is in the interest of the City of Jonesboro and the citizens and property owners of said territory that same be annexed to the City so that the territory that is set out above can be entitled to fire, police zoning and other protection and benefits, and that said benefits and protection are urgently needed now in order to allow the growth and development of said lands and territory. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation and protection of the public peace, health and safety, shall take effect and be in full force from and after its passage.
