ORDINANCE TO VACATE AND ABANDON AN ALLEY RUNNING THROUGH BLOCK 1 OF COLE'S SECOND ADDITION

WHEREAS, a petition was duly filed with the City Council of the City of Jonesboro, Arkansas, on the 2^nd day of August, 1971, praying the City Council to vacate and abandon the alley described as:

An alley running North and South through the middle of Block 1 of Coles Second Addition to the City of Jonesboro, Arkansas, bounded on the East by Lots 1, 2, 3, 4, 5 and 6, and on the West by Lots 7, 8, 9, 10, 11 and 12 of said Coles Second Addition, beginning at West Nettleton Avenue and running through to Thomas Avenue, platted and filed for record in Deed Record 26, page 402-403, at the office of the Recorder of the Jonesboro District of Craighead County, Arkansas and:

WHEREAS, after due notice as required by law the City Council has at the time and place mentioned in the notice heard all persons desiring to be heard on the question and has ascertained that the alley heretofore described as heretofore been dedicated to the public use as an alley; that it has never actually been developed or used by the public for many years; that all of the owners of the property abutting upon the alley to be vacated have filed with the City Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley.

NOW, THEREFORE, be it ordained by the City Council of Jonesboro, Arkansas:

Section 1: The City of Jonesboro, Arkansas, hereby releases, vacates and abandons all its rights described as follows:

An alley running North and South through the middle of Block 1 of Coles Second Addition to the City of Jonesboro, Western District of Craighead County, Arkansas, bounded on the East by Lots 1, 2, 3, 4, 5 and 6, and on the West by Lots 7, 8, 9, 10, 11 and 12 of said Coles Second Addition, beginning at West Nettleton Avenue and running through to Thomas Avenue.

Section 2: A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the Jonesboro District of Craighead County and recorded in the deed records of said county.

Section 3: This Ordinance shall take effect and be in force from and after its passage.
