AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS,  BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORY TO WARD TWO (2); ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCY; AND FURTHER PURPOSES.

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter more fully described, was duly filed in the County Court of Craighead County, Arkansas on April 12th, 1991; and
 
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the Quorum Court of Craighead County, Arkansas on July 29th, 1991 at 7:00 o'clock p.m., at which hearing it was duly found and declared that the petition for annexation was right and proper and that the lands hereinafter more fully described should be annexed to the City of Jonesboro, Arkansas, whereupon an order of annexation was made and entered; and,
 
WHEREAS, thirty (30) days have expired since the order of annexation was filed on July 29th, 1991 and no proceedings to prevent the annexation have been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, the annexation proceedings were in all things  confirmed  by  the  Quorum  Court  of  Craighead  County, Arkansas. By its order of September 6th, 1991.
 
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
 
SECTION 1: The territories and lands annexed to the City of Jonesboro, Arkansas by order of the Quorum Court of Craighead County, Arkansas filed July 29th, 1991 be and are hereby accepted by the City of Jonesboro, Arkansas, and the territory hereinafter more fully described shall be hereafter deemed and taken to be a part and parcel of the limits of the city of Jonesboro, Arkansas and the inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
 
SECTION 2: The lands and territories hereby annexed to and accepted by the City of Jonesboro, Arkansas are more fully described as follows: (Hedger /Happy/ Lane - Zolper) Part of the Southeast Quarter of the Northeast Quarter of Section 8, Township 14 North, Range 3 East, more particularly described as follows: commencing at the Northeast corner of said Southeast quarter of the Northeast Quarter thence South on the Section line 40 rods; thence West 20 rods; thence North 40 Rods; thence East 20 Rods to the point of beginning, containing  5 acres, more or less.
 
SECTION 3: The lands and territories hereby annexed to the City of Jonesboro are hereby accepted by the City of Jonesboro and assigned and attached to Ward Two (2) of the City of Jonesboro,  Arkansas.
 
SECTION 4: The lands and territories hereby annexed to the city of Jonesboro are here-by zoned Residential (R-1).
 
SECTION 5: It  is  hereby  found  and  declared  by  the  City  Council for the  City of Jonesboro,  Arkansas  that  there  is  now  an  extreme  urgency  that  the  territory  herein  be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that the property and the citizens of the territory described above can be entitled to fire, police, zoning water, sewage and other protections and benefits and that these benefits and protections are urgently needed how in order to allow orderly growth and development of the lands and territories herein above described.  
 
THEREFORE,  an  emergency  is  hereby  declared  to exist  and this  Ordinance  being necessary for the  preservation of the public peace, health and safety shall take effect and be in full force from and after its passage and approval.
 
PASSED and ADOPTED this 7th day of October, 1991.
