AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED AUGUST 19, 1986; ASSIGNING SAID ANNEXED TERRITORY TO WARD 4; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a Petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described was duly filed with the County Court of Craighead County, Arkansas, Western District, on July 14, 1986; and

 

WHEREAS, said Petition for annexation of said lands was signed by all the real estate owners owing acreage to be annexed to the City of Jonesboro; and

 

WHEREAS, an Order setting a hearing on said Petition was entered, notice was duly published on said hearing and hearing was duly had upon said Petition in the County Court on August 19, 1986, at which hearing it was duly found and declared by the Court that said Petition for Annexation was right and proper and that said lands hereinafter described should be annexed to the City of Jonesboro, Arkansas, whereupon an Order of Annexation was made and entered; and

 

WHEREAS, 30 days have expired since the Order of Annexation dated August 19, 1986, and no proceedings to prevent said annexation have been filed in the Circuit Court of Craighead County, Arkansas, Western District;

 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by Order of the County Court of Craighead County, Arkansas, Western District, dated August 19, 1986, be and they are hereby accepted by the City of Jonesboro, Arkansas, and said territory hereinafter described shall hereinafter be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants within the new annexation shall have and enjoy all rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.

 

Section 2: The lands and territory annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (Walnut Street Baptist Church, West of present Walnut Street Baptist Church bldg. at the end of Scenic Drive and South of the end of Dupwe)

 

A part of the South Half of the Southeast Quarter of the Southeast Quarter of Section 23 and a part of the Northeast Quarter of the Northeast Quarter of Section 26, Township 14 North, Range 3 East, being more particularly described as follows: Begin at the Southeast Corner of Section 23, Township 14 North, Range 3 East; thence N489˚ 40’ West on the Section line 521.84’ to the point of beginning proper; thence N89˚40’W 810.96’; thence in a Northerly direction on the 40 acre line 659.65’ to the South line of Briarwood 2nd and 3rd Additions; thence in an Easterly direction along said line approximately 1320.0’ to the Section line; thence S1˚06’W on the Section line 400.75’ Thence N89˚40’W 417.5’; thence S1˚06’W 677.5’; thence N89˚40’W 104.34’; thence N1˚06’E 417.5’ to the point of beginning proper, containing 18.5 acres, more or less.

 

Section 3: The lands and territories annexed to the City of Jonesboro, Arkansas, and accepted by the City are hereby assigned and attached to Ward 4.

 

Section 4: The lands and territories herein annexed to the City of Jonesboro, Arkansas, have been zoned (R-2).

 

Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that the immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect from and after its passage.
