AN ORDINANCE TO AMEND ORDINANCE NO.954, KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that:

 

SECTION 1: Ordinance No.954 known as the Zoning Ordinance of the City of Jonesboro, Arkansas, be amended as recommended by the Metropolitan Area Planning Commission by the changes in zoning classification as follows:

 

From Residential (R-1) To Commercial (C-3) to the following described property.

 

DESCRIPTION #1:

 

Part of the Southeast Quarter of Section 10, Township 14 North, Range 3 East, Craighead County, Arkansas being more particularly described as follows:  Begin at the Southeast Corner of Section 10, Township 14 North, Range 3 East, Craighead County, Arkansas; thence South 89º06'45" West along the South Line of Section 10, aforesaid, 50.02 feet to the point of beginning proper; thence continue South 89º06'45" West along said South line 2162.68 feet to the centerline of Wheeler Drive; thence North 0º44'11" East along said centerline of Wheeler Drive 1186.90 feet to the South Right-Of-Way Line of (U.S. Highway 63-B) Dan Avenue; thence South 75º00'23" East along said South Right-Of-Way Line 2229.14 feet; thence South 0º36'15" West 576.63 feet to the point of beginning proper, containing 43.74 acres and being subject to an easement of 30.00 feet for Wheeler Drive along the West Side of the tract as shown on the plat of survey hereon.

Part of the East Half of the Southeast Quarter of Section 15, Township 14 North, Range 3 East, Craighead County, Arkansas being more particularly described as follows:

 

Begin at the Southeast Corner of the Northeast Quarter of the Southeast Quarter of Section 15, Township 14 North, Range 3 East, Craighead County, Arkansas; thence South 88º59'06" West along the South Line of Section 15 aforesaid, 646.28 feet to the Easterly Right Of Way Line of United States Highway 63; thence along said Right Of Way Line as follows: North 46º22'00" West  23.21 feet, North 27º08'42" West 290.23 feet to the Southerly Right Of Way Line of St. Louis Southwestern Railroad; thence North 84º11'54" East along said Southerly Right Of Way Line 803.61 feet to the East Line of the Northeast Quarter of the Southeast Quarter of Section 15, aforesaid; thence South 0º41'00" West along said East Line 344.08 feet to the point of beginning proper, containing 5.25 acres.

 

SECTION 2: It is found and declared by the City Council that the proper use of the tract of land described above in the Ordinance is being delayed because of improper zoning, and that therefore, an emergency is hereby declared to exist and this Ordinance, being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from and after its passage and approval.
