The Oath of Office was administrated to elected Aldermen Park, Stricklin, Hinson, Bridger, Evans, Shelton, Hannah, Strauser, Sanderson, Province, Mays, and Nix by City Clerk Puryear immediately preceding the meeting.

 

City Council Minutes - January 5, 1987

 

The Jonesboro City Council met at 7:30 p.m. at City Hall. Present were Mayor, City Clerk, City Attorney and all Aldermen. The Pledge of Allegiance was given and Mr. Mays gave the invocation.

 

The minutes of December 15, 1986, were approved as mailed on motion by Mr. Stricklin, seconded by Mr. Sanderson. All voted aye.

 

The following ordinance was on second reading (Annexation - Wilson Cox, N. Scott, R-2)

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-2); DECLARING AN EMERGENCYAND FOR OTHER PURPOSES.

 

Attorney Skip Mooney asked Aldermen to amend existing annexation policy requiring that streets within a subdivision meet city requirements prior to annexation and allow residents of the subdivision to pay for construction of streets, curbs and gutters after the proposed annexation. He proposed drafting a letter of agreement between the city and residents of the subdivision stating that property owners will play for the improvements after annexation and will not expect, ask, or require the city government to pay for the street work He further added property owners have agreed to place the money in an escrow account whereby each owner would play their pro rata share to assure payment in having the streets brought up to city standards and to meet the city code.

 

Mr. Stricklin asked that the letter stipulate the city would continue to maintain the street as it is until the streets meet the city standards. Mr. Mays asked Mr. Mooney how binding the letter would be if the ownership of the property changes. Mr. Mooney stated that it would be legally binding and part of the public record.

 

Dr Strauser asked the letter provide a stipulation that the paving of the streets by completed in the summer of 1987.

 

Mr. Hannah asked for a recommendation from the Police and Fire Departments, and the City Engineer before voting on the proposal with regard to the effect gravel streets within a subdivision would have on city equipment.

 

Mr. Mooney asked the third reading of the ordinance be delayed until Feb. 2 in order to provide Aldermen & service personnel an opportunity to look at and evaluate the streets. He stated he would provide Aldermen with a copy of the letter prior to the third reading for their review. He told Aldermen that residents of a number of unincorporated areas near the city are waiting on the pending annexation petition to determine if they will move for annexation to the city.

 

The following ordinance was on third reading: (Rez/J. White, Jr. & R. White, Fox Meadow Village 3rd Addition, C-3 to R-2)

 

AN ORDINANCE TO AMEND ORDINANCE #954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES

 

Mr. Park moved, seconded by Mr. Shelton to adopt the ordinance. All voted aye. Mr. Park further moved, seconded by Mr. Shelton to include the emergency clause. All voted aye. The ordinance was given the number 2008.

 

Regarding the election of Vice-Mayor, Mr. Province moved, seconded by Mr. Evans to nominate Robin Nix. Mr. Park moved, seconded by Mr. Bridger to nominate Shirl Strauser. Mr. Nix asked that his name be withdrawn from consideration to keep unity on the council. Mr. Bridger moved, seconded by Mr. Stricklin for the nominations to cease. All voted aye. A vote was taken on Dr. Shirl Strauser for the position of Vice-Mayor. All voted aye.

 

Mr. Shelton moved, seconded by Mr. Evans to set an Appeal Hearing for Mrs. Patsy Thomasson, 801 Shoshoni regarding a Board of Variance decision to appeal a variance on a storage building at 7:00 p.m. on January 19, 1987. All voted aye. Mr. Mays asked the Attorney, Donn Mixon to provide documents and information regarding the matter prior to the hearing. Mr. Mixon concurred that he would provide said material.

 

Mayor Brodell welcomed Mr. Province to the council and stated he was looking forward to working with Aldermen, City Clerk, City Attorney, Department Heads, and other employees to make a better Jonesboro.

 

He announced that the seating arrangement of the Aldermen, Committee Chairman, and Committees would be announced at the January 19, 1987, meeting.

 

Mr. Stricklin called attention to the Resolution Index prepared by the Clerk of resolution adopted in 1986 and expressed his appreciation for the information.

 

Mr. Bridger announced that the committee to study intersections on Gee is currently reviewing the matter and drawings are being prepared. He stated he would have a report at the next meeting.
