AN ORDINANCE TO AMEND CHAPTER 117, ARTICLE III, KNOWN AS THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS, PROVIDING FOR A CHANGE IN ZONING BOUNDARIES FROM C-3 GENERAL COMMERCIAL DISTRICT TO RM-12 LUO MULTI FAMILY RESIDENTIAL DISTRICT WITH LIMITED USE OVERLAY FOR PROPERTY LOCATED AT 2038 NORTH CHURCH STREET, JONESBORO, ARKANSAS, AS REQUESTED BY NK & SONS INVESTMENT

WHEREAS, the owners of certain real property located at 2038 North Church Street, Jonesboro, Arkansas, have filed a request to rezone said property from C-3 General Commercial District to RM-12 LUO Multi Family Residential District with Limited Use Overlay; and

 

WHEREAS, the Metropolitan Area Planning Commission has reviewed said request and, after due consideration, has recommended approval of the proposed rezoning; and

 

WHEREAS, the proposed rezoning with conditions is deemed appropriate for the orderly growth and development of the City; and

 

WHEREAS, the City Council finds that the requested zoning change promotes the public health, safety, and welfare of the citizens of Jonesboro;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:

 

SECTION 1. Chapter 117, Article III of the Code of Ordinances of the City of Jonesboro, Arkansas, be amended so as to change the zoning classification of the following described property:

 

FROM:                     C-3 General Commercial District

TO:                           RM-12 LUO Multi Family Residential District with Limited Use Overlay

 

For the following described property:

 

A REPLAT OF LOTS 2 AND 3 OF T.B. HEATH SUBDIVISION OF THE WEST 15 ACRES OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 7, TOWNSHIP 14 NORTH, RANGE 4 EAST AS SHOWN BY PLAT RECORDED IN BOOK 48 AT PAGE 254 IN THE CIRCUIT CLERK’S OFFICE, CRAIGHEAD COUNTY COURTHOUSE, JONESBORO, ARKANSAS.  ALONG WITH A PART OF 8 OF T.B. HEATH SUBDIVISION OF THE WEST 15 ACRES OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECITON 7, TOWNSHIP 14 NORTH, RANGE 4 EAST AS SHOWN BY PLAT RECORDED IN BOOK 487 AT PAGE 254, IN THE CIRCUIT CLERK’S OFFICE, CRAIGHEAD OUNTY COURTHOUSE, JONESBORO, ARKANSAS.  BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF LOT 3 OF SAID T.B. HEATH SUBDIVISION, THENCE SOUTH 89º28’41” EAST 3.80 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 89º28’41” EAST 313.10 FEET; THENCE NORTH 00º06’56” EAST 200.74 FEET; THENCE SOUTH 89º37’48” WEST 308.43 FEET; THENCH SOUTH 01º28’52” EAST 195.96 FEET TO THE POINT OF BEGINNING.  HAVING A COMBINED AREA OF 61,629.8 SQUARE FEET, 1.42 ACRES MORE OR LESS. 

 

 

SECTION 2.  All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.

 

SECTION 3.  The rezoning of this property shall adhere to the following conditions:

 

1.                          That the proposed site plan shall satisfy all requirements of the City Engineer, all requirements of the current Stormwater Drainage Design Manual Flood Plain Regulations regarding any new construction.   

2.                     A final site plan subject to all ordinance requirements shall be submitted, reviewed and approved by the Planning Department prior to any redevelopment of the property.  

3.         Any change of use shall be subject to Planning Commission approval in the future.

4.                     The Limited Use Overlay shall limit multi-family development to a total of twelve (12) units on the property.
