PUBLIC HEARING- 6:15 p.m. - A public hearing was held regarding the abandonment of a 7 1/2 foot utility easement on the west property line running between Spring Hollow Drive. Mrs. Suzan Houston requested the public hearing. No opposition was voiced.

 

CITY COUNCIL MINUTES - March 17, 1997

 

The Jonesboro City Council met Monday, March 17, 1997, at 6:30 p.m. A full quorum was in attendance. Present were: City Clerk, Donna K. Jackson, City Attorney; Phillip Crego, and 11 council members. Those members were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Vice Mayor Kelton presided over the meeting in the absence of Mayor Brodell who was away on official city business. Councilman Province was unable to attend due to a death in his family.

 

The minutes of March 3, 1997, were approved as mailed by Councilman Rega and seconded by Councilman Roddy. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Mr. Joe Carrier addressed the Council regarding a condemnation extension of his property located at 511 Cate Street and 925 Warner Street. Discussion was held regarding the posting of a bond prior to granting the extension. It was determined that a bond would not be necessary since Mr. Carrier could be trusted to complete the project. Councilman Roddy moved, seconded by Councilman Pratt to grant Mr. Carrier a nine month extension with both houses to be completed by the end of 1997. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

The following ordinance was on the third and final reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES (David Cossey and Mike Young)

 

Mr. Charles (Skip) Mooney, Sr., represented David Cossey and Mike Young regarding the annexation. He stated his clients were in agreement with the stipulations established by the Metropolitan Area Planning Commission, with the exception of bringing existing residential streets up to code in terms of curb and gutter and street right of way. He explained that it would be impossible to require individual residents to agree with this stipulation since the area was developed prior to annexation. Mr. Mooney provided Council with a list of new homes, paved streets, and subdivisions that have been built within the past 8 years and were not required to curb and gutter the streets. Mr. Brian Wadley, of the Planning and Inspection Department, explained the streets were paved as part of a Street Improvement Agreement. Mr. Mike Cameron, Engineer for the project spoke in favor of not requiring curb and gutter. Councilman Rorex questioned Mr. Cameron if curb and gutter was utilized in the Sage Meadows Subdivision. Mr. Cameron stated it was, but Sage Meadows was undeveloped at the time of the annexation. City Engineer, Mr. Claude Martin was asked by Council to report on the condition of the roads in the area. Mr. Martin stated he had inspected the David Cossey Subdivision north of Macedonia Road and found the pavement to be good but needed to be widened. Mr. Martin also stated the ditches were shallow with very little drainage. The cost to the City of Jonesboro to curb & gutter the area was estimated at $75,000.00. Mr. David Cossey was asked why he wanted to annex in to the city. He stated the cost of insurance and electricity would decrease dramatically. Mr. Cossey questioned why homes within Jonesboro were being built without curb and gutter. Councilman Kelly responded by saying just because others build without following the Code, that does not make it right. In closing, Council was reminded that the nearest fire station was 5 miles away, causing a slow response time. A slow response time would have a negative impact on Jonesboro’s Class 3 Fire Rating.

 

The following ordinance was on the third reading:

 

ORDINANCE TO ANNEX 99.475 ACRES LOCATED ON THE NORTH SIDE OF MACEDONIA ROAD, WITH A PORTION OF THE PROPERTY BEING ON THE SOUTH SIDE OF MACEDONIA ROAD, ALL OF IT EAST OF HIGHWAY 351

 

Councilman Tate moved, seconded by Councilman Young for the adoption of the ordinance. A roll call vote was taken resulting in a nine (9) to two (2) vote in opposition of the motion. Those council members voting nay were: Kelton, Kelly, Tate, Crockett, Rega, Pratt, Young, Bowers, and Roddy. Those council members voting aye were: Rorex and Fletcher. The motion was denied.

 

Councilman Bowers offered the following ordinance for the first reading

 

AN ORDINANCE TO ABANDON A 7 1/2 UTILITY EASEMENT LOCATED ON THE WEST SIDE OF 2114 SPRING HOLLOW DRIVE (Suzan Houston)

 

Councilman Bowers moved, seconded by Councilman Roddy to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Bowers moved, seconded by Councilman Fletcher to further suspend the rules and place on the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Rega moved, seconded by Councilman Bowers for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The ordinance was given the number 2761.

 

Councilman Bowers offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Paula Craft / Mooney)

 

Councilman Young moved, seconded by Councilman Tate to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Tate moved, seconded by Councilman Fletcher to further suspend the rules and place on the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Young moved, seconded by Councilman Roddy for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Councilman Young offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Farm Credit / Ralph Waddel)

 

Mr. Ralph Waddell, Attorney for Farm Credit stated the rezoning was being requested to allow for extra employee parking. Councilman Kelly expressed concern over changing a residential area to commercial citing reasons of spot zoning and setting a precedence for future commercial zoning in the area. Councilman Young moved, seconded by Councilman Rorex to suspend the rules and place on second reading. A voice vote was taken with all council members voting aye with the exception of Councilman Kelly who voted nay, and Councilman Crockett who abstained from voting. Those members voting aye were: Kelton, Rorex, Tate, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (Max Dacus, Jr.)

 

Councilman Tate moved, seconded by Councilman Bowers to suspend the rules and place on second reading. A voice vote was taken with all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Councilman Rega offered the following ordinance for the first reading:

The following ordinance was on the second reading:

 

AN ORDINANCE TO AMEND TITLE NINE, KNOWN AS STREETS AND SIDEWALKS BY AMENDING CURB AND GUTTER REQUIREMENTS IN THE STREET IMPROVEMENT PROGRAM STANDARDS MANUAL

 

A public hearing was scheduled for March 18, 1997.

 

The following ordinance was pulled from the agenda:

 

AN ORDINANCE TO AMEND SECTION 8.16.03 OF THE JONESBORO CODE OF ORDINANCES TO ESTABLISH A PERMIT FEE FOR NON-OPERABLE VEHICLES

 

Councilman Pratt offered the following ordinance for the first reading:

 

AN ORDINANCE AMENDING CHAPTER SIX OF THE JONESBORO CODE OF ORDINANCES PROVIDING THAT ANIMAL CONTROL OFFICERS ASSUME THE PRINCIPAL RESPONSIBILITY FOR ANIMALS; AMENDING THE AGE FOR DOGS BEING KEPT OVER FIVE, AMENDING THE DATE WITHIN WHICH A VACCINATION IS REQUIRED FOR ANIMALS

 

Councilman Pratt moved, seconded by Councilman Bowers to suspend the rules and place on second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Councilman Tate moved, seconded by Councilman Roddy to set an appeal hearing for April 7, 1997, at 5:30 p.m. to be held in Municipal Court, 410 W. Washington, Jonesboro, Arkansas. Mr. Jim Pyle requested the hearing regarding a rezoning denial by the Metropolitan Area Planning Commission for Lots 4,5,6,7,9,10 and 12 of Wakefield Acres, located on the north side of Harrisburg Road on Wakefield Drive. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Councilman Tate moved, seconded by Councilman Roddy for the adoption of a resolution setting a public hearing for April 21, 1997, at 5:30 p.m. to be held in Municipal Court, 410 W. Washington, Jonesboro, Arkansas. Jimmy Doyle Hunt requested the public hearing regarding the abandonment of a drainage easement located in the David Smith Addition. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given the number 1997:19.

 

Councilman Roddy moved, seconded by Councilman Kelton for the adoption of a resolution setting a public hearing for April 21, 1997, at 5:30 p.m. to be held in Municipal Court, 410 W. Washington, Jonesboro, Arkansas. Jimmy Doyle Hunt requested the public hearing regarding the abandonment of an unimproved portion of Tina Circle. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given the number 1997:20.

 

Councilman Rega moved, seconded by Councilman Bowers for the adoption of a resolution setting a public hearing for April 7, 1997, at 6:00 p.m. to be held in Municipal Court, 410 W. Washington, Jonesboro, Arkansas. Carroll Caldwell requested the public hearing for the abandonment of the southern 5 feet of a 20 foot sanitary sewer easement located in Fairway Homes. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given number 1997:21.

 

Councilman Crockett moved, seconded by Councilman Young for the adoption of a resolution setting a public hearing for April 7, 1997, at 6:10 p.m. to be held in Municipal Court, 410 W. Washington, Jonesboro, Arkansas. Mike Cameron requested the public hearing for the abandonment of an undeveloped street platted as Azalea Cove, located in Block D of Aggie Village and portion of a cul-de-sac on Azalea Lane located in Block A of Aggie Village. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given number 1997:22.

 

Under new business, Councilman Tate offered the following ordinance for the first reading:

 

ORDINANCE TO AMEND ORDINANCE NO 2504 PROVIDING FOR A CHANGE IN THE AMOUNT OF RIGHT OF WAY RESERVED FOR EACH CLASS OF STREET REQUIRING ENGINEERING INFORMATION AND FOR OTHER PURPOSES

 

Councilman Tate moved, seconded by Councilman Young to suspend the rules and place on second reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Tate moved, seconded by Councilman Kelly to further suspend the rules and place on the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Tate moved, seconded by Councilman Young for the adoption of the ordinance. A roll call vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The ordinance was given number 2764.

 

Councilman Young moved, seconded by Councilman Tate for the adoption of a resolution appropriating $9,500.00 to come from unallocated surplus for a service contract from the Tiberon Software Company. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Kelly, Tate, Crockett, Rega, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given the number 1997:23.
