AN ORDINANCE TO CONDEMN HOUSES LOCATED AT: (A) 104 W. FOREST, (B) 1601 FOREST HOME ROAD, (C) 308 CENTER STREET (SHED BEHIND), (D) 604 HOPE STREET, (E) 407 WEST HUNTINGTON, (F) 526 W. WOODROW; TO IMPOSE A LIEN UPON SAID PROPERTY AND TO REMOVE SUCH STRUCTURE FROM SAID PROPERTY AND FOR OTHER PURPOSES.

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:

 

SECTION 1: That A. Belle Mangrum; B. Herald Kaffka; C. Agnes Eason; D. Issac Middlebrook; E. H. A. Fields; F. Edward Lumpkin are the owners of the following described property and that the said owners are hereby ordered to remove or raze the buildings upon said properties within thirty (30) days from the effective date of this Ordinance.

 

SECTION 2: That said properties is hereinafter set forth in this Section, giving the street addresses and the hazards which they constitute to the citizens of Jonesboro, Arkansas that same being as follows: the properties are located at (A) 104 W. Forest; (B) 1601 Forrest Home Road; (C) 308 Center Street; (D) 604 Hope Street; (E) 407 W. Huntington; (F) 526 W. Woodrow and said structures are deficient as follows: The kitchen sinks, lavatories, tub and water closets are not maintained in good sanitary working condition, these fixtures are considered unsanitary and dilapidated; the foundations need extensive repair and is not supporting the floors which are swayed; exterior walls are not maintained and in sound condition and good repair; windows and doors are not substantially weather tight and rodent proof and are not maintained in sound working condition and good repair; hardware on windows and doors need repair or replacement; interior floors are bucked or uneven and need extensive repair; walls and ceilings need major repair throughout the structure.

 

SECTION 3: The City Attorney is hereby directed to institute such legal proceedings, as may be necessary, in order to enforce the provisions of this ordinance and to remedy the dangers and unsightly conditions brought about as a result of the failure of the owner to properly keep up said properties.

 

SECTION 4: That said legal proceedings shall provide that unless the houses are razed within a certain period to be allowed by the Court, the City of Jonesboro, Arkansas, is hereby authorized to raze said property and have a lien upon the real estates for the cost of removing said houses.

 

SECTION 5: That all ordinances or part of ordinances in conflict herewith are hereby repealed to the extent of said conflict.

 

SECTION 6: The City Council finds and declares that the structures owned by Bell Mangrum; Harold Kaffka; Anges Eason; Issac Middlebrook; H. A. Fields; Edward Lumpkin are in such a dilapidated and hazardous condition as to constitute a fire and health hazard to the citizens and residents, whose property adjoin the properties in question and that this Ordinance needs to be put into effect immediately to protect the public peace, health and safety of the citizens of Jonesboro, Arkansas and therefore an emergency is hereby declared to exist and this ordinance shall be in full force from an after its passage and  approval.

 

PASSED AND ADOPTED this 15th day of August, 1988.
