CITY COUNCIL MEETING APRIL 5, 1976

 

The Jonesboro City Council met in regular session, Monday, April 5, 1976, at 7:30 p.m. There were present: Mayor, City Clerk, City Attorney, and the following named aldermen: Bowers, Sanderson, Bridger, Burns, Stricklin, Minx, Smith, Hinson, Haggenmacher, Johnson, and Darling. Absent: Hannah.

 

Mr. Sanderson offered the following ordinance:

 

AN ORDINANCE TO AMEND ORDINANCE #954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGES IN ZONING BOUNDARIES

 

Mr. Randall Ishmael, representing Southern Cast Products, advised council of 1976 Legislation, which authorizes the Mayor to advertise a Public Hearing concerning Act 9 Bond Issues.

 

Mr. Sanderson moved that the Mayor be given the authorization to do so, seconded by Mr. Stricklin, with all members voting aye.

 

After some discussion on the light at Cherry & Main and the Mayor advising council of the expense involved in repairing the light, Mr. Sanderson moved that the Safety Officer make a study on intersections for a report at the following meeting. The motion was seconded by Mr. Minx; with all members voting aye.

 

Mr. Joe Foster, representing EAPD, advised council of a federal grant available for a Bikeway Plan for the City. Mr. Bridger moved that the request for funds be made and the application filed, seconded by Mr. Stricklin. All members voted aye.

 

Mr. Minx moved that Mr. Bob Robinson be appointed to the Parks Commission, seconded by Mr. Bridger. Roll call: voting aye; Bowers, Sanderson, Bridger, Burns, Stricklin, Minx, voting nay; Smith, Hinson, Haggenmacher and Darling. Mr. Johnson passed. Motion failed.

 

Mr. Minx moved that the council meet in executive session, seconded by Mr. Bridger. All voted aye.

 

After the executive session, Mr. Minx moved that the previous action of council be rescinded, seconded by Mr. Smith, receiving unanimous vote of council.

 

Mr. Minx moved that Mr. Bob Robinson be appointed to the Parks Commission, seconded by Mr. Bridger, with all members voting aye.

 

Mr. Stricklin moved that Mr. Al Mink be appointed to the CW&L Board from Ward 3, seconded by Mr. Burns, with unanimous vote of council.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS: DATED JANUARY 20, 1976; ASSIGNING SAID ANNEXED TERRITORIES TO WARD 3; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Mr. Smith moved that the rules be suspended and the ordinance be placed on third and final reading, seconded by Mr. Bowers. All voted aye. Mr. Smith then moved that the Ordinance be adopted to include the emergency clause, seconded by Mr. Bowers with all members of council voting aye. The Ordinance was given #1494.

 

Mr. Minx moved that the structure at 323 Short Fisher be condemned and torn down, seconded by Mr. Bowers, all voted aye.

 

Mr. O’Dell Conyers, was given permission to place a mobile home at 2610 Donald Street on motion by Mr. Bowers, seconded by Mr. Johnson, with the descending vote cast by Mr. Minx.

 

After the Mayor has advised council that a Mrs. Webb had contacted him about erecting a condominium at the corner of Oak & Madison, Mr. Burns moved that the matter be referred the MAPC for their recommendations, seconded by Mr. Stricklin. All members of council voted aye.

 

The following bids were opened on a truck for the Humane Officer:

 

Central Chevrolet                      $3,750.00

Aycock Pontiac                     3,777.72

O’Neal Ford                     3,673.58

 

Mr. Stricklin moved that the low bid form O’Neal Ford be accepted, seconded by Mr. Hinson with unanimous vote of council.

 

May or Stallings read a letter from the Library board advising council that all members had resigned because of some confusion over their expiration dates. The Mayor recommended that the following be appointed:

Adrienne Washer                     1976-78

 

Mr. Johnson moved that the appointments be approved, seconded by Mr. Bridger. All aye.

 

The following bids were opened on used equipment for the street department:

Mr. Burns moved that the acceptance of the bids be deferred until the following meeting, seconded by Mr. Bridger. All members voted aye.

 

Mr. Hinson moved that the City Attorney draw up an ordinance placing a stop sign on the South Side of Wood Street at its intersection with Rosemond. All council voted aye.

 

After Mr. Burns had read recommendations from the Craighead County Bar Association, he offered the following Ordinance:

 

AN ORDINANCE TO PROVIDE THE CITY ATTORNEY AN INCREASE IN SALARY AND FOR OTHER PURPOSES

 

Mr. Johnson moved that the rules be suspended and placed on 2nd reading, seconded by Mr. Darling, all aye.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE TO PROVIDE CERTAIN TRAFFIC CONTROL DEVICES: TO PROVIDE FOR PENALTIES FOR VIOLATIONS THEREOF: AND FOR OTHER PURPOSES

 

The following Ordinance was on 3rd and final reading:

 

AN ORDINANCE TO AMEND ORDINANCE #954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGES IN ZONING BOUNDARIES

 

Mr. Haggenmacher moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Bowers, all aye. The ordinance was given #1495.

 

Mr. Smith offered the following Ordinance: (1st reading Landfill annexation)

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED MARCH 18, 1976 ASSIGNING SAID ANNEXED TERRITORY TO WARD ZONING SAID ANNEXED TERRITORY COMMERCIAL (C-3) AND RESIDENTIAL (R-1), RESPECTIVELY, DECLARING AN EMERGENCY AND FOR OTHER PURPOSE

 

Mr. Sanderson offered the following Ordinance: (1st reading traffic control West school)

 

AN ORDINANCE TO PROVIDE CERTAIN TRAFFIC CONTROL DEVICES: TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF: AND FOR OTHER PURPOSES

 

 

Mr. Smith moved that the rules be suspended and the ordinance be placed on 2nd reading, seconded by Mr. Hinson, all voted aye.

 

Mr. Smith moved that the council rescind their previous action of deferring action on the equipment bids, and accept the bid from Hawkins Equipment, seconded by Mr. Burns with all members voting aye.

 

Mr. Bridger offered the following Ordinance: (Briarwood)

 

AN ORDINANCE AMENDING ORDINANCE NO. 1485 BY ADDING THE ZONING DESIGNATION TO THE ACCEPTANCE OF CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO

 

Mr. Minx moved that the rules be suspended and the ordinance be placed on second reading, seconded by Mr. Hinson. All voted aye. Mr. Minx then moved that the rules be suspended and the ordinance be placed on third and final reading, seconded by Mr. Bridger, all voted aye.

 

Mr. Bridger moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Darling, all voted aye. The Ordinance was given #1496.

 

Mr. Stricklin moved that a public hearing be scheduled for 6:30 p.m. April 19, 1976, for the closing of an alley in the Carson Addition. Motion seconded by Mr. Darling with all members voting aye.

 

RESOLUTION DATED 4/5/76 - APRIL 19 DATE FOR HEARING UPON THE PETITION OF THE ABUTTING PROPERTY OWNERS FOR THE ABANDONMENT OF A CERTAIN ALLEY IN THE CITY OF JONESBORO

 

The resolution was given the number 1976:06.

 

Mr. Stricklin offered the following resolution, seconded by Mr. Smith with unanimous vote of council.

 

RESOLUTION EXPRESSING APPRECIATION TO GENE GARDNER FOR HIS SERVICE TO THE CITY OF JONESBORO

 

The resolution was given the number 1976:05.

 

There being no further business, council adjourned.
