CITY COUNCIL MINUTES - FEBRUARY 6, 1989

 

The Jonesboro City Council met in regular session at 7.30 p.m. at City Hall. Present were Mayor, City Clerk, City Attorney, and all Aldermen.

 

The minutes of January 16, 1989, were approved as mailed on motion by Mr. Evans, seconded by Mr. Stricklin. All voted aye.

 

Mr. Stricklin offered the following ordinance for first reading:

 

AN ORDINANCE ADOPTING AND ENACTING A NEW MUNICIPAL CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, ESTABLISHING THE SAME; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN; EXCEPT AS HEREIN EXPRESSLY PROVIDED; PROVIDING FOR THE EFFECTIVE DATE OF SUCH CODE AND A PENALTY FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE MANNER OF AMENDING SUCH CODE AND PROVIDING FOR THE EFFECTIVE DATE OF THE ORDINANCE

 

Mr. Hannah moved, seconded by Mr. Stricklin to suspend the rules and place the ordinance on second reading. All voted aye. The ordinance was read for the second time. Mr. Hannah moved, seconded by Mr. Stricklin to suspend the rules and place the ordinance on third reading. All voted aye. Mr. Sanderson moved, seconded by Mr. Shelton to require Aldermen to return the Code Books to the City Clerk when they leave office or pay the publishing fee of $100.00 and to require Aldermen to sign a form verifying they had received a copy of the Code and to request the City Clerk to keep the book updated and provided copies to the Aldermen and Department Head of the update.

 

A roll call vote was taken and all voted aye. The ordinance was read for the third time. Mr. Hannah moved, seconded by Mr. Stricklin to adopt the ordinance with the emergency clause. All voted aye and the ordinance was given the number 2157.

 

Mr. Shelton offered the following ordinance for first reading:

 

AN ORDINANCE TO AMEND NO. 2146 OF THE CITY OF JONESBORO, ARKANSAS, TO ESTABLISH THE REQUIREMENTS AND PROCEDURES FOR ISSUING RENOVATION PERMITS FOR CONDEMNED STRUCTURES AND FOR OTHER PURPOSES.

 

Mr. Hinson moved, seconded by Mr. Nix to suspend the rules and place the ordinance on second reading. All voted aye. The ordinance was read for the second time. Mr. Nix moved, seconded by Mr. Evans to amend Section 11, 6th and 7th lines to read “authorized the City Attorney to bring such action” All voted aye. Mr. Sanderson moved, seconded by Mr. Shelton to suspend the rules and place the ordinance on third reading. All voted aye. Mr. Sanderson further moved, seconded by Mr. Evans to adopt the ordinance, as amended with the emergency clause. All voted aye. The ordinance was given the number 2158.

 

Mr. Evans offered the following ordinance for first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 1812 OF THE CITY OF JONESBORO, ARKANSAS; PROVIDING FOR HAND DELIVERY OF SIGNED WRITTEN NOTICES FOR VIOLATIONS OF CHAPTER 5.16 OF THE MUNICIPAL CODE OF THE CITY OF JONESBORO, ARKANSAS, TRANSFERRING ENFORCEMENT OF SAME TO A CODE ENFORCEMENT OFFICER AND FOR OTHER PURPOSES.

 

Mr. Nix moved, seconded by Mr. Hannah to amend the ordinance in section 1, line 12, to read, “within seven days after service of the notice” All voted aye. A discussion was held regarding placing a fine to cover charges of notification of property owners of condemned property of code non-compliance. Mr. Evans stated that efforts to enforce the code had been limited and that city employees have been spending great amounts of time warning property owners of violations and citing owners to court only to have the municipal court give offenders additional time to correct the problem. He suggested property owners be cited at the time of notification and then given seven days to correct the problem. Several Aldermen expressed concern over the legality of fining a property owner at the time of notification. City Attorney, Jim Burton stated that fines for non-compliance are specified in the ordinance and property owners could be fined $100 for the first offense and $200 for additional offense. Burton requested that he be allowed to research the matter before further consideration by the Council. The ordinance was left on first reading.

 

Mr. Shelton offered the following ordinance the first reading:

 

AN ORDINANCE TO AMEND CHAPTER 11.04.06 OF THE MUNICIPAL CODE OF THE CITY OF JONESBORO, ARKANSAS, TO SET THE TIME EXPIRATION FOR BUILDING PERMITS AND ESTABLISH RULES REGARDING BUILDING PERMITS FOR RENOVATION OF STRUCTURES WHICH ARE NOT CONDEMNED AND FOR OTHER PURPOSES

 

Mr. Hannah moved, seconded by Mr. Park to amend the ordinance in section #1 (h), line #7 to read, A “valued at more than three million dollars ($3,000,000.00)” A roll call vote was taken and all voted aye. Mr. Hannah moved, seconded by Mr. Park to suspend the rules and place on second reading. All voted aye. Mr. Hannah moved, seconded by Mr. Hinson to adopt the ordinance as amended. A roll call vote was taken and all voted aye. The ordinance was given the number 2159.

 

The following ordinance was on third reading:

 

AN ORDINANCE TO AMEND #954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR THE CHANGE IN ZONING BOUNDARIES

 

Mr. Stricklin moved, seconded by Mr. Park to adopt the ordinance with the emergency clause. All voted aye. The ordinance was given the number 2160.

 

The following bids were up for review:

 

89:05 - Tractor - Parks

Mr. Nix moved, seconded by Mr. Park to approve the low bid meeting specifications from Indian Country #1 for $7,360.92 (Long brand), with delivery time 15 days and a one year warranty. All voted aye.

 

89:06 - Mid-size pick up - Humane Mr. Park moved, seconded by Mr. Nix to accept the low bid meeting specifications from McCarty Motor Co. for $8,864.00 (Isuzu brand), with delivery time 10 days estimated, warranty 36/36. All voted aye.

 

Under new business, Mayor Brodell announced a news conference at 11:00 a.m. on February 7, 1989, at City Hall to recognize the work of the League of Women Voters and the Code Book Committee on the recodification of the Jonesboro Municipal Code Book.

 

Mr. Hannah requested the League of Women be contacted and urged to reconvene the public hearings held with legislators during the General Assembly.

 

Mr. Hannah offered a resolution regarding the placement of a stop sign at the intersection of Jill Dr. and Forest Hill Rd., with traffic on Jill Dr. stopping for traffic on Forest Hill Rd. Mr. Hannah moved, seconded by Mr. Park for the adoption of the resolution. All voted aye. The resolution was given the number 1989:06.

 

Dr. Strauser moved, seconded by Mr. Sanderson to appropriate $4,460 from unappropriated reserves of the General Fund to pay for the Jonesboro Transportation Model. All voted aye.

 

Dr. Strauser moved, seconded by Mr. Hannah to appropriate $7,500 from unappropriated reserves of the General Fund to Fixed Assets to acquire equipment for the Office of the City Planner. All voted aye.

 

Mr. Hannah moved, seconded by Dr. Strauser to purchase an additional police car to reclassify $7,200 from Training and Equipment line item to Fixed Assets. All voted aye.

 

Dr. Strauser moved, seconded by Mr. Hannah to charge 30 cent for all photocopying of ordinances, resolutions, and other documents, official and unofficial, including computer printouts, with the exception of Police Department documents. All voted aye. The resolution was given the number 1989:07.

 

With no further business, Mr. Sanderson moved, seconded by Mr. Stricklin to adjourn the meeting. All voted aye. The meeting adjourned at 8:37 p.m.
