AN ORDINANCE TO AMEND ORDINANCE NO. 1434, ARTICLE 2, LICENSING OF ELECTRICIANS, CONTRACTORS, ETC. AND FOR OTHER PURPOSES:

BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas, that Ordinance No. 1434 be amended as follows:
 
Section 1: All master electricians doing business in the City of Jonesboro, Arkansas, as a licensed electrical contractor shall file with the City Clerk a bond in the penal sum of $10,000.00 with an incorporated insurance company authorized to do business in the City as surety, which bond and surety shall be approved by the City Clerk. The Condition of such bond shall be that the principal and surety shall indemnify the City of Jonesboro for its own use and/or to any citizen against loss by improper electrical work; and the principal shall strictly comply with the ordinances of the City governing such work. The principal shall do or suffer no work to be done without a permit and will report work done for inspection to the Electrical Inspector and conform to the laws of the City of Jonesboro and State of Arkansas. The bond shall be renewed each year, not later than January 31. The provision increasing the bond to $10,000.00 shall become effective January 1, 1978.
 
Section 2: No master electrician shall be allowed to establish a business or obtain electrical permits without first having been licensed in the City of Jonesboro, Arkansas, subject, however, to the permit provision contained in paragraph 5 of this ordinance. No master electrician or electrical contractor shall permit any person other than his employees to use his license and/or permits.   
 
Section 3: Every person desiring to engage in any kind of electrical work or business as hereinafter defined shall, before engaging in such business procure a license from the Electrical Board by passing the Electrical Board exam, subject, however, to the permit provisions contained in paragraph 5 of this ordinance. Application for such license shall be made to the Electrical Inspector, in writing, which shall transmit the license application to the Secretary of the Board. Applicants shall deposit with the City Collector the following required examination fees:
 
(a) Master electricians      $100.00
(b) Journeyman electrician      10.00
(c) Electrical Maintenance Man         10.00
 
The above fee will include the license fee for the remainder of the year that the examination was passed. The renewal fee for a journeyman electrician and electrical maintenance man's license shall be $5.00 per year. The renewal fee for a master electrician's license shall be $10.00 per year. There is no fee for an apprentice. The examination fee will allow an individual to take two examinations to obtain an electrical license. An applicant who fails to pass or to take the examination for electrical license, within two examination periods shall not be eligible for a temporary permit as provided for in paragraph 5 nor shall the applicant be eligible to take another exam for one year from the date of applicant's last examination period. The City building official's office will provide the necessary forms for registering all master electricians, journeyman electrician, and electrical maintenance man upon the payment of the above license fee, payment of the applicable privilege tax, where applicable, and passage of the Electrical Board exam. The license must be carried by the electrician while working on the construction job or jobs, and must be shown to the electrical inspector, building official or the building official's authorized agent at his request. Any person not holding a current license card and performing electrical work will be required to halt the work until they show evidence that they are currently licensed to perform the work within the City of Jonesboro, Arkansas.
 
Section 4: The Board shall examine all applicants applying to do electrical work to determine their competency. All applications for the electrical examination shall be submitted no later than the first Thursday in April, the first Thursday in July, the first Thursday in October and the first Thursday in January. The examination will be given within fifteen working days from the first Thursday in April, the first Thursday in July, the first Thursday in October and the first Thursday in January. All applicants shall be notified in writing as to the time and place of testing not less than five days prior to the testing date. The examination will be graded within ten days from the date of testing. All applicants must be at least 18 years of age, pass the examinations prescribed by the Board and meet the following requirements:   
 
(a)      Master Electrician:
(1)      A master electrician is defined to be a person having the general charge and supervision of the business of installing electrical wires, electrical machinery, apparatus, devices and instruments.
(2)      The person must be a journeyman electrician with at least four (4) years practical experience as a journeyman in installing wires, conductors, and other electrical equipment, machinery, and apparatus used for the transmission of electrical current, for light, heat, power or signaling.
(3)      Must have a technical knowledge of such matters necessary to satisfactorily pass examinations provided by the board.
(4)      Education from a recognized college or university or technical school will be accepted as experience on the basis of one-half of the actual time spent in college in the electrical field can be counted as experience.
(5)      The time element of experience for all applicants for master electrician license must be substantially continuous before the date of this application.
(6)      Any person passing the examination and holding a master electrician's license shall not pursue employment or work for or serve more than one person, firm, or corporation at the same time.
(b)      Journeyman Electrician:
(1)      A journeyman electrician is defined as a person who has had at least four (4) years of practical experience doing electrical work under the supervision of a master electrician, and who shall pass an examination given by the Electrical Board determining his competency to install wiring for light, heat, power, or signaling.
(2)      Education time in the electrical field from any recognized college, university or technical school will be counted on the basis of one-hand of the actual time in school and will be counted as practical experience.
(c)      Electrical Maintenance Man:
1. An electrical maintenance man is defined as a person in charge of maintenance of electrical systems in plants, buildings and other places.
 
2. Such person shall be required to pass an examination given by the Board determining his knowledge of electrical machinery and systems.
 
3. He may be employed either full or part time, but may not act as an electrician other than in the installation and removal of equipment.
 
4. The electrical maintenance man would not be allowed to run circuits or feeders. This does not apply to City Water and Light plant employees.
 
(d)      Apprentice:
1.      An apprentice is defined as a person working in the learning of electrical systems. He will work under the direct supervision of a journeyman electrician and will be required to be registered with the City of Jonesboro, Arkansas.
2.      After four (4) years experience as an apprentice, the person will be eligible to take the journeyman electricians examination.
3.      There is no fee for the apprentice, but registration will be required to establish his eligibility. The City will furnish the necessary forms and cards for the registration of the apprentices.
4.      Apprentices may work for thirty (30) days before registration is made. Registration will begin at date of employment.
 
Section 5: The Electrical Board shall issue temporary permits to applicants who meet the qualifications and requirements to apply for the respective electrical license and who have applied for licensing and who have paid the applicable examination fee pending a scheduled examination. The temporary permit shall expire upon the applicants failing to take or pass the examination, for electrical license, within two examination periods.
 
Section 6: Notwithstanding the provisions contained in paragraphs 3 and 4 of this ordinance, any person who is legally employed as a master electrician or is engaged in business as an electrical contractor in the City of Jonesboro, Arkansas, on the effective date of this ordinance, shall be entitled to apply for and take the examination for electrical license.
 
Section 7: Any person who shall violate or fail to comply with the provisions of this ordinance or the rules and regulations of the Electrical Board shall be deemed guilty of a misdemeanor and subject to a fine of not less than $50.00 nor more than $200.00 or by imprisonment for not less than one day nor more than 30 days and/or both. Each day a person violates or fails to comply with this ordinance or the rules and regulations of the Electrical Board shall constitute a separate violation of this ordinance.
 
Section 8: If any of the provisions of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable.
 
Section 9: Section 8-17, 8-18, 8-25 and 8-26 are hereby specifically repealed. All other ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict.
 
Section 10: It is found and declared by the City Council of the City of Jonesboro, Arkansas, that there is a need to insure adequate licensing of electricians who work in the City of Jonesboro, Arkansas, to insure that the citizens of Jonesboro, Arkansas, are given adequate electrical work and that the electricians who work within the City of Jonesboro, Arkansas, are competent within their profession, and therefore, this ordinance being necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, and this ordinance shall take effect from and after its passage and approval.
