CITY COUNCIL MINUTES - AUGUST 3, 1987

 

The Jonesboro City Council convened at 7:30 p.m. at City Hall. Present were Mayor, City Clerk, City Attorney, and Aldermen Hannah, Park, Stricklin, Evans, Bridger, Shelton, Province, Mays, Sanderson, Strauser and Hinson. Alderman Nix was absent.

 

The Pledge of Allegiance was led by Ken Miller and Chief Dean Bradley gave the invocation.

 

The minutes of July 20, 1987, were approved as mailed on motion by Mr. Hannah, seconded by Mr. Stricklin. All voted aye.

 

Mr. Hannah offered the following ordinance for first reading: (Annexation- R. Griffin, et al, Hwy 18 E. W. of FMC, 33.7 acres)

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 6; ZONING SAID ANNEXED TERRITORY TO A-1 AND I-1; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

The following ordinance was on third reading: (Re: increase of $2 to $5 for Police Officers Training Fund)

 

AN ORDINANCE TO AMEND NO. 1787, SECTIONS 2 & 3, THE POLICE OFFICERS TRAINING FUND ORDINANCE, AND FOR OTHER PURPOSES

 

Mr. Hannah moved, seconded by Mr. Park for the adoption of the ordinance with the emergency clause. All voted in the affirmative. The ordinance was given the number 2044.

 

The following ordinance was on third reading:

 

AN ORDINANCE TO AMEND NO. 1916, SECTION 4, THE NORTHEAST ARKANSAS REGIONAL SOLID WASTE DISPOSAL AUTHORITY ORDINANCE AND FOR OTHER PURPOSES.

 

Mr. Hannah moved, seconded by Mr. Shelton for the adoption of the ordinance with the emergency clause. All voted in the affirmative. The ordinance was given the number 2045.

 

The following ordinance was on third reading and was read by the City Attorney: (Annexation- Henry Turner, Off Woodsprings Rd. & Neeley Rd. 87.6 acres)

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY CLERK OF CRAIGHEAD COUNTY, ARKANSAS; ASSIGNED SAID ANNEXED TERRITORY TO WARD 4; ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1), DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Asst. Fire Chief Wayne Masterson stated the Fire Department recommended installation of six- inch water mains and fire hydrants or the department could not provide adequate fire protection. The attorney representing the matter, Dennis Zolper stated one of his clients may object to the request and withdraw his petition. He asked aldermen to table the proposal until the matter could further be discussed with his clients. Mr. Hannah suggested the matter be handled subject to the same stipulation placed for the most recently adopted annexation of land whereby if streets are improved and other utilities and improvements are made, it will be done at the present or future property owners expense, and the city will not bear the expense, and this will be recorded and included in the abstract. Mr. Bridger then moved, seconded by Mr. Hannah to table action on the proposed ordinance until August 17, 1987. All voted in the affirmative.

 

Attorney Dennis Zolper requested the following two items be heard by the council and stated it was his secretary’s error in not notifying the City Clerk to place the items on the agenda for council consideration. Mr. Hannah objected to the request stating the two proposals were not given to the Clerk for inclusion on the agenda and added that at the meeting immediately preceding, a request has been made by the council of the MAPC liaison, Greg Moody and the Clerk to provide Aldermen with all necessary paperwork in order to give Aldermen time to view annexation proposals and city department heads time to submit data to aldermen. Mayor Brodell stated he thought his secretary had mailed a supplemental agenda to the Aldermen on Friday including the additional items, but aldermen stated they had not received said mailing.

 

Following discussion, Mr. Evans offered the following ordinance for first reading:

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS: ASSIGNING SAID ANNEXED TERRITORY TO WARD 2: ZONING SAID ANNEXED TERRITORY RESIDENTIAL (R-1, R-3, C-3, AG-1, I-1 AS SHOWN ON THE ANNEXATION PLAT); DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

 

Mr. Mays inquired about the I-1 reference and Mr. Zolper stated the ordinance would be revised for deletion and correction. Mr. Zolper asked city officials to notify him before August 17 of any restrictions placed on the proposed annexations in order for him to notify his clients in advance. Pete Gambill, abutting property owner voiced opposition to the annexation and inquired his rights as a citizen regarding the matter. Mr. Hannah stated, and it was confirmed by the City Attorney, that once the property is surrounded, property owners do not have a choice. Mr. Hannah told Mr. Gambill that he does have the right to file a petition with the City Clerk opposing the annexation.

 

The following bid was up for review:

 

87:35 - Pickup truck - mid size

Mr. Bridger moved, seconded by Mr. Shelton to approve the low bid meeting specifications from Sain GMC for $9,410.00. A roll call vote was taken. Aldermen Hannah, Park, Stricklin, Evans, Bridger, Shelton, Province, Mays, and Hinson voted aye. Aldermen Sanderson and Strauser voted aye. Aldermen Sanderson and Strauser voted nay. The motion passed 9-2.

 

Mayor Brodell stated the city had secured the services of Bill Bowers, former Street Supt. and Alderman, to help map, survey, and improve the drainage system in West Jonesboro. He added the city will receive personnel from Manpower and assistance from a Drainage District 30 to complete the work. Mr. Sanderson will assist with the program.

 

Mr. Hannah moved, seconded by Mr. Hinson to approve the placement of a mobile home at 4704 Samantha on a lot with an existing structure by the Building Inspector that the trailer be removed after a one year period or when the home is completed or occupied. All voted aye.

 

Mr. Hannah moved, seconded by Mr. Park to approve the placement of a mobile home at 608 Warren by Dub Mahon subject to a recommendation by the Building Inspector that the 3 lots be replatted into 1 lot on a 75 ft. frontage. All voted aye.

 

Mayor Brodell stated the Dept. of Pollution Control and ecology has agreed to extend the city’s landfill permit from August 15 to September 1 to give the Solid Waste Authority time to install a trash compactor. He said P C and E indicated this will be the last extension the city can expect.

 

With no further business, the meeting adjourned.
