February 8, 1968
body
Meeting called to order by Chairman A.E. Scott.
Minutes of the December and January meeting were read by Secretary Clay Kenward.
Mr. Scott explained to those present that this was a public hearing, and the commission would take each item in the order as listed on the agenda.
Item #1. The Malco Theatre rezoning of the plat west of their present C-3 plat. There was no one to talk about this matter.
Item #2. The Dean Ellis rezoning from R-1 to C-3. Mr. Strad Appleton presented his case against the rezoning, stated it would lower the value of his place, which joins it on the west, and he would probably have to move, and he did not want to move, nor have his property changed to commercial.
Item #3. Farmers Union, Mr. Howard Vance, stated that about all had been said about this that could be said. They just wanted to know if the commission would change to commercial or not. They wanted a decision.
Item #4-5. The changing of these two lots from R-1 to C-3, was to be considered with the Dean Ellis item, on No. 2. Mr. Brickell spoke about the need for the change, since he would not be surrounded by commercial.
Item #6. Briarwood Subdivision brought to the commission for final approval. Since the last meeting they wanted more information about the adjoining subdivision.
Item #7. Mrs. Opha Malone, to add to her store. Mr. Kenward said this had to come under by Board of Adjustment. Building Inspector Stewart said a nonconforming building to extend should come under the jurisdiction of this commission. He could not find the reference, so this was referred to the Board of Adjustment.
Item #8. Roy Sigler presented his case to rezone Lots 1 and 2 in Block K, Lots 1, 2, 3, and 4 in Block M and Lots 1, 2, 3, and 4 in Block N in Sigler Addition. He states that this was going commercial all around, and that he had several inquiries about he property, but could not really present it to anyone, until it was zoned commercial. He wanted it changed from R-1 to C-3.
Item #9. Wallace Fowler to change from R-1 to C-3, Lots 1, 2, 3, and 4 in Block J of Sigler College Addition. He presented his case, stating that had to get off Main Street because of parking. He was asked by Mr. Kenward if he would still keep a Main Street Store. He stated he would keep one uptown store. He further stated he had contacted all the adjoining property owners and they did not have any object to the store.
Item #10. J.W. Cowles, change from R-1 to C-3 and R-2 for his property at the corner of Browns Lane and Parker Road. Mr. Cowles stated his care, that the new Medical Center would be across Browns Lane from him, and this needed to be changed. Melton Addition, changing Lot A into three lots. IT was pointed out by Mr. Jarrett that this lots was partially in R-1, and not commercial. Inspector Stewart was asked to check the minutes to see if all of this was changed to commercial.
Item #11. Heights Subdivision to make three lots out of 4. Referred to CW and L for study of underground utilities.
Item #12. Preliminary study of ____________________ Subdivision by Guaranty. Mr. Gschwyn and Mr. Johnson presented their case for the subdivision, asking the commission if there is any further study or changes to be made.
CLOSED SESSION
Item #1. It was decided to ask Malco to build a street, 24 feet wide with curbs and gutters on the west side of their property, and that if the property to the west was made C-3, they too would have to build such a road. They further wasted access road or street from Bernard to the south of the Malco property to S. Caraway Road. These streets are to have a 30 foot right of way.
Item #2. Dean Ellis, Poling and Brickell items to be taken together. This was agreed to change to C-3 providing that buildings setback would be 60 feet from the center of S. Culberhouse. They agree to the Highway Department setback for the corner of Nettleton and S. Culberhouse. Any plans for development must go before the Planning Commission before any building permits are to be issued. Motion made by Mr. Jarrett and seconded by Mr. Ulmer to change from R-1 to C-3 with these conditions.
Item #3. Motion made by Mr. Jarrett and seconded by Mr. Falls that the request by Farmers Union be denied.
Item #8. After much discussion a motion was made by Mr. Jarrett and seconded by Mr. Harrison, that the request be granted, subject to highway department right of ways and setbacks, and that any development proposed must be approved by the planning commission before building permits are granted.
Item #9. After much discussion it was agreed to table this matter and asked that Glen Lane talk to Mr. Fowler and try to get all of the property from Sigler’s Addition to Douglas Bradley’s property zoned C-3.
Item #10. Motion made by Falls and seconded by Harrison to deny the request by Mr. Cowles to rezone his property until more is learned about the new Medical Center and bypass. Carried.
