CITY COUNCIL MINUTES DECEMBER 4, 1978

 

The Jonesboro City Council met December 4, 1978, at 7:30 p.m. in the Municipal Court Room. Present were Mayor, City Clerk and all elected aldermen. City Attorney Dennis Zolper was absent.

 

The minutes of November 20, 1978, were approved as mailed on motion by Mr. Park, seconded by Mr. Smith and all council voting aye.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE TO AMEND CHAPTER 13, ARTICLE 1 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, THE SAME DEALING WITH LICENSE AND PRIVILEGE TAXES

 

Mr. Minx offered the following amendment:

 

(Section 14: creating a Board of Review of nine members for the purpose of citizens seeking relief from license). Mr. Minx moved for the adoption of the amendment, seconded by Mr. Bridger, all voted aye.

 

Mr. Bridger offered the following amendment:

 

(105) MANUFACTURERS, to be based on number of employees as follows:

                     

(a.) From 1 to 50 employees                     $500.00

(b.) From 51 to 99 employees                     $1,000.00

(c.) From 100 to 199 employees                     $1,500.00

(d.) From 200 to 299 employees                     $2,000.00

(e.) From 300 and more                     $2,500.00

 

Mr. Bridger moved for the adoption of the amendment, seconded by Mr. Park, with Mr. Sanderson and Mr. Shepard casting dissenting votes. All others voted aye. Motion carried.

 

After a lengthy discussion on the matter and all citizens wishing to be heard had spoken, Mr. Shelton moved that the ordinance be adopted as amended, seconded by Mr. Park, with all council voting aye except Mr. Sanderson. The ordinance was adopted, and given #1664.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE TO AMEND SECTION 13-70 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, INCREASING THE LICENSE TAXES FOR ARKANSAS LOUISIANA GAS COMPANY AND THE TIME WHEN SAID TAXES WILL BE DUE

 

Mr. Stricklin moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Shelton. All voted aye and the ordinance, was given #1665.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE TO AMEND ORDINANCE #1249, AN ORDINANCE WHEREBY THE CITY OF JONESBORO, ARKANSAS AND SOUTHWESTERN BELL TELEPHONE COMPANY, A MISSOURI CORPORATION, AGREE THAT THE TELEPHONE COMPANY SHALL CONTINUE TO OPERATE ITS TELEPHONE SYSTEMS AND ALL BUSINESS INCIDENTAL TO OR CONNECTED WITH THE CONDUCTING OF A TELEPHONE BUSINESS AND SYSTEM IN SAID CITY AND ERECT AND MAINTAIN ITS PLANT CONSTRUCTION AND APPURTENANCES ALONG, ACROSS, ON, OVER, THROUGH, ABOVE AND UNDER ALL PUBLIC STREETS, AVENUES, ALLEYS, PUBLIC GROUNDS AND PLACES IN SAID CITY; THAT THE CITY SHALL RECEIVE AN ANNUAL PAYMENT FROM THE TELEPHONE COMPANY; AND REPEALING ALL ORDINANCES AND AGREEMENTS IN CONFLICT HEREWITH

 

On motion by Mr. Smith, seconded by Mr. Park and unanimous vote of council, the ordinance was adopted to include the emergency clause and given #1666.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED SEPTEMBER 11, 1978; PROVIDING FOR A ZONING CLASSIFICATION FOR SAID LANDS; ASSIGNING SAID ANNEXED TERRITORY TO WARD 3; AND FOR OTHER PURPOSES

 

Mr. Park moved for the adoption of the ordinance, seconded by Mr. Smith and all council voted aye. The ordinance was given #1667.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS; DATED JULY 24, 1978; PROVIDING FOR A ZONING CLASSIFICATION FOR SAID LANDS ASSIGNING SAID ANNEXED TERRITORY TO WARD 4, AND FOR OTHER PURPOSES

 

Mr. Stricklin moved for the adoption of the ordinance, seconded by Mr. Shelton, all voted aye and the ordinance was given #1668.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS: ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; ZONING ANNEXED TERRITORY COMMERCIAL (C-3); DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

 

Mr. Smith moved for the adoption of the ordinance to include the emergency clause, seconded by Mr. Stricklin. Mr. Sanderson voted nay, Mr. Bridger passed and all other voted aye. The ordinance was adopted and given #1669.

 

On recommendation of the Building Inspector, Mr. Smith moved that permission be granted for placing a mobile home at 200 W. Center. The motion was seconded by Mr. Hinson. After roll call, the motion was declared passed by eleven affirmative votes and one negative vote, that being cast by Mr. Minx.

 

Mr. Minx offered the following ordinance for council consideration:

 

AN ORDINANCE TO AMEND SECTION 10-11 OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO, ARKANSAS, INCREASING THE MONTHLY TRASH COLLECTION FEES FOR RESIDENTIAL UNITS BY $1.00 PER MONTH AND DECLARING AN EMERGENCY

 

On motion by Mr. Smith, seconded by Mr. Bridger and unanimous vote of council, the rules were suspended and the ordinance was placed on second reading.

 

Mr. Park offered the following ordinance:

 

AN ORDINANCE PROVIDING FOR CERTAIN TRAFFIC CONTROL DEVICES; TO PROVIDE PENALTIES FOR VIOLATIONS THEREOF; AND FOR OTHER PURPOSES

 

Mr. Park moved that the rules be suspended and the ordinance be placed on second reading, seconded by Mr. Hinson, all voted aye.

 

The following ordinance was on 2nd reading:

 

AN ORDINANCE CREATING THE DEPARTMENT OF CODE ENFORCEMENT FOR THE CITY OF JONESBORO, ARKANSAS; ESTABLISHING THE DUTIES, PRESCRIBING QUALIFICATIONS AND RESPONSIBILITIES OF THE DIRECTOR OF CODE ENFORCEMENT

 

Mr. Hannah moved that the rules be suspended and the ordinance be placed on third and final reading, seconded by Mr. Stricklin, all voted aye. After the reading, Mr. Hannah moved for the adoption of same, to include the emergency clause, seconded by Ms. Haigler, all voted aye and the ordinance was given #1670.                     

 

On motion by Mr. Hannah, seconded by Mr. Haigler, the traffic control ordinance, which had been read previously, be amended by placing a 20 MPH on Nelms Street. All council voted aye.

 

The following ordinance was on 3rd reading:

 

AN ORDINANCE ACCEPTING CERTAIN LANDS, ZONED R-1, ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, LOCATED IN WARD 3, BY ORDER OF THE COUNTY COURT DATED SEPTEMBER 11, 1978

 

Mr. Hinson moved that the ordinance be tabled for two weeks, seconded by Mr. Park, all voted aye.

 

There being no further business, council adjourned at 10:35 p.m.
