APPEAL HEARING - 5:45 P.M. - An appeal hearing was held regarding denial by the Metropolitan Area Planning Commission to rezone property from Residential (R-1) to Commercial (C-3), located on Stadium Boulevard south of Bunting Drive. Mr. Terry L. Henson requested the hearing, and addressed Council first. Mr. Henson stated he realized it was a small piece of property and that residential zoning surrounded it, but explained the property was annexed in as residential. He stated he was hopeful that this would encourage others in the area to rezone their non-conforming property. He stated he had a letter signed by all but one of his neighbors agreeing the property should be zoned Commercial (C-3). Mayor Brodell questioned the size of the lot. Mr. Henson responded that it was a little over a third of an acre (167 X 93 feet). The question was asked of City Planner, Jeff Hawkins, why did the MAPC recommend denial. Mr. Hawkins stated generally the MAPC felt the property was more suited for commercial purposes than residential purposes, but there should be a more comprehensive approach to determining zoning boundaries, than one non-conforming piece at a time. Mr. Henson stated there were several non-conforming properties operating as commercial in the immediate area.

 

PUBLIC HEARING - 6:05 P.M. - A public hearing was held for the purpose of vacating a portion of Marchbanks Circle and certain utility easements. Mr. Rick Wyatt stated he had been denied access to the property by the Highway Commission, and so the abandonment was necessary. Questions followed regarding the utility letters. Mr. Wyatt explained that the only letter not received was Southwestern Bell. City Clerk, Donna K. Jackson stated the only letter she had been provided was for Cox Communications. She requested copies of the letters be sent to her so they could be provided to Council.

 

PUBLIC HEARING - 6:15 P.M. - A public hearing was held for the purpose of vacating a portion of Baswell Street a/k/a Gwyndale Avenue, between Stadium Boulevard and Brazos Street. No opposition was voiced.

                     

CITY COUNCIL MINUTES - September 5, 2000

 

The Jonesboro City Council met Monday, September 5, 2000 at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Clerk Donna Jackson, City Attorney Phillip Crego, and 11 council members. Those members were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Crockett was unable to attend.

 

Councilman Perrin moved, seconded by Councilman Roddy to approve the minutes, from August 21, 2000 as provided earlier. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy.

 

Councilman Rega offered the following ordinance for first reading:

 

ORDINANCE AMENDING ORDINANCE 954, THE ZONING ORDINANCE TO REZONE FROM RESIDENTIAL (R-1) TO COMMERCIAL (C-3) LOCATED ON STADIUM BOULEVARD, SOUTH OF BUNTING DRIVE. (TERRY L. HENSON)

 

Councilman Rega moved, seconded by Councilman Moore to amend the ordinance to remove the wording, “as recommended by the Metropolitan Area Planning Commission”. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Tate moved, seconded by Councilman Perrin to suspend the rules and place on second reading as amended. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Copeland moved, seconded by Councilman Young to further suspend the rules and place on third reading as amended. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded Councilman Tate for the adoption of the amended ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned ordinance number 3243.

 

Councilman Perrin offered the following ordinance for first reading:

Councilman Perrin moved, seconded by Councilman McCall to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The decision was made to hold the ordinance on second reading until utility letters have been provided.

 

Councilman Tate offered the following ordinance for first reading:

 

ORDINANCE TO VACATED AND ABANDON A PORTION OF BASWELL STREET a/k/a GWYNDALE AVENUE, BETWEEN STADIUM BOULEVARD AND BRAZOS STREET.

 

Councilman Tate moved, seconded by Councilman Perrin to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Copeland moved, seconded by Councilman Young to further suspend the rules and place on third reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded Councilman Tate for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned ordinance number 3244.

 

Councilman Perrin moved, seconded by Councilman Kelton for the adoption of a resolution requesting City Water and Light to provide free services at the following locations:

 

•Electrical, Water and Utility Service to the new fire station located at 3215 E. Johnson

 

•Utility service to 2349 W. Matthews at the Oak Lawn Cemetery and at 311 Airport Road at the Nettleton Cemetery.

 

A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The resolution was assigned number 2000:35.

 

Under new business, Councilman Young offered the following ordinance for first reading:

 

ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE PURCHASE OF BERMUDA SOD FOR THE PARKS DEPARTMENT

 

Councilman Rega moved, seconded by Councilman Moore to suspend the rules and place on second reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Rega moved, seconded by Councilman Young to further suspend the rules and place on third and final reading. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. Councilman Young moved, seconded by Councilman Perrin for the adoption of the ordinance. A voice vote was taken resulting in all members voting aye. Those members voting aye were: Kelton, Tate, McCall, Young, Crockett, Rorex, Rega, Province, Copeland, Moore, Perrin and Roddy. The ordinance was assigned 3245.
