AN ORDINANCE AMENDING THE JONESBORO CODE OF ORDINANCES ESTABLISHING CITY COUNCIL MEMBERSHIP ON CERTAIN CITY BOARDS AND COMMISSIONS (NOTE: THIS ORDINANCE WAS AMENDED BY ORD-08:032 ON JULY 15, 2008; ORD-09:116 ON JANUARY 5, 2010)

WHEREAS, the City Council of the City of Jonesboro, Arkansas, has authority to select and/or approve members for certain city boards and commissions; and
WHEREAS, it is in the best interest of the City of Jonesboro and her citizens for those elected by the citizens to serve on these city boards and commissions; and
WHEREAS, there is a long-established history of City Council members serving on these city boards and commissions.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas that the Jonesboro Code of Ordinances is hereby amended and the following boards and commissions shall have one or two current City Council members as set out below as a board or commission member effective January 1, 2007 or the next expiration of a term thereafter:
SECTION 1: Title 2.76, entitled Advertising and Promotion Commission; Section 2.76.01 (B) of the Jonesboro Code of Ordinances shall be amended to read as follows: Two (2) members of the Advertising and Promotion Commission shall be members of the governing body.
SECTION 2: Title 2.64, entitled Municipal Airport Commission; Section. 2.64.02, of the Jonesboro Code of Ordinances shall be amended to read as follows: The Commission shall be composed of seven (7) citizens who are qualified electors of the state. At least one (1) of the seven (7) members shall be fully experienced in aviation, holding some type of pilot aeronautical rating; provided, however, that if there is not any citizen experienced in aviation, holding some type of pilot aeronautical rating, who is available or willing to serve on said Commission, then the City Council may waive this requirement. Provided further, no member of said Commission shall engage financially in any aeronautical enterprise while a member of the Commission. (Sec. 3-32, 1962 Code) A.C.A. 14-359-104, Ord. SECTION 3: Title 2.64, entitled Municipal Airport Commission; Section. 2.64.03, of the Jonesboro Code of Ordinances shall be amended to read as follows: The commissioners shall be appointed by the Mayor and confirmed by a three-fourths (3/4) vote of the duly elected and qualified members of the City Council and shall hold office for a term of five (5) years provided that the commissioners first appointed and confirmed after the passage of this chapter shall serve for terms of one (1), two (2), three (3), four (4), and five (5) years each, to be designated by the Mayor and hereafter, upon the expiration of their respective term, their successors shall be appointed by the Mayor, subject to the approval of three-fourths (3/4) of the duly elected and qualified members of the City Council for a term of five (5) years. Two (2) members of the Municipal Airport Commission shall be members of the governing body; and at least one of he council members shall be a member of the Finance Committee. The commissioners shall file the oath required by law in the state of Arkansas. Any commissioner may be removed upon a three-fourths (3/4) vote of the duly elected and qualified members of the City Council. Any and all vacancies on the Commission shall likewise be filled by appointment of the Mayor, subject to confirmation by the City Council. The City Council retains the authority to fix and prescribe, by appropriate resolution, any compensation to be paid to commissioners; however any current member of the governing body shall not receive said compensation. SECTION 4: Title 2.72, entitled Auditorium Commission; Section 2.72.01 of the Jonesboro Code of Ordinances shall be amended to read as follows: Two (2) members of the Municipal Auditorium Commission shall be members of the governing body.
SECTION 5: Title 2.60 entitled City Water and Light Board shall be amended by the addition of Section 2.60.07, entitled City Council Members and shall read: Two (2) members of the City Water and Light Board shall be members of the governing body; and at least one council member shall be a member of the Finance Committee.
SECTION 6: Title 5.04 entitled Solid Waste Authority, Section 5.04.04, shall be amended to read as follows: Two (2) members of the Solid Waste Authority shall be members of the governing body; and shall be a member or members of the Finance Committee and/or Public Works Committee.
SECTION 7: Title 2.80 entitled Northeast Arkansas Industrial Development Commission, Section 2.80.03, shall be amended to read as follows: A minimum of one (1) not to exceed two (2) members of the Northeast Arkansas Industrial Development Commission shall be members of the governing body; and at least one council member shall be a member of the Finance Committee.
SECTION 8: All ordinances or part of ordinances in conflict herewith are repealed to the extent of the conflict.
SECTION 9: The provisions of this ordinance are hereby declared to be severable and if any section, phrase or provision shall be declared or held invalid, each invalidity shall not affect the remainder of the sections, phrases or provisions.
