CITY COUNCIL MINUTES - JANUARY 20, 1997

 

The Jonesboro City Council met Monday, January 20, 1997, at 6:30 p.m. A full quorum was in attendance. Present were: Mayor Hubert Brodell, City Clerk, Donna K. Jackson, City Attorney; Phillip Crego, and 11 council members. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Rega was absent due to official business.

 

The minutes of January 6, 1997, were approved as delivered by Councilman Young and seconded by Councilman Roddy. A voice vote was taken resulting in all council members voting aye. Those members voting aye were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy.

 

The following ordinance was on the third reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (David Abernathy)

 

Councilman Tate moved, seconded by Councilman Young for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. The ordinance was given the number 2752.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 954 KNOWN AS THE ZONING ORDINANCE PROVIDING FOR CHANGES IN ZONING BOUNDARIES AND FOR OTHER PURPOSES (John T. Douglas)

 

Councilman Young moved, seconded by Councilman Bowers to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. No further action was taken after the ordinance was read for the second time.

 

Councilman Roddy offered the following ordinance for the first reading:

 

AN ORDINANCE TO AMEND ORDINANCE NO. 14.08.02 KNOWN AS THE R-1 RESIDENTIAL ZONING DISTRICT, OF THE CODE OF ORDINANCES OF THE CITY OF JONESBORO TO ALLOW PRIVATE SCHOOLS.

 

After the first reading, discussion followed with Councilman Kelly expressing concern over Pre-Schools being separate and apart from primary & secondary schools in Residential (R-1) zoning. Mayor Brodell stated that under 509-A any school must meet certain guidelines. However, City Attorney, Phillip Crego explained that 509-A and 501C3 were merely tax exemptions for non-profit organizations and foundations. Mr. Crego agreed with Councilman Kelly stating that as the ordinance was written any one could establish a preschool separate from any primary or secondary school. Councilman Kelly moved, seconded by Councilman Kelton to amend the ordinance as follows: (Original wording) (a) (3) Community uses. Public parks, playgrounds and open spaces; churches, public schools and utility or governmental facilities. Private, not for profit (501C3 or 509A), nonvocational, non-therapeutic or non-rehabilitative teaching institutions providing preschool, kindergarten, primary or secondary education with the intent of providing a traditional education experience. (Amended To Read) (a) (3) Community uses. Public parks, playgrounds and open spaces; churches, public schools and utility or governmental facilities. Private, not for profit (501(C)3 or 509(A)), non-vocational, non-therapeutic, non-rehabilitative, non-recreational teaching institutions providing primary or secondary education, which may include preschool or kindergarten, with the intent of providing an education. Councilman Young moved, seconded by Councilman Tate to suspend the rules and place on the second reading. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Kelly moved, seconded by Councilman Young to further suspend the rules and place on the third and final reading. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. Councilman Tate moved, seconded by Councilman Kelton for the adoption of the ordinance. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. The ordinance was given the number 2753.

 

The following resolutions were reviewed:

 

Councilman Kelton moved, seconded by Councilman Roddy for the adoption of a resolution setting a public hearing for February 3, 1997, at 6:10 p.m. for the purpose of vacating a five (5) foot utility easement on the north property line of 304 Windover Road. Mr. Jim Darnell had requested this public hearing. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given the number 1997:02.

 

Councilman Bowers moved, seconded by Councilman Young for the adoption of a resolution naming the following positions to serve in the election for City Water & Light Plant:

A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given the number 1997:03.

 

Councilman Tate moved, seconded by Councilman Rorex for the adoption of a resolution increasing Residential Sanitation Rates from $8.00 to $12.00 for curb-side pick up and from $12.00 to $16.00 for rear door pick up. Councilman Province inquired about Code Enforcement for trash cans left at the curb for long periods of time. Mayor Brodell stated there would be a Sanitation Committee meeting and Code Enforcement would be discussed. Councilman Bowers questioned why the resolution was necessary since the increase had been approved in the 1997 budget ordinance. It was explained that the resolution was for compliance purposes only. Jonesboro Municipal Code requires sanitation rates be set by resolution. Councilman Bowers questioned why sanitation collections had increased so drastically in 1995. It was explained that in 1995, 13 payments were posted in the 1995 budget, while only 11 payments were posted in the 1996 budget causing a dramatic percentage increase. Councilman Bowers expressed concern over a 50% increase rather than a gradual increase for Sanitation fees. Councilman Tate explained that there had not been an increase in ten years. Mayor Brodell reminded Council that they do not have control over Craighead County Regional Solid Waste Disposal Authority tipping fees, and these fees have doubled in the last six years. A voice vote was taken resulting in all council members voting aye with the exception of Councilman Bowers who voted nay. Those members voting aye were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, and Roddy. The resolution was given the number 1997:04.

 

Councilman Tate move, seconded by Councilman Kelly for a resolution to condemn property at the following locations:

 

213 Pine Street Robert Hall, Owner

301,303, And 305 South Madison Street Hope Foundation, Owner

 

Rev. Carl J. Henley addressed the Council as Director of the Hope Foundation. Rev. Henley stated the buildings were in compliance except for the ceiling and porch. Mr. Brian Wadley of the Planning and Inspection Department informed Council that Rev. Henley has been working on this property for two years. In August of 1996 a sixty (60) day extension was granted to Rev. Henley, but since that time no visible progress has been made to the property. A voice vote was taken resulting in all council members voting in favor of the resolution. Those members voting aye were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy. The resolution was given the number 1997:05.

 

Councilman Kelton moved, seconded by Councilman Roddy to approve Doyle Gillam and Bob Adams to the Board of Adjustment and Appeals with both terms to expire January 2000. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Under new business, Mayor Brodell informed Council of the transfer of T.C.I. franchise to T.C.A. The Mayor stated he had given a transfer ordinance to City Attorney, Phillip Crego and the ordinance would be introduced at the next council meeting.

 

Councilman Kelton informed the Council of a Fire Committee meeting, Wednesday, January 22, 1997, at 6:00 p.m. in the Fire Chiefs Office.

 

Councilman Kelly reported the Information Systems & 911 Committee would meet in the training room on Thursday, January 23, 1997, at 1:00 p.m.

 

Councilman Tate stated the Street Committee had met regarding the purchase of a Tract Excavator and recommended purchasing from United Equipment, being low bid meeting bid specifications. Councilman Young moved, seconded by Councilman Roddy to accept the low bid meeting bid specifications. A voice vote was taken resulting in all council members voting aye. Those members were: Kelton, Rorex, Province, Kelly, Tate, Crockett, Pratt, Young, Fletcher, Bowers, and Roddy.

 

Councilman Crockett informed Council of an Audit and Grants Committee meeting for Thursday, January 23, 1997, at 4:00 p.m. at 314 W. Washington.

 

Councilman Roddy announced a Sanitation Committee meeting for Tuesday, January 21, 1997, at 8:30 a.m. in the Mayors Office.

 

With no further business, the meeting was adjourned.
