BE IT ORDAINED BY THE CITY COUNCIL OF JONESBORO, ARKANSAS:
SECTION I: CHAPTER 117, KNOWN AS THE ZONING ORDINANCE OF THE CITY OF JONESBORO, ARKANSAS BE AMENDED AS RECOMMENDED BY THE METROPOLITAN AREA PLANNING COMMISSION BY THE CHANGES IN ZONING CLASSIFICATIONS AS FOLLOWS:
FROM: R-1, SINGLE-FAMILY MEDIUM DENSITY DISTRICT
TO: C-3 LUO, GENERAL COMMERCIAL DISTRICT LIMITED USE OVERLAY
THE FOLLOWING DESCRIBED PROPERTY:
LEGAL DESCRIPTION:
A part of the Northwest Quarter of the Southeast Quarter of Section 36, Township 14 North, Range 3 East, Craighead County Arkansas, being more particularly described as follows:
BEGINNING at the Southeast Corner of Lot 1 Block G of Southern Hills; Thence North 00°39'38" East, 603.43 feet to the POINT OF BEGINNING; Thence North 00°39'38" East, 245.94 feet; Thence with a curve to the right, with a radius of 1274.89 feet, 62.41 feet, to a point which bears South 80°11'05" East, 62.40 feet from the last said point; Thence South 75°17'56" East, 867.41 feet; Thence with a curve to the left, with a radius of 1000.08 feet, 83.37 feet, to a point which bears South 77°41'14" East, 83.35 feet from the last said point; Thence South 00°09'02" East, 172.90 feet; Thence South 89°20'58" W, 159.83 feet; Thence with a curve to the right, with a radius off 198.51, 59.69 feet to a point which bears South 07°51'57" West, 59.47 feet from the last said point; Thence North 75°17'56" West, 682.99 feet; Thence North 00°11'54" East, 62.36 feet; Thence North 89°48'06" West, 156.84 feet to the POINT OF BEGINNING, containing 5.73 acres more or less and being subject to all right of way and easements of record.
SECTION II: THE REZONING OF THIS PROPERTY SHALL ADHERE TO THE FOLLOWING STIPULATIONS:
1. That the proposed site shall satisfy all requirements of the City Engineer, all requirements of the current Stormwater Drainage Design Manual and Flood Plain Regulations regarding any new construction.
2. A final site plan subject to all ordinance requirements shall be submitted, reviewed, and approved by the Planning Department, prior to any redevelopment of the property.
3. Any change of use shall be subject to Planning Department approval in the future.
4. A final site plan illustrating compliance with site requirements for parking, signage, landscaping, fencing, buffering, outdoor storage, dumpster enclosure, sidewalks etc. shall be submitted to the Planning Department prior to any redevelopment.
5. This Limited Use Overlay (LUO) allows the following uses:

SECTION III: THE CITY CLERK IS HEREBY DIRECTED TO AMEND THE OFFICIAL ZONING DISTRICT BOUNDARY MAP OF THE CITY OF JONESBORO, ARKANSAS, INSOFAR AS IT RELATES TO THE LANDS DESCRIBED HEREINABOVE SO THAT THE ZONING CLASSIFICATION OF SAID LANDS SHALL BE IN ACCORDANCE WITH THE PROVISIONS OF THIS ORDINANCE.
