AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT DATED NOVEMBER 6, 1968; ASSIGNING SAID ANNEXED TERRITORY TO WARD 5; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of certain lands to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, Western District, on September 30, 1968; and
WHEREAS, said petition for the annexation of said lands was signed by a majority of the real estate owners owning a majority of the acreage to be annexed to the City of Jonesboro; and
WHEREAS, an Order setting a hearing on said petition was entered, notice was duly published of said hearing and hearing upon said petition was duly had and held in the County Court on November 6, 1968, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, whereupon an Order of annexation was made and entered; and
WHEREAS, thirty days have expired since the Order of annexation dated November 6, 1968, and no proceedings to prevent said annexation have been filed in the Circuit Court for the Western District of Craighead County, Arkansas:
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jonesboro, Arkansas:
Section 1: The territory and lands annexed to the City of Jonesboro, Arkansas, by Order of the County Court of Craighead County Arkansas, Western District, dated November 6, 1968, be, and they are hereby, accepted by the City of Jonesboro, Arkansas, and said territory, hereinafter described, shall hereafter be deemed and taken to be part and parcel of the limits of the City of Jonesboro, Arkansas, and inhabitants residing therein shall have and enjoy all the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows:
Begin at the Southeast Corner of the Southwest Quarter of the Southwest Quarter of Section 25, Township 14 North, Range 3 East, thence North along the Quarter Section Line, which is the present City Limits Line, 390 feet; thence West 1304 feet to the Section Line between Section 25 and 26; thence North along the Section Line 1315.1 feet; thence West along the North line of the Southeast Quarter of the Southeast Quarter of Section 26, 1323 feet to the Quarter Corner; thence South along the Quarter Section Line 1317.3 feet to the Section Line; thence East along the Section Line 2622.4 feet to the point of beginning.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City are hereby assigned and attached to Ward 5.
Section 4: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that immediate plans for development of the area hereby annexed to the City of Jonesboro, Arkansas, require the immediate extension of fire, police, zoning, water and other protection and benefits in order to allow the orderly growth and development of said lands and territory and an emergency is hereby declared to exist and this Ordinance being necessary for the preservation and protection of the public peace, health and safety, shall take effect and be in full force from and after its passage.
