AN ORDINANCE ACCEPTING CERTAIN LANDS ANNEXED TO THE CITY OF JONESBORO, ARKANSAS, BY ORDER OF THE COUNTY COURT OF CRAIGHEAD COUNTY, ARKANSAS, ASSIGNING SAID ANNEXED TERRITORIES TO WARD FIVE; DECLARING THE ZONING FOR THE ANNEXED TRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES

WHEREAS, a petition for the annexation of a particular tract to the City of Jonesboro, Arkansas, hereinafter described, was duly filed in the County Court of Craighead County, Arkansas, on June 9, 1987; and
WHEREAS, said petition for the annexation for these lands was duly assigned by all of the owners of the tracts to be annexed to the City of Jonesboro, Arkansas, and
WHEREAS, an order setting a hearing upon said petition was entered, notice was duly published of said hearing and a hearing upon said petition was duly had and held in the County Court of Craighead County, Arkansas, on July 14, 1987, at which hearing it was duly found and declared that said petition for annexation was right and proper and that such lands hereinafter described should be annexed to the City of Jonesboro, Arkansas; whereupon an order of annexation was made and entered; and
WHEREAS, thirty days having expired since the order of annexation dated July 14, 1987, and no proceedings to prevent said annexation having been filed in the Circuit Court for the Jonesboro District of Craighead County, Arkansas, said annexation proceedings were in all things confirmed by the County Court of Craighead County, Arkansas, by its order of August 20, 1987.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JONESBORO, ARKANSAS:
Section 1: All of the territory and lands annexed to the City of Jonesboro by order of the County Court of Craighead County, Arkansas by its order of July 14, 1987, be and they are hereby accepted by the City of Jonesboro, Arkansas and said territory hereinafter described shall be hereafter deemed and taken to be a part and parcel of the limits of the City of Jonesboro, Arkansas, and the inhabitants residing therein shall have and enjoy all of the rights and privileges of the inhabitants within the original limits of the City of Jonesboro, Arkansas.
Section 2: The portion of lands and territory hereby annexed to and accepted by the City of Jonesboro, Arkansas, are more particularly described as follows: (David Pyle)
Mardis Third Subdivision, Jonesboro Arkansas, (as recorded in Book 179, Page 69) part of the Southeast Quarter of the Northeast Quarter of Section 6, Township 13 North, Range 4 East, LESS AND EXCEPT, Lot 1, Block A, Lot 3, Block B, Lot 1, Block C, and re-plat of Lots 4, 5 & 6, Block A (as recorded in Book 198, Page 86) containing 23.43 acres, more or less, and the South 390 feet of the East 466.0 feet of the Southeast Quarter of the Northeast Quarter of Section 6, Township 13 North, Range 4 East, Craighead County, Arkansas, containing 4.17 acres, more or less, the above said Tracts contain 27.60 acres, more or less in all in Section 6, Township 13 North, Range 4 East, and, A tract of land being a part of the southwest Quarter of the Northwest Quarter of Section 5, Township13 North, Range 4 East, Craighead County, Arkansas, and being more particularly described as follows: Commencing at the West Quarter Corner of Section 5, Township 13 North, Range 4 East: thence North 1˚03’ East 1544.2feet along the West line of aforesaid Section 5; thence North 87˚54’ East; 420.1 feet; thence South 1˚03’ West 1562.90 feet to the South line of aforesaid Southwest Quarter of the Northwest Quarter of Section 5; thence North 89˚32’ 19® West 419.5 feet along aforesaid South line to the Point of Beginning Proper containing 14.96 acres, more or less.
TOTAL ACRES included in Section 5 and Section 6, Township 13 North, Range 4 East is 42.56 acres, more or less, in all.
Section 3: The lands and territory annexed to the City of Jonesboro and hereby accepted by the City of Jonesboro are assigned and attached to Ward Five (5).
Section 4: Said lands and territory annexed to the City of Jonesboro are hereby classified for purposes of zoning as Residential -1.
Section 5: It is hereby found and declared by the City Council of the City of Jonesboro, Arkansas, that there is now an extreme urgency that the territory herein be immediately annexed to and accepted by the City of Jonesboro, Arkansas, so that said property and the citizens and property owners of said territory described and herein can be entitled to fire, police, zoning an other protection and benefits and that said benefits and protection are urgently needed now in order to allow orderly growth and development of said lands and territory. Therefore, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace, health and safety, it shall take effects and be in full force from and after its passage.
